The Department of Legal Metrology, Under the Government of Goa, issued a notification on 28th July 2022 notifying about the Goa Legal Metrology (Amendment) Rules, 2022, to amend the Goa Legal Metrology Rules, 2011. The draft rules “Goa legal Metrology (Amendment) Rules, 2022” for the same purpose were published on 28th April 2022 and have been further finalized for Amendment.

Overview of the Department of Legal Metrology

The name of the “Department of Legal Metrology” has been changed from its previous name “, The Department of Weights And Measures”, by a notification issued by the Government. As the new name suggests, the legal metrology department is based on regulations related to weights and measures, informing about the methods of measurements and measuring tools in favour of public safety.

The Legal Metrology Department is one of the most vital organs of Consumer protection. It plays an important role in providing Citizens with helpful Administration Services. It is concerned with statutory and technical requirements to safeguard the Public Interest for security, the accuracy of weights and measures, etc.

The Department of Legal Metrology has finalized the Goa Legal Metrology (Amendment) Rules, 2022, for the Amendment of the Goa Legal Metrology Rules, 2011.

The Department of Legal Metrology has control over the following-

  • Weights, Measures, etc.
  • Trader
  • Offender
  • Manufacturer
  • Dealer
  • Repairer

Functions of Controller, Legal Metrology

The Duties and responsibilities of the Controller Legal Metrology originated from the Legal Metrology Act, 2009, Goa Legal Metrology Rules, 2011 and Legal Metrology Packaged Commodities Rules, 2011. Following are the functions of the Controller of the Department of Legal Metrology-

  • It acts as the Head office of the Legal Metrology Department
  • It performs Supervision of sub-ordinate staff, Assistant Controllers, and Inspectors throughout Goa
  • It takes charge of the Administrative work of the Head office
  • It implements Plan Matters
  • It acts as a budget-controlling authority
  • It also acts as First Appellate Authority under the RTI or Right to Information Act, 2005[1]

Regulations of Goa Legal Metrology (Amendment) Rules, 2022

The Department of Legal Metrology, under the Government of Goa, has finalized the Goa Legal Metrology (Amendment) Rules, 2022, for Amendment of the Goa Legal Metrology Rules, 2011. The Rules came into force on 1st September 2022. For Schedules II and III appended to the Goa Legal Metrology Rules, 2011, new Schedule II and III have been substituted in the new Amendment, Which is as follows-

Schedule II: The Amendment of Schedule II Specifies Licencing fees and renewal fees for manufacturers, repairer or dealers of weights and measures

The details specified by Schedule III are as follows-

  1. Issue of licence/renewal of licence to Manufacturer, Repairer and Dealer
  2. Alteration of Licence
  3. Issue of Duplicate Licence

Schedule III: The Amendment for Schedule III specifies about Fees which is to be paid for the verification and Stamping of Weights and Measures, Weighing and Measuring Instruments

The details specified by Schedule III are as follows-

  1. Weights
    • Bullion Weights
    • Brass Weights (other than Bullion)
    • Sheet metal Weight (other than Bullion)
    • Carat Weights
    • Cylindrical Knob Type Weights
    • Iron and Steel Weights
    • Standard weights for testing of High Capacity Weighing Machines
  2. Capacity Measures / tank lorry / storage tank
  3. Length Measures
    • Non-Flexible
    • Fabric / Plastic
    • Woven
    • Steel tapes
    • Folding Scales
    • Surveying Chain
  4. Beam Scale Class A & B
  5. Beam Scales Class C & D
  6. Non-Automatic Weighing Instruments, Mechanical (Analogue indication) / digital belonging to ordinary and medium accuracy class III & IV
  7. Non-Automatic Weighing Instruments, digital belonging to ordinary and medium accuracy class III & IV
  8. Weighing instruments of high accuracy class and special accuracy in both mechanical and electronics class II & I
  9. Automatic Weighing Instruments
  10. Volumetric measuring instruments
  11. Flow / Bulk meters
  12. Linear Measuring Instruments
  13. Clinical Thermometer
  14. Blood Pressure Measuring Instrument
  15. Water Meter
  16. Kitchen Scale
  17. Tubular balance
  18. A person weighing machine, excluding bath room scales
  19. Bathroom Scales: 120 kg and above
  20. Baby or child weighing Scales
  21. Peg or liquor measure
  22. Automatic Rail weighbridge
  23. Automatic Gravimetric Filling Instruments (it includes fill in ml or litre or Multiples thereto)
  24. Discontinuous totalizing automatic weighing instruments (Totalizing Hopper Weighers)
  25. Compressed Natural Gas
  26. LPG
  27. Continuous totalizing automatic weighing Instruments (Belt Weighers)
  28. Automatic-in-motion road weighbridge
  29. Weights for high-capacity weighing machines
  30. Tapes for use in the measurement of Oil quantities

Conclusion

The Goa Legal Metrology (Amendment) Rules, 2022 have brought various changes in the department of Legal Metrology of Goa. The Amendment has been implemented to Schedule II and Schedule III to make new rules regarding the Licensing fees and renewal fees for manufacturers, repairers or Dealers, and Fees payable for the verification and stamping of weights and measures.
