A forest clearance certificate or NOC is a formal approval issued by MoEF&CC or any other relevant State Forest Department, thereby authorizing the user agencies to divert forest land for non-forest purposes.

Users intending to file an application for the grant of a forest clearance certificate for non-forest purposes can either visit the Nodal Officer of the respective State or Union Territory or file an online application on the PARIVESH portal of MoEF&CC after completing the registration on the portal.

The list of mandatory forms needed to be filed to obtain the forest department NOC are as follows: Form A filed under section 2 (ii) for the diversion of allocated fresh forest land or any portion thereof for any non-forest purpose; Form A filed under section 2 (iii) for leasing forest land or any portion thereof to any private person or authority owned or managed by the Government of India; Form B filed for the renewal of the lease of forest land granted under Form A; Form C filed for obtaining prior approval for the prospecting of minerals; Form D filed under section 2(iii) for signing of the lease agreement; Form E filed to report any changes in land use; Form F filed for the transfer of lease/ change in the user agency name; Form H filed to report any amendment of Forms A, B, C, & D.

PARIVESH, which stands for Pro-Active and Responsive facilitation by an Interactive, Virtuous and Environmental Single-window Hub, is a web-based workflow application launched by the Government of India to enable online submission and monitoring of proposals from proponents seeking Environmental, Forest, Wildlife, and CRZ clearances from the respective authorities.

The final forest clearance certificate remains valid for the entire lifecycle of the project or lease, as specified in the approval letter. However, for mining projects, validity periods may range from 20 to 30 years.

The specific conditions under which obtaining a forest clearance NOC is prohibited include activities causing significant ecological damage, projects located within the critical wildlife habitats, unauthorized use or encroachment of forest land, commercial exploitation of forest land, activities threatening endangered biodiversity-rich areas, and diversion of forest land without approval from the Government of India.

Forest land includes reserved forests, protected forests, village forests, unclassed forests, deemed forests, land recorded as forest in the official government records, or any private land recorded as forest in revenue records.

The environmental and tribal laws applicable for obtaining a forest clearance certificate in India include the Forest (Conservation) Act, 1980; the Forest Rights Act, 2006; the Indian Forests Act, 1927; the Environmental (Protection) Act, 1986; and the Wildlife (Protection) Act, 1972.

The projects that require obtaining forest clearance NOC from the respective departments are nuclear power-related projects, river valley projects, petroleum refineries, chemical fertiliser industrial projects, petrochemical complexes, synthetic rubber manufacturing projects, asbestos and asbestos-based industrial projects, thermal power plants, highway projects, etc.

The areas that are mandatorily taken into consideration for notified forest blocks are the map area as determined through the DGPS survey, or any other areas specified in the available ROR.

Compensatory afforestation approval is a mandatory clearance under the Forest (Conservation) Act and is required when forest land is diverted for non-forest purposes. Compensatory afforestation requires the user agency to provide CA land or deposit CA charges as directed by the competent authority.

Stage 1 approval, commonly known as in-principle approval for forest clearance, is a conditional agreement granted to divert forest land for non-forest purposes. It allows user agencies to proceed only after fulfilling specific conditions, such as depositing the NPV, transferring CA land to the forest department, and meeting other implementation requirements.

The Ministry of Environment, Forest, and Climate Change (MoEF&CC) is the authority responsible for granting a forest clearance certificate in compliance with the Forest (Conservation) Act, 1980.
