  • Appeal filing- in case a decision is made against you, then we will file an appeal within 60 days.

Consequences may include monetary penalties and other regulatory action- expect to pay anything between INR 2,000 and INR 1 lakh, based on the seriousness and repeatability of your violation. You can also face criminal prosecution and jail time in case of severe issues.

Yes, some offences are compoundable under the legal metrology law, meaning they can be settled via penalties, and you don’t have to go through the hassle of long and expensive court cases. Key violations are:
  • Use, sale, or delivery of non-standard weight and measurement under section 25-31.
  • Anything related to the identification, verification, and inspection of weight instruments- section 33-37.
  • Using non-standard packaging under section 38.
  • Violations relating to declaration on pre-packaged goods- section 39.
  • Tampering with weights and quantities under section 45-47.
You should note that if there are second offences under these sections, then it will be a little difficult to get settlements via compounding.

That depends on your due dates and how fast you review the notice and prepare a response. For example, you will have at least 7 to 15 days to send your response.
  • Review by the Metrology Department: 6 to 7 days.
  • Settlement/compounding: 7 to 14 days.
  • Take note that you will have at least 15 days to pay the compounding fine.

Here's a generic idea of what all you should put in your packaging:
  • Name of the manufacturer, packer, or importer.
  • Generic name of the product.
  • Net quantity with accurate weight, measurements, and numbers.
  • Date of manufacturing/packing.
  • Maximum retail price (inclusive of all taxes).
  • Name, address, email ID, and phone number for consumer complaints, as applicable
  • Best before/use before/expiry date, as applicable.
  • You should also include per Kg/gm rate- mostly for food-packet goods.
  • Declaration in Hindi/English or any other language as per the state.
Also, if you are an online seller, then make sure to put all the details on your website/digital network where you sell your goods.

Of course, it is a serious violation to hide the actual rate with a made-up one because, first, it's a fraud, and secondly, it's basically misleading to the public. Any such non-compliance can hold you up with a penalty of INR 5,000 or more if it's your first offence. Penalties for recurring violations are higher.
