Overview of FSSAI State License

Any business person who wants to start a food business has to register for FSSAI License. It is mandatory for Small and medium-sized manufacturers, retailers, distributors, marketers, etc. engaged in the food business and related activities to obtain the State FSSAI License. The FSSAI monitors the business operations and is responsible for issuing the FSSAI License to the food business operators.

The food business operator shall have a business in only one state to obtain this license. This license applies to all the food units having an annual turnover of INR 12 Lakhs to INR 20 Lakhs that trades within India. This license is valid for five years tenure with a minimum validity of 1 year.

Food Operators under FSSAI License

FSSAI is an acronym for Food Safety, and Standard Authority of India, it is a supreme body authorized and responsible for regulating and supervising food safety and food hygiene. This authority issues the FSSAI license to all the food operators doing business in India.

FSSAI has issued the standards that have to be met by food operators along with the regulation of manufacturing, storage, sale, import, and distribution process to ensure the food consumed by millions of populations is safe, hygienic, and wholesome in quality.

The authority has also created the chain of an information network for the awareness of the general public and consumers to get accurate and reliable information relating to food safety, hygiene, and related concerns. Different types of FSSAI license issued are:-

  • Central License
  • Basic Registration

A different license is issued based on the scale of operation on which they operate. We will discuss in detail the state license in hereafter.

Why FSSAI State License is Required?

Before starting the food business, a person needs to ensure that the products used in the food business are not harmful in any manner. We all know food is a very sensitive subject as it directly affects health. All you need to check is whether you are eligible for a Basic license, State License, or Central license. Subject to eligibility, the Food Business operators may fall under the State license.State FSSAI License is needed in the following situations-

  • State license has to be obtained by every individual who is involved in food operations activities like manufacturing, retailing, transportation, or in any way dealing with food products.
  • To safeguard and upgrade the quality and hygiene of food, massive changes have been brought by the Food Safety & Standards Act, 2006. As per the act, a person must get an FSSAI Registration and license to start a food business.
  • Whether it is a Basic, State, or a Central, for every Food Business Operators must fulfill all the criteria and the responsibilities mentioned under the Act.
  • Issue of license or registration certificate is governed and regulated by the provisions of Food Safety and Standards Regulations 2011.
  • FSSAI license or registration requirement varies as per the type and nature of the food business.
  • If the operations of the Food business operators, expand to more than one state, a Central FSSAI license has to be acquired for the main Branch/Head Office. Also, a State License or Basic Registration for each branch, as per their eligibility.
  • FSSAI license is a one-time expense valid for one to five years depending upon the requirement of the business.

Note-In case the food operator fails to obtain an FSSAI license falls under the proceedings of legal offense and shall be penalized for his ignorance.

Eligibility for FSSAI State License

The requisite criteria for applying for a State Food License is that the annual turnover of the business shall fall between Rs. 12 lakhs up to a maximum of Rs. 20 crores. The food business operator shall apply for FSSAI State License to the state government where your business is based in. Following are the eligible entities having above stated turnover for applying for state license:

  • Food business operators with an annual turnover of within Rs. 12 lakhs to up to Rs. 20 crores.
  • Proprietary foods
  • Production and processing units of vegetable oil by the process of solvent extraction and refineries including oil expeller unit. With an annual turnover within Rs. 12 lacs to Rs. 20 crores.
  • Hotels of 4-star ratings or less
  • Dairy Units including milk chilling units, with a daily limit to handle or process, among 500 to 50000 lit
  • Storages having a capacity of less than 50,000 metric tons yearly.
  • A daily slaughtering capacity of more than 2 and up to 50 large animals. Or the capacity of handling more than 10 and up to 150 small animals. Or daily capacity of more than 50 to up to 1000 poultry birds.
  • All food processing units including re-packers, with a daily capacity of not less than 100 kg/liters to up to 2 metric tons.

Documents Required for FSSAI State License

Following documents are required for applying for State Registration-

  • Particulars of Partners, directors, proprietors, and Executive Members of Society with full address and contact details.
  • Passport-sized photograph of the applicant
  • Identification proof and Proof of address of the Applicant.
  • PAN Card of the applicant.
  • A copy of property papers (If the place of business is owned by the applicant).
  • A copy of the rented agreement and landlord’s No Objection Certificate(If the property is rented).
  • Particulars on Source of Raw material.
  • Form duly completed and signed.
  • List of all the equipment & machinery installed and operating in the unit.
  • No Objection certificate from the Municipality.
  • Particulars of food category and complete details of the product to be manufactured.
  • E-code document issued by Directorate General of Foreign Trade.
  • Form IX Nomination of persons by a company.
  • Letter of authorization including the name & address of the responsible person.
  • Certificate of the plan relating to the food safety management system.

Government Fee for FSSAI State License

The requisite fees shall be paid by the Food business Operator through-

  • Demand Draft,
  • Treasury Challan, or
  • Cash

Government fee varies as per the production capacity of the manufacturer:

Ø 10001 to 50,000 Liter per day of milk or 501 to 2500 Million tons of milk solids per annum.

What is the Process to Obtain the FSSAI State License?

The FSSAI License depends on the volume of business and premises. Before starting the food business, the food business operator may go by the-

  • Eligibility criteria,
  • Fees structure,
  • Documentation required, etc.

The Below-mentioned steps are required to obtain the State FSSAI License-


It is initiated by the submission of Form B. The form must have been filed when the food unit’s turnover is under 20 crores and whose zone of activity is limited to the state.


The application filed may be approved or rejected by the department within 7 days from the application date.


If the application is approved by the department, a registration certificate will be granted along with the 14-digit registration number (Contain a state code and Registration) and the photo of applicant.


After getting the Certificate, the Food business operator should display the certificate of the registration at the place of business during business hours.

Penalty for Non-Compliance

Non-compliances in the food business can prove to be costly. Running the food business without an FSSAI license will incur a harsh penalty and may also harm the brand image. Inspections will be conducted by the Safety officers and the levels of compliances are granted by the officers for the food business.
