The Legal Aspect of Legal Metrology

Legal Metrology refers to the legal protection provided to the study of Measurement. It alludes to the units and techniques for Weighment and Measurement, in accordance with the Laws and Regulations. To provide a uniformity norm of Weights and Measures, there was the enactment of the Standards of Weight and Measurement Act, 1976 and the Standards of Weights and Measures (Enforcement) Act, 1985.

To normalise weights and measures for commercial purposes and for trading business and stay aware of the advances in science and innovation, there was the enactment of the Legal Metrology Act, 2009, which repealed the Standards of Weight and Measurement Act, 1976 and the Standards of Weights and Measures (Enforcement) Act, 1985.

Similarly, Legal Metrology (Packaged Commodities) Rules, 2011 was enacted, which stated the fundamentals and mandated standards required on packaged goods, registrations of producers, traders, and packaging of goods, provisions for the wholesale and retail businesses, Power of Government to investigate the premises, punishments, etc.

As per the Constitution of India, Entry 33A of the Concurrent List states the measures for enforcement of Legal Metrology in India. Entry 50 of the Union List states the framing of Acts, Rules, and Standards in accordance with the maintenance of International Relations and Standards of Legal Metrology.

The Indian Institute of Legal Metrology

Under Section 21, for Knowledge related to Legal Metrology Laws or any similar field. The Indian Institute of Legal Metrology , also known as IILM, has been established. This Institute is established by the Government of India in accordance with the Standards of Weights and Measures Act, 1976. This institute is dedicated towards training for jobs in the field of Legal Metrology, which also imparts towards foreign officials of around 32 various countries.

Objective of the Legal Metrology Act

The Objective of The Legal Metrology Act, 2009

 

  • Maintenance of regulation over trade and of commerce of weights and measures.
  • Establishment and enforcement of standards set for weights and measures.
  • Regulation over manufacturing, selling and utilisation of goods measured by weights, measures and numbers.
  • Rationalisation of the specific Metric System to be utilised in India, i.e., meter, kilogram, etc.

 

Salient Features of Legal Metrology Act, 2009

  • Section 22 of the Act, which states the approval required to be obtained from competent authority in regard to the model of weights and measures prior to manufacturing or importing.
  • Section 23 of the Act, which states the provisions in regard to Licensing under Legal Metrology applicable for every manufacturer, repairer and seller.
  • Section 20 of the Act, which states the Standards in regard to Weights, Measures and Numbers to conform to the standards, and the importer is registered under the Director as per the prescribed manner.
  • Section 4 of the Act, which states that the weights and measures are to be in accordance with the standards Metric System, which is based on the International System of Units.
  • Section 5 of the Act, which states the base unit for weights and measures.
  • Section 7 (1) of the Act, which states the standard units for weights and measures.
  • Section 6 of the Act, which states the base units of numeration to be units as per the international form of Indian numerals.
  • Section 7 (2) which states the standard units of numerations where every numeration is to be in accordance with the decimal system, and the decimal multiples and sub-multiples of numerals are to be denominations written as per the prescribed.
  • Section 18 of the Act, which states the mandates for pre-packaged commodities along with bearing declaration and particulars of standard quantities or numbers as per the prescribed manner.
