Overview of Legal Metrology License Renewal

The Legal Metrology Act was enacted in 2009 to give standardised weights and measurement methods and values in trade and commercial use. It gave uniformity to the world dealing with weights and measurements. Under the Legal Metrology Act, any manufacturer or importer dealings in goods and services that are bought or sold by number, weight or measures need prior approval or a license to certify the type of weight and measurement used from the concerned authorities. 

The legal Metrology Department has defined a particular license for weights and measures. The application for such a license is made by the manufacturer, dealer, or repairer of weights and measures along with other related instruments. The license is not required by the one who uses the weight and measures or any related instrument. 

The applicant must disclose the relevant facts while applying for renewal of a license under Legal Metrology. He must fill out the application form for renewal with all the required details. The application for renewal can be filed by the manufacturer or importer who deals in the weight and measures under the Legal Metrology Act. 

Details to be filed in renewal application

The details which the applicant files in the application form of Legal Metrology License Renewal:

  • Full name of the applicant
  • Complete the address of the applicant
  • Contact details, including the email address of the applicant
  • License number
  • Complete address of manufacturer/repairer/dealer, for which renewal application is made
  • Name of father or husband of the proprietor(s)
  • Name of partner(s) with the name of managing director or directors, in case of a limited company
  • Type of weight and measures 
  • Information of Trademark or monogram that is used on weight and measure, in case of manufacturer license
  • Details of workshop facilities
  • Registration number of Sales Tax, VAT, CST, Professional tax and Income tax

  • An assistant controller is the designated officer
  • A controller is an appellate authority where a person can appeal against the order of the Assistant Controller. 

Types of Legal Metrology License Renewal

The followings are different types of Legal Metrology Licenses that the applicant renews:

  • License to Manufacturer

The manufacturer of weights and measures instruments or any related instruments shall obtain a license for manufacture according to the rules and regulations set by the Legal Metrology laws. 

  • License to a Dealer

A dealer license is granted to a person who trades and markets the weights and measures. If any importer wants to act as a dealer of weights and measures, he needs to obtain the dealer license and the manufacturer or importer license.

  • License to Repairer

A person who cleans, lubricates, adjusts or paints any weight and measures is known as a repairer. The repairer also needs to obtain a license under the Legal Metrology Act. 

Documents required for Legal Metrology License Renewal

The list of documents, along with the original license, submitted by the applicant with the application for Legal Metrology License Renewal, is as follows:

  1. Existing valid license documents
  2. Proof of premises such as sale deed or allotment letter, property tax receipt
  3. Rent receipt or NOC from the owner
  4. List of tools and equipment
  5. List of testing equipment
  6. Copy of document related to the constitution of the firm
  7. Proof of financial status 
  8. A detailed list of workers
  9. Proof of continued legal Possession 
  10. Change is the constitution of the firm 
  11. Statement of stock and sales

This list of documents may vary in different states as each State's Legal Metrology Department has its own rules and regulations for granting and renewing such Legal Metrology Licenses. 

Procedure for Legal Metrology License Renewal 

According to the Rule 11 of the Legal Metrology (Enforcement) Rules 2011, the renewal application must be made at least 30 days before the date of expiry of the original license. The following are the steps for obtaining renewal of a Legal Metrology License:

  • The applicant files an application for renewal to the appropriate Legal Metrology Department. 
  • The application is filed and submitted with all the required details and the requisite fee.
  • The Assistant Controller of Legal Metrology receives the application. 
  • The Assistant Controller scrutinises the renewal application, and then an inspector is appointed to inspect the applicant's premises. 
  • The inspector conducts inspection and makes reports and recommendations to the Department, which is sent to the Assistant Controller. 
  • The Assistant Controller reviews such recommendations and the application for renewal. 
  • The Assistant Controller then sends their recommendation to the Deputy Controller/Controller of the Legal Metrology Department for approval or rejection of the applicant's renewal application.
  • Deputy Controller/Controller reviews the recommendation and, if satisfied, then issues a signed renewed certificate/license for the applicant. 

If the applicant fails to make an application for renewal within the prescribed time, then a late fee of 100% is in excess of the fee ordinarily payable for getting approval from the Controller.

Yes, as per Section 23 of the Legal Metrology Act, 2009, no person should make, manufacture, sell or repair any weight and measure without any valid license.

The Controller of the Legal Metrology Department is the competent authority to grant the license.

No, a license granted/renewed under the legal metrology law is not transferable.

Initially, for one calendar year, such a license may be renewed for one to five calendar years.
