An IPLC License Holder:

• Can vend bandwidth to telecom service providers other than other IPLC license holders.
• The location of the cable landing station should be according to the terms of International Long-Distance Operators (ILDO) rules.
• Can create its own infrastructure for multiplexing, de-multiplexing, and billing

Scope of IPLC License

The scope of the IPLC License is to enable the holder to intercept, capture, and monitor the information carried on the International Private Leased Circuits (IPLC), which could be either voice or data traffic. The IPLC license holder is able to provide these end-to-end IPLC Services by procuring the international bandwidth from ILDOs. The IPLC license holder enters into an arrangement with the access providers, or NLD (National Long Distance) Service Providers, or the ILD (International Long Distance) Service Providers.

Additionally, the IPLC can also be used for ISP Gateways.

Guidelines For License of Resale of IPLC Service

The Department of Telecommunications (DoT) has issued guidelines for issue of License for the Resale of IPLC Services, some of which are:

• The applicant company can apply for only one License for the Resale of IPLC service.
• The IPLC License holder must not access the subscribers for any other purpose except for IPLC.
• The IPLC License holder must sell bandwidth on a retail basis.
• The IPLC License holder cannot sell the bandwidth to another license holder for the resale of the IPLC License
• An IPLC license holder cannot engage with Internet Telephony Network, PSTN, or GMPCS.
• The officials of the company engaged in the Resale of IPLC Service, who deal with the lawful interception of messages, must be resident Indian citizens.
• The Chief Officer in charge of the technical operations, the Chief Security Officer and the major directors on the board of the company engaged in the resale of IPLC service must also be a resident Indian citizen.
• The applicant company involved in the resale of IPLC Service shall further be required to pay a one-time non­refundable Entry Fee of INR 1 crores before the signing of the License.
• In case the applicant does not adhere to the License conditions envisaged in the License, the License granted shall be deemed as cancelled, and the licensor shall have the right to encash the financial bank guarantee and will not be liable for loss of any kind.
• The Reseller must ensure the protection of the privacy of communication and that unauthorized interception of messages does not take place. In pursuance of the same, he must take adequate and timely measures to ensure that the information passed through IPLC is protected and secured.
• In addition to these, the resellers shall be required to provide a list of their customers to the authorized security agencies as well as to the ILD Operator from whom the IPLC has been taken and to the licensor. This information is required to be furnished at quarterly intervals. Fit here are any additions or removals of the customers from that list; it should be reported on a monthly basis.
• The Licensor also reserves the right to suspend the License at any time if, in the opinion of the Licensor, it is necessary or expedient to do so in the public interest or in the interest of the security of the State or for the proper conduct of service.

Therefore, the applicants must adhere to these guidelines and others, as specified from time to time, to avoid any rejection of the application or suspension of the License so granted. Process of Deciding Application for Resale of IPLC Service

The application for Resale of IPLC Service submitted is usually decided within 15 days of the submission as far as possible. The applicant company shall be informed accordingly. If the applicant company is found to be eligible for grant of IPLC license, the applicant will be expected to deposit the non¬refundable Entry Fee and submit Bank Guarantees, including a no dues certificate in respect of any outstanding amount against any license granted to the applicant. The applicant will also be required to sign the license agreement immediately within a period of 3 months from the date of issue of the letter, failing which it will be presumed that the applicant is no longer interested, and the application will stand rejected.

In case the applicant is found to be not eligible for the grant of License for Resale of IPLC service, the applicant will be informed accordingly, after which he can file a fresh application removing the deficiencies. License Fee of IPLC License

The entry license fee for an IPLC License is INR 1 Crores, and the annual fee shall be 6 per cent of the Adjusted Gross Revenue (AGR) or INR 5 Lakhs, whichever is higher. Every IPLC must also submit an FBG, i.e., a Financial Bank Guarantee of INR 1 crore, and this must be submitted within 1 year from the following date, whichever is earlier:

• Date of the Licensing Agreement
• Date of commencement of IPLC Service

Resale of IPLC Service

The resale of IPLC Services had been permitted by the government of India in 2008 with the objective of promoting competition and affordability in International Private Leased Circuits (IPLC). This enabled the Reseller to provide end-to-end IPLC between India and the country of destination for any capacity denomination.

In order to provide the IPLC service, the Reseller has been mandated to take the IPLC from International Long Distance (ILD) Service Providers who are licensed under Section 4 of the India Telegraph Act, 1885. Resellers are permitted to enter into an arrangement for leased lines with Access Providers, National Long Distance (NLD) Service Providers and International Long Distance (ILD) Service Providers for the provision of IPLC to end customers.

Eligibility Criteria for Resale of IPLC Services in India

The eligibility criteria for resale of IPLC Service in India is:

• The IPLC applicant must be an Indian company incorporated as per the Companies Act 2013.
• The IPLC applicant must be able to dispense the duties required by a licensee.
• The IPLC applicant company should have a net worth as well as a paid-up capital of INR 2.5 Crores.
• Furthermore, the total foreign equity in the paid-up capital of the applicant company must not exceed 74 per cent of the total equity subject to FDI norms. Foreign Investment will include investment by FIIs, NRIs, FCCBs, ADRs, GDRs, etc.
• In the case of FDI in the IPLC applicant company, the applicant must provide all details pertaining to the investment.
• The IPLC applicant company is also required to provide a declaration that it will unconditionally abide by the compliance requirements prescribed by the FDI rules.
• The Lawful Interception and Monitoring of the Reseller's Circuits shall take place at the Gateway Monitoring system of the ILD operator from whom the IPLC has been taken by the Reseller.
