How to Renew Food License Online in India?

It is mandatory for every Food Business Operator (FBO) in India to obtain the FSSAI license. Every FBO is required to hold a valid food license to ensure that every consumer gets products that are safe for consumption, and it conforms to the standards laid down by the FSSAI Act.

It is required to be obtained by all manufacturers, storage units, transporters, distributors, retailers, petty hawkers, etc. eligible as per the FSS Act, 2006. These FBOs are required to obtain the FSSAI license from the Food Safety and Standards Authority of India {FSSAI} before commencing their food business. However, the food license has validity for a maximum of five years. After that, there is a need to renew the license within the specified time to be able to continue operating legally and is in accordance with the FSSAI regulations.

Initially, the validity of the food license is chosen by the food business operators (FBO), which can be from 1 year and up to 5 years. The fees to be paid by the applicant depending on the number of years selected. As per FSSAI, every food business operator has to apply for renewal of the license 30 days before the expiration of the current food license.

What is The Consequence if The FSSAI License is Not Renewed With in The Stipulated Time?

If the request for FSSAI license renewal is not made within the stipulated time, then a penalty of Rs. One hundred for per day of delay will be charged on such defaulting person/ entity. If the application for the renewal of a license has not been applied within the given time, then it is considered as expired, and a new license would have to be applied, in case the business owner wants to continue operations. Hence to avoid the punishment, it is advisable to renew the license in time.

The Registration/ License will continue to be valid until if the license is renewed within 30 days from the time of expiry of registration or license.

Procedure For FSSAI License Renewal

You are required to follow the steps mentioned below to renew your Food License;

  • First, you need to file your application in Form A(for renewal of basic registration) or Form B (for the renewal of state or central license) along with the signatures of the authorized signatory. Also, you need to attach a government-issued photo identity proof along with the Form.
  • Furthermore, the application for FSSAI license renewal must contain by an audit report, FSMS plan, Certificate or Self-declaration regarding Food Safety Management System has to be filed together. Such a declaration should be given on the letterhead of the FBO/ firm/ company as per the prescribed format.
  • Moreover, another requirement of the FSSAI license renewal is filing up of Form no. IX - Form for Nomination of Personsby a Company has to be filed in the prescribed format.
  • Also, a declaration signed by the Authorized signatory stating that the food business conducted conforms to the Food Safety and Standards Act, Hygiene and Sanitary Practices. Additionally, all FBOs need to comply with the Guidelines provided under Schedule 4 of the Registration and Licensing Regulation issued by the Food Safety and Standards Authority of India and to all subsequent rules issued by an authorized person/ authority from time to time. It must be attached with the application for FSSAI license renewal. 
  • After receiving the application for FSSAI license renewal, the authorities would then examine it and if required, arrange an inspection at the business premises to make sure that the details related to the food business furnished are true
  • The complete procedure of FSSAI registration or license renewal takes almost 60 days. In case it takes more than 60 days, and in case you have not got any notice from the concerning authority, then you can continue the business without waiting for any further communication

What are The Required Documents For Food License Renewal?

You are required to submit certain documents to apply for the FSSAI License renewal;

For Basic Registration

  • Form A is expected to be submitted and signed by FBOs along-with supporting documents;
  • Identity proof such as a Pan Card, Driving license, Voter id card, Passport, Aadhaar card, senior citizen card;
  • Two passport size photos of the applicant
  • NOC’s by Municipality or Panchayat, Health Department etc. if any;
  • Rent Agreement if any.

For State or Central License

  • Duly completed and signed Form B
  • Photo proof and address proof of Proprietor/ Partner/ Director(s)/ Authorized Signatory.
  • Layout plan of the food processing plant;
  • List of Directors with their full address and contact details
  • ID and address proof for the above persons
  • List of food category (for manufacturers);
  • Authority letter nominated by the manufacturer to act on behalf of him;
  • NOC from the municipality or any other local body
  • name and number of equipment’s as per installed capacity and horsepower for manufacturing and processing unit
  • Partnership deed/ or affidavit of proprietorship and in case of a company a copy of MOA and AOA as well is required
  • Specify the source of the raw material of meat and meat processing unit and source of milk and milk-related products and milk collection centre where it is applicable;
  • For hotel industry certificate provided by the Ministry of Tourism;
  • Pesticide residue report of water for the packaging of products like Mineral, carbonated beverages etc.
  • Certificate from the Ministry of Commerce for 100 % EOU (in the case of central license)
  • IEC documents issued by DGFT (in the case of Central License)
  • Supporting documents as a proof of turnover (in the case of Central License)
  • The analysis report of water to be used in the food. (in the case of Central License)
  • Possession proof is necessary (Electricity bill, sales deed etc.) (in case of Central License)
  • A cancelled cheque

You may apply for a new FSSAI License through the FSSAI online portal. Additionally, FSSAI License renewal can also be done online by submitting the Form C. After filing of the online application, and you need to submit a physical copy of the application, which is duly signed along with an original copy of fees paid to the FSSAI. This rule is applicable in all states of India except Delhi and few other states
