E-filing of Copyright Registration

Under the Copyright Act, 1957, a copyright registration provides various rights and protections to the creator of the original work. Creators of dramatic, musical, literary and artistic works and cinematography can avail rights on their original creation by the virtue of copyright registration. What do you mean by Copyright?

Copyright is fundamentally a creator’s right to protect his original work from being copied or stolen. In order to avail this right, a creator has to obtain copyright registration for his work. If a work is protected under the Copyright Act, then no other person can copy, imitate, or reproduce that work.

Process for E-filing of Copyright Registration

The steps required to be followed for E-Filing of Copyright Registration are as follows-

  • Enter your valid login credentials; if you have not registered yet then click onto New User Registration. Keep your Login credentials for future use.
  • After Log in, click onto the link for “Click for Copyright Registration”.
  • The e-filing of Copyright Registration can be done in four steps by filing “Copyright Registration Form”-
  1. The first step is to fill Form XIV and save the entered details. Press Step-2 to move to the next step;
  2. The second step is to fill the Statement of Particulars and save the entered details. Press Step-3 to move for the further process;
  3. The third step is to fill the Statement of Further Particulars. This form is available for Literary, Dramatic, Musical, & Artistic works, save the entered details. Press Step-4 to move to the next step;
  4. Make the relevant payment through Internet Payment Gateway.
  • After successful completion of ‘Copyright Registration Form’, a Diary Number will be generated. Keep this number for future reference.
  • Artistic works are required to be uploaded in JPG, PNG or PDF format whereas literary works are to be uploaded in PDF format, less than 5 MB.
  • Take a print out of “Acknowledgement Slip” and “Copyright Registration Form”, and send it through post to the following address-

Documents required for Artistic Work

  • No objection certificate from the author if applicant is different from author;
  • No objection certificate from the publisher if contender is different from the publisher;
  • No objection certificate from the person whose photograph appear on the work;
  • If the application is being filed by any attorney, an original duly signed specific Power of Attorney by the applicant and accepted by the attorney;
  • Demand Draft (DD) in favor of ‘Registrar of Copyrights’;
  • 2 Copies of Work.

Documents required for Cinematograph Films

  • 2 Copies of work;
  • Demand Draft (DD) in favor of ‘Registrar of Copyrights’;
  • No objection certificate from various copyright holders or copy of agreement;
  • No objection certificate from the publisher if contender is different from the publisher;
  • If the application is being filed by any attorney, an original duly signed specific Power of Attorney by the applicant and accepted by the attorney.

Documents required for Musical Work

  • 2 Copies of Graphical Notes;
  • Demand Draft (DD) in favor of ‘Registrar of Copyrights’;
  • No objection certificate from the publisher if contender is different from the publisher;
  • If the application is being filed by any attorney, an original duly signed specific Power of Attorney by the applicant and accepted by the attorney.

Documents required for Literary or Dramatic works

  • 2 Copies of Work.
  • Demand Draft (DD) in favor of ‘Registrar of Copyrights’;
  • If the application is being filed by any attorney, an original duly signed specific Power of Attorney by the applicant and accepted by the attorney;
  • No objection certificate from person whose photograph appears on the work;
  • No objection certificate from the publisher if contender is different from the publisher;
  • No objection certificate from the author if applicant is different from author;

Documents required for Sound Recording 

  • 2 Copies of work;
  • Demand Draft (DD) in favor of ‘Registrar of Copyrights’;
  • No objection certificate from various copyright holders or copy of agreement;
  • No objection certificate from the publisher if contender is different from the publisher;
  • If the application is being filed by any attorney, an original duly signed specific Power of Attorney by the applicant and accepted by the attorney.

Documents required for Software

  • 2 Copies of work;
  • Demand Draft (DD)  in favor of ‘Registrar of Copyrights’;
  • Object code and Source code of work for verification;
  • No objection certificate from various copyright holders or copy of agreement;
  • No objection certificate from the publisher if contender is different from the publisher;
  • If the application is being filed by any attorney, an original duly signed specific Power of Attorney by the applicant and accepted by the attorney.

Checklist for Applicant to Follow

  • Make sure that application is enclosed with prescribed fee by postal order or Demand Draft only in favor of ‘Registrar of Copyrights’ payable at New Delhi.
  • The Application Form XIV including the Statement of Particulars and the Statement of Further Particulars should be signed by the applicant only.
  • No objection certificate from legal heir if author is deceased.
