An Overview of PSARA License in Sikkim

The Private Security Agencies Regulation Act (PSARA), 2005 regulates all aspects of the operations, such as conditions for obtaining new and renewal of licenses, training certificates, and physical standards related to the private security agency business in India. Under the PSARA Act, a person who wishes to start a security agency business must get a PSARA license in India. If an agency doesn't possess a valid license, it shall suffer consequences like fines or imprisonment. Private security agencies provide armed and unarmed security guards like patrol services, bodyguards, and security services in IT sectors, malls and other commercial establishments. These security services not only provide protection services, but they also give training to the security services.

Eligibility Criteria under PSARA in Sikkim

Eligibility criteria for business entity / Directors / Security officer or guard

  • The private security agency can be started by any individual entity/ various associates/ NGO/ LLP / Sole proprietor/ Limited liability partnership firms.
  • The applicant should be of Indian origin. Also, if the business entity is a partnership firm or association of persons, those persons should be of Indian origin.
  • The organisation or security guard must have a crime-free track record.
  • The applicant should not have crossed 65 years and should undergo adequate training.
  • The applicant should not be disqualified from any government services.
  • The individual should not have a connection with the organisation barred by the government.
  • The candidate must have desired physical strength as per the PSARA Act.

Process involved obtaining a PSARA license in Sikkim

  • The applicant shall submit a signed affidavit regarding the details provided under Section 6 of the PSARA, 2005.
  • The requirements of section 9(2) should be ensured regarding the training of the security guards and supervisors.
  • The applicant should fulfil all the conditions of Section 11 regarding the pending cases of the applicant, either before the police or a Court of Law.
  • Upon receipt of the application, the controlling authority will inquire. For this inquiry, the NOC from the police is also required in written form.
  • After processing the application, the controlling authority either grant the license or refuses to grant the license.
  • This license assessment process should be completed within 60 days of receiving the application.
  • If the controlling authority refuses the application, then a reasonable opportunity of being heard will be given to the applicant.
  • After all the Perusal, the license is granted, and then it will be valid for 5 years under Section 13(1).

Validity and renewal of PSARA license in Sikkim

Once the organisation gets the license, it is valid for a time limit of 5 years. Application for the PSARA license renewal shall be made to the controlling authority. It must be made prior to 45 days of the expiry of the validity period. The controlling authority has to pass an order regarding the PSARA License renewal within 30 days of receiving the Renewal application.

Conditions for renewal of PSARA license in Sikkim

There are certain conditions that an applicant should fulfil for the renewal of a license.

  • The applicant should maintain the same jurisdiction as the controlling authority and continue their business in their principal place.
  • To get the renewal of the license, the applicant should continue their training for their supervisors and their employees.
  • The applicant should follow the rules, regulations, and conditions under PSAR Act.
  • The applicant should not hold any criminal record.
