The PSARA, 2005 regulates all the activities of an organisation that provides security guard service on a time-to-time basis. As per the Act, any security agency that carries out these businesses without obtaining the PSARA license would not be allowed to operate in India as per the Act. Therefore, it is essential for the private security agency must obtain the PSARA license before starting its operations in India.

Eligibility Criteria under PSARA in Kerala

Eligibility criteria for organisations / Principal Officers / Security guards

  • Sole proprietorship / Partnership firms/associations of persons can get the PSARA license.
  • The person applying for a PSARA license must be an Indian Citizen and attain a major.
  • The person applying for a license should not be convicted of any offence and doesn’t hold any criminal record.
  • The person applying for a license should not be bankrupt and should be a financially stable person to meet the business needs.
  • The security officer applying for a license should be 18 to 65 years old.
  • The security officer must provide a certificate of his character.
  • The applicant should not be dismissed from any government service.

Documents that are necessary to obtain a PSARA license in Kerala

The Documents required for getting a Kerala license are per the state guidelines.

  • PAN card or any address proof of the applicant
  • Shop and establishment Act registration letter
  • Contractual labour Act registration letter
  • Address proof of the registered office
  • ESI certificate
  • Certificate of Incorporation (details about the board of directors)
  • Signed memorandum of understanding
  • Uniform code details of the security agency
  • An affidavit obtained as per the PSAR Act

Process involved in obtaining a PSARA license in Kerala

Qualifying Documents

MOU with a training institute

The organisation or establishment must have undergone a Memorandum of Understanding (MOU) with an institute that provides training and other services to the private security agency.

Police verification

All the details and activities of the security agency should be filed before the respective police authority for verification. The police officer checks all the necessary criteria and reports to the PSAR officer.

Application Submission

The PSARA application will be effected only after receiving the NOC from the respective police authority. The PSA controlling authority, based on the police report, may either approve or denies the license.

Validity of PSARA license in Kerala

Once the application is accepted, the license is provided and valid for five years. It is not permanent. It can be subject to renewal based on the requirement of the security agency before the expiry of the license.

Suspension and cancellation of PSARA license in Kerala

The Private Security Agency Regulating Act's controlling authority can suspend and cancel the PSARA licenses based on the following conditions.

  • If the person or organisation forged all the details to get the license
  • If an agency got the license using the shell company name.
  • If any agency acts against the regulations of the PSAR Act and also against the interest of the public.
  • A person or business entity that obtained a license is proved insolvent.
