How to Obtain BIS Certification in India?

Every product requires an authenticity mark to legitimize its purity. You must have seen in advertisements that the products proudly proclaim their ISI Mark. ISI is the acronym of the Indian Standards Institute which came into being on the 6 January 1947. It is a body which was set up during the Independence period to provide advantages of standardization to everyday consumers like us. However, by the mid-80s, certain circumstances change and triggered the need for a stronger organization. The ISI was not responsible for the formulation of standards and other related work apart from the product certification. To broaden the scope and give more powers to the staff, assets and liabilities and function of ISI, the Indian Government bring BIS (Bureau of Indian Standards) into the picture on 20 November 1986. This blog will lead you through the entire procedure required for obtaining the BIS certification.

What is BIS and why do we require BIS Certificate?

BIS is a government organization which looks over the quality, safety and reliability of products in India. It is a Corporate body which consists of 25 members representing both Central and State governments, Members of Parliament, industry, scientific and research institutions, consumer organizations and professional organizations; with Union Minister of Consumer Affairs, Food and Public Distribution[1] as its President and with Minister of State for Consumer Affairs, Food and Public Distribution as its Vice-President.

The purpose of Obtaining the BIS Certificate is as follow:

  • It safeguards public health and provides quality assurance.
  • It promotes consumer confidence and protects the consumer from the hazardous product.

What are the products which fall under the category of BIS Certification in India?

Products under Compulsory Registration –

The list of products which fall under Scheme 1 (Mark Scheme) are as follow:

  • Cement
  • Household electrical goods
  • Batteries
  • Food and related products
  • Oil pressure stoves
  • Automobile accessories
  • Cylinders, Valves, and Regulators
  • Medical Equipment
  • Steel and Stainless Steel Products
  • Electrical Motors
  • Electrical Transformers
  • Capacitors
  • Chemicals and Fertilizers

The list of products which fall under Scheme 2 (Registration Scheme) are as follow:

It mainly consists with the list of Electronics and IT goods:

  • Electronic games like video games
  • Laptop/Notebooks/tablets
  • Plasma/LCD/LED Televisions of screen size 32 and above.
  • Optical Disc Players with built-in amplifiers of input power 200W and above.
  • Microwave Ovens
  • Visual Display Units, Video Monitors of screen size 32″ & above
  • Printers, Plotters
  • Scanners
  • Wireless Keyboards
  • Telephone Answering Machines
  • Amplifiers with input power 2000W and above

What are the kinds of BIS Certification Scheme?

There are two kinds of procedure, namely Normal and Simplified procedure:

  • Normal Procedure: Under the Normal Procedure, the applicant applies to the BIS Officer in the BIS certificate application along with certain documents and the prescribed fee. After the submission of the application form, the concerned BIS officer will evaluate the samples and will come up with a testing report. If no discrepancy is found, then a BIS registration is granted within four months from the submission of the application form.
  • Simplified Procedure: Under the Simplified Procedure for Domestic manufacturers, the applicant sent the test report of the sample from the government-approved labs to the BIS officer. If the BIS officer finds the test report ok then the officer will grant the BIS Registration Certificate within 30 days of the submission of the application.
  • Eco Mark Scheme: Under the Eco mark scheme, the BIS provide a license to the environment-friendly products.
  • FMCS (Foreign Manufacturers Certification Scheme): This scheme was mainly introduced by the BIS for the overseas applicants and foreign manufacturers. Under this scheme, the manufacturers can use the standard mark on their products. After the successful verification by the BIS officer, the BIS Registration Certificate is issued within six months.

BIS Certification Process under various Schemes:

Normal Procedure for the Domestic Manufacturers:

  • The candidate has to fill the prescribed application Form-1 along with the application fee of INR 1000 and submit it to the branch office of the jurisdiction in which the manufacturing unit is located.

Checklist of Documents that are required to submit along with the application form:

  • Documents like Registration Certificate, MOA etc. which will authenticate the address and purpose of the establishment of the manufacturing unit.
  • If the applicant applies as SSI (Small Scale Industries) unit, a copy of a valid registration certificate from the Local/State authority from a CA (Chartered Accountant).
  • A process-flow chart indication all the process like:
  • Processing from raw material to finished product
  • In-process controls at each stage and all those stages which have been outsourced.
  • Details (capacity and quantity) of all the manufacturing machinery used along with the name of machinery and its process.
  • Name of the equipment, its range, least count, the accuracy of the test equipment, its calibration status and quantity as per the information provided in Annex A-2.
  • If any manufacturing processes are outsourced, then provide the details of the processes and the controls exercised along with the receipt of such materials and components etc.
  • Details of the testing facilities indicating the name of equipment, range, least count, the accuracy of the test equipment, calibration status and quantity as per the information provided in Annex A-2.
  • A copy of the Calibration Certificate of testing equipment which will be valid for a minimum of three months.
  • A consent letter from the BIS recognized laboratory.
  • A plant layout is mentioning the location of manufacturing machinery, office, storage area etc. available on the factory premises.
  • Appointment letter of the QC (Quality Control) personnel mentioning the names, qualifications, experience and date of appointment.
  • A copy of each test report for each of the raw materials and components.
  • An In-house copy or independent test report of the products which should cover all the requirements as per the relevant Indian Standard.
  • An authorization letter from CEO in case the application is signed by the authorized signatory of the applicant.

Simplified Procedure for the Domestic Manufacturers:

The steps of Simplified Procedure for Domestic Manufacturers are listed below:

Submit an application form

In the first step, the applicant needs to submit an application form with the prescribed documents and an application fee of INR 1000 and special inspection charge.

You need to submit only one application for one product and one manufacturing location. The BIS will test the products as per the requirements of the Indian Standards and will grant the license.

The checklist of documents required is given below:

  • Application form according to the format provided in Annex 1.
  • A report of the self-evaluation as per the format provided in Annex II.
  • Undertaking a Simplified Procedure (Annexure-III).
  • An Original test report from the government-specified laboratory (not older than one month).

Verification

Within 15 days of submission of application, a verification visit by the concerned BO will be done who will verify the capabilities of the organization. During the verification, a product sample will be tested in an independent laboratory.

Granting of license

The competent authority will issue the license after the verification of the required documents. The validity of the license is one year and can be renewed for two years as per the RBI guidelines.

What is the procedure required under the Eco Mark Scheme?

  • Submit the application along with the following documents:
  • A certificate of Environmental clearance from the concerned state pollution control board.
  • For the small scale sector, a small scale industries certificate issued either by the office of the development commissioner, small scale industries or industries department of the concerned state government.
  • If the applicant unit holds a valid BIS certification mark license, then that applicant has to request the Bureau to take proper steps.
  • Under the Eco mark Scheme, a single mark will be the combination of the ISI mark[2] and the Eco-logo.

Powers and Functions of The Bureau

The Bureau can execute such duties and implement such powers as assigned to it under this Act and they are as given below

  • Establish, circulate and endorse in a manner as prescribed by the Indian Standard, in reference with any process or article;
  • Identify any standard as established by any Institution in India or somewhere else as an Indian Standard in a manner as prescribed in relation to any process or article;
  • Particularly identify a Standard Mark to be called the Bureau of Indian Standards Certification Mark which will be of such design and have particulars as prescribed to signify a particular Indian Standard;
  • Grant, restore, suspend or terminate a licence for the purpose of using the Standard Mark;
  • Charge fees for the renewal or grant of any licence;
  • Conduct an inspection and receive samples of material or substance as may be necessary to see whether any article or process in relation to which the Standard Mark has been used.
  • Conforms to the Indian Standard and check that the Standard Mark has been not improperly used in reference to any article or process
  • Seek acknowledgment of the Indian Standards and of the Bureau outside India on terms and conditions mutually agreed by the Bureau with any equivalent organization or institution in any country;
  • establish, maintain and identify labs for the purposes of standardization and check on quality control and other purposes as may be prescribed;
  • Carry out research for formulating Indian Standards in the manufacturer and consumers interests;
  • Identify institution in India or outside India engaged in the standardisation of any process and article or in the expansion and improvement of the quality of any  process or article;
  • Give services to consumers and manufacturers  of processes or the articles on terms and conditions as mutually agreed upon;
  • Appointment of agents inside India or outside India for the purpose of testing, doing inspection, and other purposes as prescribed;
  • Establish offices, branches or agencies in India or outside;
  • Inspect any article or process and verify that whether it is conforming to the Indian Standard as may be prescribed by this Act or under any other law.
  • Coordinate with the activities of any producer or association of manufacturers or the consumers who are involved in standardization and in improving the quality of any process or article or in the execution of any quality control actions;
  • Execute such other functions as prescribed.

What is the procedure required under the FMCS (Foreign Manufacturers Certification Scheme?

  • Submit the application form in the prescribed format along with the requisite fee and documents.
  • The foreign-based manufacturer needs to set up a branch office in India, and preliminary inspection will be carried out at the manufacturing and testing units of the applicant.
  • After the BIS is satisfied with all the requisite, the Bureau of Indian Standards will issue the BIS certificate, which will be valid for one year.
