Regulatory Body for Protection of IP Rights in India

In India, the protection of IP Rights is governed under the Office of the Controller General of Patents, Designs and Trade Marks, authorised by the Department for Promotion of Industry and Internal Trade, governed under the Ministry of Commerce and Industry, Government of India. The Office of the Controller General of Patents, Designs & Trade Marks (CGPDTM) is situated in Mumbai. The Controller General supervises the regulation of the protection of IP Rights under the Patents Act, 1970 (as amended), the Designs Act, 2000, the Trade Marks Act, 1999, the Geographical Indications of Goods (Registration and Protection) Act, 1999, the Copyright Act, 1957, the Protection of Plant Varieties and Farmers Rights Act, 2001, the Semiconductor Integrated Circuits Layout Design Act, 2000, and the Information Technology Act, 2000, along with rendering advice to the Government of matters subject to same.
