Guidelines for AIR
Every foreign manufacturer/applicant must have a branch office in India that, on their behalf, would perform all responsibilities and obligations related to the BIS Act of 1986 and the rules and regulations created for the purpose of registration. For the purpose of presenting their case and complying with the legislation and registration requirements, foreign manufacturers and companies must appoint an authorised representative in India.
The applicant should watch out for the following things when appointing the AIR:
- AIR nominated by the foreign manufacturer or applicant should be an Indian resident.
- AIR shall give his consent that he or she is responsible for compliance to the provisions of the BIS Act, Rules & Regulations, and terms & conditions given in BIS Licence, agreement, undertaking/other documents executed on behalf of the foreign manufacturer or applicant in connection with grant & operation of the licence.
- AIR can only represent one foreign manufacturer or applicant at one time.
- AIR(s) shall have zero conflict of interest in their role as Authorised Indian Representative with testing of a sample(s) in 3rd party laboratories.
- The minimum qualification for an Authorised Indian Representative is a bachelor’s degree & knowledge of the provisions of the BIS Act, 2016, as well as rules & regulations.
- The name of the AIR should appear in the licence documents.
