I – Stands for Registrar of Newspapers, commonly known as RNI, which came on 1st July 1956 on the recommendation of the first press commission. The Act contains the Function and Responsibilities of RNI, the office of the Registrar is performing statutory as well as non–statutory functions. In India, Press and Books Regulation Act – 1867[1] regulates the publication of newspapers and periodicals and books; under this Act, an office for Registrar of newspapers which is a statutory body created by amending the Press and Registration of Books (PRB) Act 1867. In this piece of writing, we have discussed the RNI revised Registration.

Statutory and Non–Statutory Functions of RNI

The following are the statutory and Non- Statutory function of RNI, which has been discussed below for a better understanding and knowledge.

Statutory Functions

  • Compilation and Maintenance of Register of Newspapers which contain particulars of all newspapers published.
  • They will also issue a Registration Certificate to the newspaper published under valid declaration.
  • The publisher will send an annual statement to the Registrar for Scrutiny and analysis under section 19-D of the Press and Regulation of Books which contacts Information on ownership and circulation etc.
  • The Registrar will inform the District Magistrates about the availability of titles.
  • The Registrar will look at whether the newspaper which is published is in accordance with the provisions of the Press and Registration of Books Act 1867 and rules.
  • Preparation and Submission to the government each year on or before 31st Dec, a report which contains all statistics and Information about the press in India.       

Non–Statutory Functions

  • Certifying and Assessing the essential needs and requirements of newspaper establishments to import printing and composing machinery and allied materials.
  • Forming guidelines and newsprint policy and issuance of Eligibility Certificate to the newspapers.

There are significant benefits associated with the RNI Registration, which are as follows: –

  • Proper Compliance:  Any registered entity or company in the business of a magazine, publication of a newspaper, etc., has to comply with the Press and Registration of Books Act and the rules made there.

  • Protection against 3rd Party Claim:  Apart from protection to the title and ownership, the register published would also enjoy protection against any false third-party claims. Any form of copyright issue is also protected under this form of registration.  

Recognition:  RNI Registration secures some form of recognition of the registered company or entity in the business of newspaper and publication in India.

Documents Required for RNI Revised Registration

The following are documents required for the RNI Revised Registration

  • New Declaration filed by the publisher/printer before the District Magistrate in (Form I).
  • Original Registration certificate issued by RNI.
  • An affidavit duly notarized in the case where the original certificate had been misplaced/lost along with IPO of Rs.5/-
  • A copy of the latest issue of the periodical/ newspaper
  • A written agreement between the keeper of printing press and publisher of newspaper and.
  • An authorization in writing from the owner(s) authorizing publisher/printer (by name) to make and subscribe declaration under provisions of PRB Act, 1867 (Required only in the case where the publisher/printer is not the owner thereof).

Process of RNI Revised Registration

The following is the step-by-step process for the RNI Revised Registration (Change in details of registered new paper and change in ownership).

The process of transfer/change in the ownership of a registered newspaper requires an affidavit for the transfer of ownership before the district magistrate to be executed; along with that, all other relevant documents are required to be submitted to the Registrar of Newspapers which are mentioned above in Documents Required for RNI Revised Registration     

Steps involved in getting a Duplicate RNI Revised Registration.

  • A notarized affidavit for loss of original certificate of registration.
  • An IPO of Rs.5/-
  • A copy of the authenticated declaration on the basis of which the newspaper/periodical got registered.
  • The penalty of 1000.00 per year against RNI, in the form of a demand draft in favour of DDO, against non Submission of annual statements is compulsory. (Submission of annual statements to RNI is mandatory under section 19D of PRB Act, 1867).
  • A copy of the latest issue.

Process for the New Registration of RNI

The following is a step-by-step process for the New Registration of RNI, which has been elaboratively discussed below.

STEP 1. Verification of the title:An application is needed to be produced for title conformation, containing:

  1. The newspaper name
  2. The owner name
  3. Periodicity
  4. The proposed area of the magazine.

STEP 2. Authenticated of Declaration

  • Once the title confirmation letter from RNI is acquired, it has to be presented to the authority concerned in addition to appropriately filled up declaration FORM – I for verification.
  • In case the publisher and publisher are different people, a different declaration from both publisher and printer is needed.    
  •  If the place of printing press and publication press are in different districts, then separate declarations are needed from both districts.
  • The publisher should file a declaration from the district of the place of publication, and the printer should file a declaration from the district of the printing press.

STEP 3. Submission of Documents for RNI Registration: Once the title verification letter from RNI website is issued, the same has to be presented to the forwarding authority concerned (DM/DC/SDM/DCP/JCP/CMM etc.) along with a properly Declaration (Form-I) for authentication and for other required documents.
