At the end of the 19th century, the first electronic musical system was created, introducing a new universe of sounds and compositions. Everyone has become a music fan due to the development of technology. We can find a favourite music playlist on every phone. Music listening has become a universal pastime. An instrument that generates sound with electronic circuitry is called an electronic musical system. Electronic musical instruments are now often used in a variety of musical genres. It promotes relaxation and is regarded as a form of medication for the mind and soul. The Bureau of Indian Standards determined on July 3rd that all models falling under the category of Electronic Musical Systems with Input Power 200W and above needed to register with BIS to be sold in the Indian consumer market. The Indian Standard IS 616:2017 should be followed when using an electronic musical instrument. The BIS Registration is required to launch any musical system in the Indian market.

What is the meaning of CRS?

CRS is a short form of Compulsory Registration Scheme, which was first introduced by the Ministry of Electronics & Information Technology for electronic & IT items. Currently, there are 79 electronic items listed under this Scheme. All individuals and businesses manufacturing, importing, storing, selling or distributing electronic goods under the product list must apply for BIS CRS Certification. Any individuals who are manufacturers of electronic items need to apply for this Certification after getting their electronic product tested by the BIS Certified Laboratory. Then, BIS registers the manufacturers under BIS CRS Certification Scheme who are allowed to declare that their products conform to the Indian Standards. Once the entity is successfully registered, they are permitted to use the BIS Standard mark as informed by the BIS CRS Certification allotted to the applicant.

Basic Requisite of BIS CRS Certification for Electronic Musical Systems

Following are the four essential requisites on which BIS CRS Certification depends; without these, no one can apply for BIS Certification. To obtain BIS CRS Certification for Electronic Musical Systems, an applicant need to fulfil the following requirements:

  1. Manufacturer: The first essential thing is that Indian BIS CRS Certification is granted to manufacturers only, not sellers/importers. An importer may act Authorised Representative of a foreign manufacturer and can apply to BIS. But a final BIS CRS Certification is only granted to the manufacturer.
  2. Manufacturing Address: Proper manufacturing address will be mentioned in the documents. In case the manufacturer has more than one manufacturing address for one product, then separate BIS CRS Certification is required for each manufacturing address.
  3. Product: If the manufacturer is manufacturing more than one electronics product, then the manufacturer has to apply a separate BIS CRS Certification application for each product category. For example, a manufacturer who manufactures mobiles and chargers needs to apply two separate applications with BIS.
  4. Trademark/ Brand: All trademark or brand needs their own BIS CRS Certification.

Documents Required to Obtain BIS CRS Certification for Electronic Musical Systems

Following are some essential required documents to obtain BIS CRS Certification for electronic musical systems in India:

  • Filled CDF or CCL form
  • Duly filled BIS application form-I
  • Business License of manufacturing unit (English Translation + Local Language)
  • The scope of the Business License (English Translation + Local Language)
  • Authorisation letter (In case of the signatory person is other than the owner of the manufacturing)
  • Marking Label/ Details of Marking on the product
  • ISO Certificate of the manufacturer
  • Trademark Certificate
  • An affidavit cum undertaking
  • Trademark Authorization Letter (In case of  TM is owned by other than the manufacturer)
  • Letter of the nomination of Authorised Indian Representative
  • ID proof of authorised Indian Representative/ Authorized Signatory
  • Technical Specification Sheet of Product or user manual
  • Authorised Indian Representative (AIR) Company Registration proof in India (in case of the foreign manufacturer)

Procedure to Obtain BIS CRS Certification for Electronic Musical Systems

The process of obtaining BIS CRS Certification for domestic manufacturers differs from foreign manufacturers. Following is the process required to obtain BIS CRS Certification for Electronic Musical Systems in India:

Process for Indian (Domestic) Manufacturer

Step 1: Submit the online application, submit all the required vital documents, and pay the certification and testing fees.

Step 2: The BIS-certified Laboratory must submit the product samples test report.

Step 3: Submit a copy of the application, including a test report of product samples.

Step 4: The BIS Official & Inspection team will verify the application, essential documents, and the product samples test report.

Step 5: Issuance of Certificate for BIS CRS Certification for Electronic Musical Systems.

Process for Foreign or Overseas Manufacturers

Step 1: Nominate AIR (Authorised Indian Representative), who can represent foreign/overseas manufacturers.

Step 2: Submit an online application and submit the required vital documents and product samples test reports.

Step 3: Submit a hard copy of the application and the product samples test report.

Step4: BIS Official & Inspection team verify the application and all the submitted documents and product samples test report.

Step 5: Issuance of Certificate for BIS CRS Certification for Electronic Musical Systems.

Note: BIS CRS Certification for Electronic Musical Systems is valid for two years. The Certification can be further renewed if there is no change in the product and standard.

Guidelines for the Nomination of Authorised Indian Representative (AIR)

The foreign or overseas manufacturer must appoint Authorized Indian Representative or AIR[1] for its operations in India to get BIS CRS Certification. In case they do not have a branch office in India. An AIR, as a local representative, is accountable for submitting and managing the application for BIS CRS Certification and is available to answer the questions. Following are some essential guidelines to be followed by foreign or overseas manufacturers to appoint AIR:

  • Clause 1: If the foreign or oversea manufacturer has a liaison office/ branch office in India, they will be designated as AIR.
  • Clause 2: If the foreign or overseas manufacturer does not have a liaison office/branch office in India, but the proprietor/registered user of the trademark or brand appearing on the product is located in India, the owner of the trademark or brand will become AIR.
  • Clause 3: If the manufacturer does not have a liaison office located in India, and there is no proprietor/registered user of the trademark or brand appearing on the product in India, then the other entity will become the AIR.

Conclusion

Getting a BIS CRS Certification for Electronic Musical Systems for Electronic Musical Systems is not as seamless as it seems, considering that it includes proper knowledge of the certification process. It is mandatory for all manufacturers who want to sell their electronic products in the Indian market.
