On 05th April 2023, the Ministry of Health and Family Welfare (MoHFW) published the Surrogacy Regulations, 2023, where the regulations are deemed to be effective from 05th April 2023.
The Amended Regulation states the following –
In Section 4 clause (iii) which states “no surrogacy or surrogacy procedures shall be conducted or initiated, unless the Director or in-charge of the surrogacy clinic and the person qualified to do so are satisfied, for reasons to be recorded in writing, that the following conditions have been fulfilled” in subclause (c) the following condition shall be added namely –
