Overview of Karnataka State Pollution Control Board

Karnataka State Pollution Control Board is an authority under the Karnataka State Government that regulates and implements various environmental laws to ensure the safety and health of people living in the State and to keep a check on environmental degradation. The State Government adopted uniform environmental laws enacted by Central Government to control the environmental pollution in the State.  

The Karnataka State Government constituted the Karnataka State Pollution Control Board on 21st September 1974 in pursuance of the Water (Prevention & Control of Pollution) Act, 1974. The Board was constituted for the prevention and control of water pollution. After the enactment of the Air (Prevention & Control of Pollution) Act in 1981 enforced, the responsibility of prevention, control and abatement of the air pollution was entrusted to the Karnataka State Pollution Control Board. The Board is headed by a full-time Chairperson and assisted by a Member Secretary with a strength of 300 employees. 

The vision of KSPCB is to have a cleaner and greener Karnataka. For a pollution-free environment and for a better quality of life in the State, KSPCB has effectively implemented the environmental laws and created awareness among the public.

The objective of the Karnataka State Pollution Control Board

The followings are the objectives of the Karnataka State Pollution Control Board:

  • To safeguard and improve the environment.
  • To aim at establishing programmes in the State to protect and restore the quality of the environment in the State. 
  • To implement uniform and workable environmental standards that the industries can accept to remove the inconsistency and ambiguity in relation to environmental laws.
  • To monitor Sir and water pollution level in the State and to keep a record of the same.

Karnataka State Pollution Control Board Consent and registration

The individual or business entity that is involved in activity resulting in the discharge of effluents and emissions is required to obtain prior consent from the Karnataka State Pollution Control Board under the Water and Air Act. It is obtained to ensure that the activities adhere to the rules and regulations implemented by the Karnataka State Pollution Control Board. Non-adherence to such rules and regulations will compel the Board to initiate legal action. The rules and regulations under the KSPCB are binding, practicable and activity-specific, such as: 

  • Discharge effluents
  • Discharge emissions
  • Dispose of Hazardous waste
  • Dispose of bio-medical waste
  • Dispose of e-waste
  • Dispose municipal waste
  • Restriction for authorized recyclers

For the consent, authorization or registration, the Board has categorized industries into three categories on pollution potential. The categorization is as follows:

  1. Red: High Pollution potential industries 
  2. Orange: Moderate Pollution potential industries
  3. Green: Least Pollution potential industries

There are three types of consent as defined by the Board:

  1. Consent for Establishment

The consent for establishment is obtained before establishing any industry, operation or process.

  1. Consent for Operation

The consent for operation is obtained before the commission of industry and for the continuation of discharge of effluents and emissions.  

  1. Consent for Expansion

The consent for expansion is obtained when an industry expands, modifies or changes products or processes. 

Functions of the Karnataka State Pollution Control Board

The following are the main functions of the Karnataka State Pollution Control Board:

  • Make recommendations on any matter related to the prevention and control of water and air pollution and improvement of the quality of air. 
  • Organizing consumer awareness programmes related to preventing and controlling air and water pollution and waste management. 
  • After collecting and compiling, and preparing statistical and technical data related to air and water pollution.
  • Lay down the standard of sewage and trade effluents and for emissions from an industrial plant, automobiles, health care units, etc. 
  • Development of new technology for trade effluents, treatment of sewage and control equipment.
  • Issuance of consent certificate to industries falling under red, orange and green categories.
  • Issuance of bio-medical, plastic, hazardous, battery and E-waste management Authorization to the industries and establishment. 

Documents for Karnataka State Pollution Control Board consent

The documents required for filing an application to Karnataka State Pollution Control Board are the following:

  • Aadhar Card and Pan card of Authorized person 
  • Certificate of Incorporation (CIN), in case of a Private Company
  • PAN Card of the unit, in case of Partnership
  • Authorization letter except in case of Proprietorship
  • Proof of Ownership
  • CA Letter for total project cost
  • GST Certificate

Procedure for Karnataka State Pollution Control Board Consent

The consent by Karnataka State Pollution Control Board is as per the Water, and Air Act is obtained by fulfilling certain conditions with the required fee and by following these steps:

  • Identification of Category 

New industry first has to identify the category (red, orange or green) under which it falls, as divided by the Karnataka State Pollution Control Board.

  • Filing of Application

The new industry has to apply for consent to the Karnataka State Pollution Control Board by submitting necessary documents with the requisite fee and fulfilling all the required conditions. 

  • Scrutinization 

The application by the applicant for obtaining the consent of the Karnataka State Pollution Control Board is scrutinized by a designated officer. The site inspection is also done by the authorized officer and then forwarded to Head Office with the recommendation. The review by Technical Advisory Committee is also done if necessary. 

  • Issue of consent

The consent of the Karnataka State Pollution Control Board is issued within specified days.
