Validity of UL VNO License from DoT

As per the unified license guidelines, a UL VNO license in India shall be issued on a non-exclusive basis and is valid for 10 years from the effective date of the first authorisation; however, this duration of license can be reviewed after 3-4 years.

UL VNO Guidelines Issued by DoT

In order to obtain a UL VNO License, the applicant must keep in mind the following guidelines issued by the Department of Telecommunications (DoT) under the aegis of the Ministry of Communications and Information Technology:

  • The VNO applicant must be registered as a company under the Indian Companies Act, 2013.
  • The UL VNO application must be submitted in the format prescribed under Annexure II.
  • One Company can have only one UL VNO License.

The applicant may apply for authorisation for more than one service and service area, subject to fulfilment of all the conditions of entry simultaneously or separately at different times. The tenure of such authorisation will run concurrently with the UL VNO.

  • The VNO applicant is required to pay the nonrefundable processing fee as per Annexure-I, along with two copies of the application. The fees shall be payable in the form of a Demand Draft/Pay Order from a Schedule Bank payable in New Delhi.
  • There is no restriction on the number of VNO licensees per service area, so innumerable people can apply.

Who is Eligible to Obtain a UL VNO License in India?

An operator who wants to provide telecom services employing the underlying network and/or access spectrum of an existing Network Service Operator (NSO) will have to obtain a UL (VNO) license. The following entities are eligible to obtain a UL VNO License in India:

  • The applicant company must be registered in India and have a net worth of at least INR 10 lakhs.
  • The applicant company must have a 3-year track record of financial soundness.
  • The applicant company must not have any outstanding dues to the DoT or any other government organisation.
  • The applicant company must have a clear business plan that clearly outlines the services intended to be provided, target market, projected revenue, etc.

Prerequisites of a UL VNO License Application

Once you have figured out that you are eligible to obtain a UL VNO License in India, you must ensure the following:

  • Your company must enter into a network agreement with a licensed telecom service provider to enable you to lease capacity. This will allow you to offer services to the end customer.
  • Your company must ensure compliance with all pertinent rules, regulations and guidelines pertaining to quality of service, data security, client protection, etc., issued by the DoT and other concerned authorities.
  • You are required to pay the applicable fees and/or charges, such as License fees, regulatory fees, etc.
  • You are further mandated to maintain precise records of your business operations, which are to be submitted at regular intervals as a report to the DoT.
  • You must comply with all other applicable tax laws and pertinent regulations.

How to Apply for a UL VNO License in India?

As per the VNO Guidelines by Dot, the applicant can obtain a UL VNO License by undertaking these steps:

  • First things first, the applicant must check his eligibility as per the VNO guidelines prescribed by DoT.
  • The VNO is available under three categories. Therefore, the VNO applicant must specify the class mentioned under which he intends to apply.
  • Once the first two things have been ensured, the applicant is required to fill out the form, which can be downloaded from the official website.
  • The applicant must submit the application form, along with the prescribed fee and the necessary papers prescribed as per the VNO guidelines.
  • Post submission, the Telecom Regulatory Authority of India, i.e., TRAI, will evaluate the application submitted, verify the Documents and provide you with the details.
  • If your VNO application gets accepted, you will receive a Letter of Intent. As per the VNO ISP License guidelines, you will be required to follow the instructions specified in that letter.
  • After this, simply submit the bank guarantees and deliver the guarantee agreement to the DoT.
  • Once you have paid all the fees as prescribed and followed all the necessary instructions, you will receive the UL VNO License.
