The\nSpecification of a Patent is a techno-legal document that contains technical\nand scientific claims and disclosures related to the invention which are the\nbasis of rights associated with the Patent. The Specification, thus, forms a\ncrucial part of the patent application. As per the <strong><em>Patent Act, 1970, and\nthe Patent Rules, 2003<\/em><\/strong>, a Patent Specification can be filed either as a\nProvisional or Complete Specification. <\/p>\n\n\n\n<p>The Provisional or Complete Specification is required to be submitted in <strong><em>Form-2 <\/em><\/strong>as prescribed under the<strong><em> <\/em><\/strong><em><strong>Patent Act, 1970, and the Patent Rules, 2003<\/strong>.<\/em> The <strong><em>Form-2<\/em><\/strong> is also required to be filed along with an Application <strong><em>Form-1<\/em><\/strong> and other required documents together with the fees prescribed as provided in the First Schedule. <\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter\"><img decoding=\"async\" width=\"576\" height=\"336\" src=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/06\/image-10.png\" alt=\"Specification of Patent\" class=\"wp-image-9943\" srcset=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/06\/image-10.png 576w, https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/06\/image-10-300x175.png 300w\" sizes=\"(max-width: 576px) 100vw, 576px\" \/><\/figure><\/div>\n\n\n<p><strong><em>As\nper the Patent Act, 1970, and the Patent Rules, 2003, the first page of Form &#8211;\n2 should contain the following essentials: <\/em><\/strong><\/p>\n\n\n\n<ul>\n<li>The Title of the\ninvention; <\/li>\n\n\n\n<li>The Name of each of the\napplicants for Patent;<\/li>\n\n\n\n<li>The Address of each of\nthe applicants for Patent;<\/li>\n\n\n\n<li>The Nationality of each\nof the applicants for Patent; and <\/li>\n\n\n\n<li>The Preamble to the Description.\nThe basic requirements for the Preamble to the Description are as follows: &nbsp;<\/li>\n<\/ul>\n\n\n\n<ol>\n<li>If any person files the\nProvisional Specification of a Patent, the Preamble is required to be as under:\n\u201c<strong>The following Specification describes\nthe invention<\/strong>\u201d. <\/li>\n\n\n\n<li>If any person files the\nComplete Specification of a Patent, the Preamble is required to be as under: \u201c<strong>The following Specification particularly\ndescribes the new or original invention and the complete manner in which it is\nto be performed<\/strong>.\u201d <\/li>\n<\/ol>\n\n\n\n<ul>\n<li>The title of the new or original invention should disclose the definite features of the invention generally in not more than 15 words. The applicant of the application for grant of Patent is required to submit the necessary drawings, wherever required. Further, the Controller of Patent can also require the applicant to submit drawings, if required, at the stage of examination. <\/li>\n\n\n\n<li>Such drawings shall form a part of the Specification of Patent and suitable references thereto should be made in the Patent Specification. The Controller of Patent may require the applicant of the application for grant of Patent to submit, at any time before the grant, samples or models related to the new or original invention of the inventor for better illustration of the invention. However, such samples or models should not form part of the Patent Specification.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_are_the_requirements_for_filing_amendments_to_the_Specification_of_Patent\"><\/span>What\nare the requirements for filing amendments to the Specification of Patent? <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>The essential requirements for filing amendments to the Specifications of Patent are as follows:<\/em><\/strong><\/p>\n\n\n\n<ul>\n<li>When any amendments are\nmade to a Provisional or Complete Specification of a Patent or any drawing\naccompanying the invention, the pages including such amendments should be submitted\nand retyped to form a continuous document. <\/li>\n\n\n\n<li>A marked copy clearly\nidentifies the amendments that are carried out and a statement clearly indicates\nthe portion (line number and page number) of <strong>the Specification of Patent or any drawing<\/strong> that is being amended\nalong with the reasons in detail should also be filed. <\/li>\n\n\n\n<li>Amendments in a\nSpecification should not be made by some slips pasted on, or as footnotes or by\nwriting along the margins of any of the said documents. <\/li>\n\n\n\n<li>When a retyped page or\npages including amendments are submitted, the conforming earlier page or pages\nshould be deemed to have been cancelled and superseded by the applicant of the\napplication for grant of Patent.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_is_a_Provisional_Specification_of_Patent\"><\/span>What\nis a Provisional Specification of Patent? <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul>\n<li>When the applicant of the application for grant of Patent finds that his\/her invention has reached a phase where the invention can be disclosed but the final phase of the invention has not attained by it, he\/she may go for a preparation of a disclosure of the invention in the form of a description in written form and submit such description of the Patent at the Patent Office as a Provisional Specification of Patent.<\/li>\n\n\n\n<li>The filing of a Provisional Specification secures a date of priority for the application of Patent. <\/li>\n\n\n\n<li>As per <strong><em>Section 9(1) of the Patent Act, 1970,<\/em><\/strong> an application that is filed with the Provisional Specification is deemed to be abandoned if no Complete Specification is filed within the time period of 12 months from the date on which the Provisional Specification was filed with the Patent Office. <\/li>\n\n\n\n<li><strong><em>Under Section 9(2) of the Patent Act, 1970,<\/em><\/strong> if in the opinion of the Controller of Patent, two or more Provisional Specifications are filed by an applicant are similar, or if one Specification is a modification of the other Specification, he\/she can allow the applicant to file one Complete Specification with regard to all such different Provisional Specifications. Such a Complete Specification is required to be filed within the time <strong>period of 12 months<\/strong> from the date on which the first provisional Specification of Patent was filed. In such cases where Controller asked to file one Complete Specification for two or more Provisional Specifications, the date of filing of the application will be considered the date on which the earliest Provisional Specification was filed and should also bear the number of that earliest application. <\/li>\n\n\n\n<li>A request can be made by the applicant, within 12 months from the date of filing of a Complete Specification (not being a PCT National Phase application or a convention application Application) to the Controller of Patent to convert the Complete Specification so filed by the applicant into a Provisional Specification. <\/li>\n\n\n\n<li>Subsequently, the applicant is required to file a Complete Specification within 12 months from the date of the first filing of the application. In the Patent proceedings, a Complete Specification is an important document;\nit is advised to the applicant that Complete Specification is required to be\ndrafted with the highest care and should be without any ambiguity. <\/li>\n\n\n\n<li>It is compulsory on the\npart of the applicant to disclose particularly and fully numerous features establishing\nthe invention. The disclosures of an invention in a Complete Specification should\nbe such that a person of average knowledge and skill in India should be able to\nperform the invention of the applicant based on the descriptions and other\nrequired details that are disclosed in the Complete Specification of a Patent\nby the applicant.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_are_the_contents_of_the_Complete_Specification_of_Patent\"><\/span>What\nare the contents of the Complete Specification of Patent? <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>The\nessential contents of Complete Specification of Patent are as follows: <\/em><\/strong><\/p>\n\n\n\n<ul>\n<li>A Complete\nSpecification filed by the applicant should particularly and fully describe the\ninvention of the applicant and the use or operation of the invention and the\nmethod by which the invention is performed; <\/li>\n\n\n\n<li>A Complete\nSpecification should disclose or reveals the best method of performing the\ninvention of the applicant which is known to the applicant for which he\/she is\nentitled or permitted to claim protection for the invention; <\/li>\n\n\n\n<li>A Complete\nSpecification is required to end with a claim or set of claims defining or\ndescribing the scope of the new invention for which the protection is claimed\nby the applicant; <\/li>\n\n\n\n<li>A Complete\nSpecification should also make a reference for the deposit of the biological\nmaterial related to the invention in the International Depository Authority, in\ncase it is applicable; <\/li>\n\n\n\n<li>A Complete\nSpecification should disclose the geographical origin and source of the biological\nmaterial related to the invention that is specified in the Specification; <\/li>\n\n\n\n<li>A Complete\nSpecification should be accompanied by an abstract; <\/li>\n\n\n\n<li>A Complete\nSpecification should not include any irrelevant or other subject matter, which\nis not necessary for the explanation of the invention of the applicant, from\nthe title, claims, description, and drawings filed by the applicant. <\/li>\n\n\n\n<li>In the case of Complete\nSpecification for a Divisional Application under the Patent Act, 1970, it\nshould contain a specific reference to the total number of original applications\nfiled by the applicants from which the Divisional Application of invention is\nmade. <\/li>\n\n\n\n<li>In the case of a Complete\nSpecification for a Patent of Addition under the Patent Act, 1970, it should\ncontain a specific reference to the total number of main Patent or Application\nfor the grant of Patent, as the case may be, and a definite statement that\ninvention of the applicant comprises of an modification or improvement of the\ninvention claimed in the Complete Specification of the main Patent granted or\napplied for the grant.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion\n<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p> The applicant of the application for the grant of Patent is required to file the Specification of Patent in India with the Patent Office.
