The Indian International Searching Authority provides the applicants from different member countries, a facility for filing single international application for granting of Patent in member countries all over the world. <\/li>\n\n\n\n<li>This Indian International Searching Authority also has some additional benefits like, obtaining <strong>International Search Report<\/strong> (ISR) before entering the national phase in every individual country which is a member. The International Search Report (ISR) is established in accordance with high <strong>internationally regulated standards<\/strong>, by one of the Patent Offices of the world.<\/li>\n\n\n\n<li>These Patent Offices are highly experienced in doing <strong>examination of the Patent applications<\/strong> and specifically those Patent applications that have been appointed by World Intellectual Property Organization (WIPO) to carry out international examination and search. The Patent Office of India was recognized as an International Searching Authority (ISA) under the Patent Cooperation Treaty (PCT). The Indian Patent Office started functioning from <strong><em>15<sup>th<\/sup> October, 2013<\/em><\/strong> as International Searching Authority. <\/li>\n\n\n\n<li>As per requirement for International Searching Authority, the Indian Patent Office has access to the complete and <strong>comprehensive collection of Patent<\/strong> and <strong>Non-Patent literature<\/strong> to accomplish Patent Cooperation Treaty minimum documentation requirement, integrated Search platform IPATS. <\/li>\n\n\n\n<li>It is to enable one-click search through the wide assembly of information and professionally experienced, qualified, and skilled Examiners. Indian Patent Office also has established a Quality Management System for monitoring the Indian International Searching Authority. A fully electronic processing system ensures speedy dissemination and disposal and of information on a real-time basis.<\/li>\n\n\n\n<li>The Patent Office, Delhi performs the functions of the Indian International Searching Authority under the <strong>Patent Cooperation Treaty<\/strong> (PCT) in accordance with an agreement between the <strong>International Bureau<\/strong> (IB) and the <strong>Indian Patent Office<\/strong> (IPO). The fees payable to the Indian International Searching Authority includes the fees as prescribed in the Fifth Schedule, along with the fees prescribed in the regulations made under the Patent Cooperation Treaty (PCT). <\/li>\n\n\n\n<li>The International Searching Authority (ISA) establishes the International Search Report relating to the international applications for the grant of Patents, or, as the case may be. It declares in compliance with <strong><em>Rule 19-B of the Patent Rules, 2003,<\/em><\/strong> that an expressive search cannot be established, in the cases where India has been designated as a competent International Searching Authority (ISA).<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Who_are_the_Applicants_in_Indian_International_Searching_Authority\"><\/span>Who\nare the Applicants in Indian International Searching Authority? <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The applicants of PCT International applications are nationals or residents of India and Iran. These nationals can choose the Indian Patent Office (IPO) as International Searching Authority. The different type of Indian applicants choosing IPO as International Searching Authority includes <strong>individual inventors<\/strong>, <strong>premier research institutions<\/strong>, <strong>start-ups<\/strong>, <strong>universities<\/strong>, <strong>Indian multinational conglomerates, foreign firms<\/strong> with Indian inventors or <strong>Indian companies<\/strong> as co-applicants and Indian units of foreign <strong>multinational firms<\/strong>.<\/p>\n\n\n\n<p class=\"text-left\"><b>Read our article<\/b>:<mark style=\"background: #fffd03 !important;\"><a href=\"https:\/\/corpbiz.io\/learning\/types-of-patent-applications-in-india\/\">Different Types of Patent Applications in India\n<\/a><\/mark><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_is_an_International_Search_Report_of_an_Indian_International_Searching_Authority\"><\/span>What is an International Search Report\nof an Indian International Searching Authority? &nbsp;<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>The\nprocess of obtaining an International Search Report of an International\nSearching Authority is as follows:<\/em><\/strong><\/p>\n\n\n\n<ul>\n<li>Under <strong><em>Rule 19-B\nof the Patent Rules, 2003,<\/em><\/strong> on receipt of the search copy, the Indian\nInternational Searching Authority, is required to notify the International\nBureau (IB) and the applicant of the application about the receipt of search\ncopy with an identification mark <strong>&#8216;ISA\/IN&#8217;<\/strong>\ntogether with the international application number and date of receipt and\nserial number of the search copy. <\/li>\n\n\n\n<li>Notwithstanding\nanything contained in the proviso to item (i) of <strong><em>Rule 24-B of the<\/em><\/strong>\n<strong><em>Patent Rules, 2003,<\/em><\/strong> the International Searching Authority is\nrequired to, upon the receipt of the search copy, refer the international\napplication for the grant of Patent, in the manner in which the search copy was\nreceived, to an examiner or any other officer appointed under <strong><em>Section 73(2)\nof the Patent Act, 1970.<\/em><\/strong> <\/li>\n\n\n\n<li>The examiner is\nrequired to prepare an International Search Report (ISR), consistent with the\nprovisions prescribed in the Patent Cooperation Treaty (PCT) and the\nregulations and rules prescribed under the Treaty. The ISR should be prepared\nby the examiner within a time period of one month but should not exceed 2\nmonths from the date on which such reference was made by the Indian\nInternational Searching Authority.<\/li>\n\n\n\n<li>In accordance with <strong><em>Rule\n19(3) of the Patent Rules, 2003,<\/em><\/strong> if the International Searching\nAuthority contemplates that, the international application for the grant of\nPatent is related to a subject matter which the International Searching Authority\nis not required to search. Therefore, accordingly, the Searching Authority decides\nnot to search; or the claims, description, or drawings fail to fulfill the\nrequirements prescribed under the rules and regulations prescribed under the Patent\nCooperation Treaty. <\/li>\n\n\n\n<li>It is to such an extent\nthat an expressive and meaningful search will not be carried out, and then the International\nSearching Authority states and informs the applicant of the application for the\ngrant of Patent and the International Bureau (IB) that there will be no\nestablishment of an International Search Report. <\/li>\n\n\n\n<li>In the case where any\nof the situations mentioned in<strong><em> Rule 19(3) clause (a) or (b) of the<\/em><\/strong>\n<strong><em>Patent Rules, 2003,<\/em><\/strong> is found to be existing in connection with\ncertain specified claims only, the International Searching Authority (ISA) is\nrequired to indicate such a fact in the International Search Report (ISR) with\nregard to such claims, and for any other claims, that are established in the\nInternational Search Report (ISR). <\/li>\n\n\n\n<li>If the International Searching\nAuthority (ISA) contemplates that the international application for the grant\nof Patent does not fulfill the requirements of unity of an invention or\ncreation, consistent with the provisions prescribed in <strong><em>Rule 13<\/em><\/strong> of\nthe rules and regulations under the Patent Cooperation Treaty (PCT), then the\nSearching Authority sends a notice with specifying the reasons for which the\ninternational application for the grant of Patent is not considered as fulfilling\nthe requirement of the unity of an invention. <\/li>\n\n\n\n<li>Subsequently, the\napplicant of the application for grant of Patent is invited to;-<\/li>\n<\/ul>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter is-resized\"><img decoding=\"async\" src=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/05\/image-141-e1590650735690.png\" alt=\"International Search Report\" class=\"wp-image-9593\" width=\"544\" height=\"313\" srcset=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/05\/image-141-e1590650735690.png 579w, https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/05\/image-141-e1590650735690-300x173.png 300w\" sizes=\"(max-width: 544px) 100vw, 544px\" \/><\/figure><\/div>\n\n\n<ul>\n<li>The International Searching\nAuthority creates the International Search Report (ISR) on those parts of the\ninternational application which are related to the invention first mentioned in\nthe claims of the main invention and subject for the payment of additional fees\nwithin the prescribed time period specified in<strong><em> Rule 19<\/em><\/strong> <strong><em>(5) of\nthe Patent Rules, 2003<\/em><\/strong>. It applies to those parts of the international\napplication for the grant of Patent which is related to inventions in respect\nof which such an additional fee was paid.<\/li>\n\n\n\n<li>Any applicant can under\nprotest also pay the additional fees that are to be accompanied by a reasoned\nstatement explaining that the international application fulfills the\nrequirement of unity of invention or that the amount of the additional fees\nrequired is excessive. <\/li>\n\n\n\n<li>The examination of the\nprotest referred to in<strong><em> Rule 19 (7) of the Patent Rules, 2003,<\/em><\/strong> is\ncarried out by a Review Committee established by the Controller of the Patent. <\/li>\n\n\n\n<li>The Review Committee that\nis established under<strong><em> Rule 19 (8) of the Patent<\/em><\/strong> <strong><em>Rules, 2003<\/em><\/strong>,\nwill examine the extent to which the protest is justified and, will accordingly,\norders for the total or partial repayment of the additional fee to the\napplicant of the international application for the grant of Patent.<\/li>\n\n\n\n<li>Where the applicant of\nthe international application for the grant of Patent has not paid the fees for\nthe protest according to<strong><em> Rule 19 (5) clause (b) of the<\/em><\/strong> <strong><em>Patent\nRules, 2003,<\/em><\/strong> the protest will be considered that it has not been made\nand the same will be declared by the International Searching Authority.<\/li>\n\n\n\n<li>The protest fee of the\napplicant will be refunded to the applicant, in the case, where the Review\nCommittee referred to in<strong><em> Rule 19 (8) of the Patent Rules,<\/em><\/strong> <strong><em>2003,<\/em><\/strong>\nfinds that the protest was completely justified.<\/li>\n\n\n\n<li>Where the international\napplication for the grant of Patent includes the disclosure of one or more\namino acid or nucleotide sequences and such sequences are not furnished in\ncomputer-readable text format, the International Searching Authority sends a\nnotice to the applicant of the international application for the grant of\nPatent to submit such a sequence listing in computer-readable text format. They\nhave to pay the late fee specified in the Fifth Schedule, within a time period\nof one month from the date on which such notice was received. <\/li>\n\n\n\n<li>In a case where the\napplicant of the international application fails to fulfill the requirements of\nthe notice, the International Searching Authority searches the international\napplication made for the grant of Patent to such an extent that a meaningful or\nexpressive search can be carried out without the sequence listing in computer-readable\ntext format. <\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_is_the_time_period_prescribed_for_establishing_an_International_Search_Report_by_the_Indian_International_Searching_Authority\"><\/span>What is the time period\nprescribed for establishing an International Search Report by the Indian\nInternational Searching Authority? <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>As per <strong><em>Rule 19-C of the Patent Rules, 2003,<\/em><\/strong> the Indian International Searching Authority is required to establish the International Search Report (ISR) and a written opinion or, as the case may be, within a time period of 3 months from the date on which the search copy by the International Searching Authority is received, or within a time period of 9 months from the date of priority, whichever expires later. The provisions related to the time period for establishing an International Search Report is prescribed in <strong><em>Rule<\/em><\/strong> <strong><em>19-B of the Patent Rules, 2003<\/em><\/strong>.&nbsp; <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_are_the_essential_requisites_to_be_fulfilled_by_the_Indian_International_Searching_Authority\"><\/span>What are the essential requisites\nto be fulfilled by the Indian International Searching Authority?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>The essential requirements to be fulfilled by the Indian International Searching Authority are as follows:<\/em><\/strong><\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter\"><img decoding=\"async\" width=\"576\" height=\"337\" src=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/05\/image-143.png\" alt=\"Indian International Searching Authority\" class=\"wp-image-9594\" srcset=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/05\/image-143.png 576w, https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/05\/image-143-300x176.png 300w\" sizes=\"(max-width: 576px) 100vw, 576px\" \/><\/figure><\/div>\n\n\n<h3 class=\"wp-block-heading\">Transmittal of International\nSearch Report and written opinion<\/h3>\n\n\n\n<p>As\nper <strong><em>Rule 19-D of the Patent Rules, 2003,<\/em><\/strong> the International Searching\nAuthority is required to transmit one copy of the International Search Report\n(ISR) or of the declaration mentioned to in <strong><em>Article 17(2)(a)<\/em><\/strong> of\nthe Patent Cooperation Treaty (PCT), and one copy of the written opinion provided\nunder <strong><em>Rule 43bis.1<\/em><\/strong> of the rules and regulations under the Patent\nCooperation Treaty (PCT), to the International Bureau (IB) and one copy to the\napplicant of the application of Patent, on the same day.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Confidential Treatment<\/h3>\n\n\n\n<p>As\nper <strong><em>Rule 19-E of the Patent Rules, 2003,<\/em><\/strong> all subject matters relating\nto the international applications for grant of Patent are to be kept\nconfidential in accordance with the Patent Cooperation Treaty (PCT) and the\nrules and regulations prescribed under the PCT.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The <strong><em>Patent Rules, 2003,<\/em><\/strong> provides for the provisions related to the Indian International Searching Authority.
