Adulteration Act, 1954 the definition of \u201cadulterated\u201d food\nis as follows;<\/p>\n\n\n\n<ul>\n<li>If they sold food item is not of nature, substance or quality demanded by the customer. Additionally, if the food product does not conform to the quality, standard or nature it was represented as then it can be categorized as an adulterated food<\/li>\n\n\n\n<li>When the food article contains any other substance which might affect or the article is so processed which might cause a health hazard, comprised in its nature, content or quality<\/li>\n\n\n\n<li>Any food article prepared, packed or kept under unsanitary conditions, which lead to contamination of such food item<\/li>\n\n\n\n<li>In case the constituent of the food item has wholly or partially abstracted that might affect the health of the consumer<\/li>\n\n\n\n<li>If the food article is obtained from a diseased animal<\/li>\n\n\n\n<li>In case the food product is entirely or in part is a filthy, putrid, rotten, decomposed, or sick animal. On the other hand, vegetable items containing insect\/ pest- infected or are unfit for human consumption in any way<\/li>\n\n\n\n<li>Food item containing any poisonous or any other ingredient which might be detrimental to health<\/li>\n\n\n\n<li>Article consisting of any prohibited preservative or permitted preservative used above the prescribed limit<\/li>\n\n\n\n<li>If the quality of the food product is below the prescribed standards or consists of ingredient which is not within the permissible limit<\/li>\n\n\n\n<li>Any other reason as specified<\/li>\n<\/ul>\n\n\n\n<p>However, it is provided that if the quality or purity of the food product gets deteriorated due to any natural reason\/ factor, it would not be considered as food adulteration. <\/p>\n\n\n\n<p>Food adulteration also includes the display of any false or misleading advertisement intending for the sale of any food item. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Causes_of_adulteration_of_food_How_food_adulteration_happens\"><\/span>Causes of adulteration of food: How food adulteration\nhappens?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Adulteration of food is\na long term problem dating back from ancient times. It can be intentional\nintending to earn more profits from the products sold, or it can be\nunintentional, caused due to natural causes or any other such reason. The common occurrence of food adulterations\nare as follows;<\/p>\n\n\n\n<ul>\n<li>Sale of expired food items&nbsp;<\/li>\n\n\n\n<li>Dust, insects, worms or fungus on food<\/li>\n\n\n\n<li>Incorrect packing<\/li>\n\n\n\n<li>Incomplete\/insufficient\/improper information on food label&nbsp;<\/li>\n\n\n\n<li>Misleading commercials<\/li>\n\n\n\n<li>Address of maker\/ marketer not mentioned<\/li>\n\n\n\n<li>No enlistment of harmful ingredients like MSG&nbsp;<\/li>\n\n\n\n<li>Lack of warnings<\/li>\n\n\n\n<li>Any other form of contamination as per the Prevention of Food Adulteration Act, 1954<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Compensatory_Remedies_for_Victim_of_Food_Adulteration\"><\/span>Compensatory\nRemedies for Victim of Food Adulteration <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>According to\nthe Food Safety and Standards Act, 2006, the given below remedies\ncan be granted to\nthe victims under section\n65 of the Act. Any person who manufactures a food article\neither by himself or through any other person which can be injurious to the\nconsumer or can cause his\ndeath, such manufacture shall be made liable for the payment to the victim a\nfine which may exceed to :<\/p>\n\n\n\n<p>i) At least\nfive lakh rupees in case of death;<\/p>\n\n\n\n<p>ii) Not beyond three lakh rupees\nin case of serious or grievous\ninjury;<\/p>\n\n\n\n<p>iii) Not more than one lakh rupees in other cases of injury. Provided that such compensation shall be paid at the earliest before six months and an interim relief in the case of death of the person shall be sent to the family of the victim within the time period of thirty days. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Procedure_to_File_a_Complaint_against_Adulteration_of_Food\"><\/span>Procedure to File a Complaint against Adulteration of Food<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>You should be aware of\nthe food products you are consuming. Sometimes it happens that you get a food\nproduct which is infected with worms or contains dust or any other external\nmatter, which should not have been there in the first place. Therefore, to\navoid such situations, you are required to know what steps you can take. In\nother words, you need to know how you can file a complaint against such an\noccurrence.&nbsp;<\/p>\n\n\n\n<p>If you come across any\nrestaurant or any other&nbsp;<a href=\"https:\/\/corpbiz.io\/learning\/how-to-set-up-a-food-business-in-india\/\"><strong>food business<\/strong><\/a>&nbsp;that\nyou see is taking part in or perpetrating food adulteration, you can file a\ncomplaint against the Manufacturer,&nbsp;Restaurant owner, Shopkeeper or\nEmployer to the Local Health Authority\/ Food Safety Authority\u2019s district commissioner\nor the Consumer Forum.<\/p>\n\n\n\n<p>Furthermore, you can\napproach the Consumer Forum at any of the three levels, namely; district level,\nstate level and national level. The complaints registered in this manner have\nthe original jurisdiction at district levels and further appellate court at a\nstate or federal levels.<\/p>\n\n\n\n<p>Also, the consumers have\nan option to directly reach out to&nbsp;<a href=\"https:\/\/corpbiz.io\/fssai-license\"><strong>FSSAI&nbsp;<\/strong><\/a>through an online platform called the Food Safety\nVoice. This platform provides the provisions for registering a complaint\nagainst adulterated, substandard or unsafe food products. You also can complain\nabout the poor labeling of the product or any misleading advertisement you came\nacross regarding the product.<\/p>\n\n\n\n<p>Also, the Government\nprovides you with another option to file your complaint against adulterated\nfood, namely, the&nbsp;<strong>Food Connect Application<\/strong>. You can download\nthe&nbsp;<strong>Food Connect Application<\/strong>&nbsp;application from the Google play\nstore or Apple store based on the type of Operating System you are using.<\/p>\n\n\n\n<p><strong>Furthermore, follow the given procedure to file your complaint on the Food Connect Application:<\/strong><\/p>\n\n\n\n<ul>\n<li>Open the Food Connect Application<\/li>\n\n\n\n<li>Select the right category from the given option namely; Packaged food or Premises<\/li>\n\n\n\n<li>Specify the kind of issue you faced or are facing<\/li>\n\n\n\n<li>Describe the problem with relevant pictures<\/li>\n\n\n\n<li>Submit your complaint<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Documents_required_to_be_submitted\"><\/span>Documents\nrequired to be submitted<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\ncomplainant must submit the following\ndocuments:<\/p>\n\n\n\n<ul>\n<li>The complete details and Address of the place from where the food\nproduct is purchased (name of shop, name of the food and the exact locality).<\/li>\n\n\n\n<li>Pictures of the defect in the adulterated food product <\/li>\n\n\n\n<li>The medical reports that confirm that such an ingredient of the food\nproduct has certain health risks and detrimental for human consumption (in\ncases of adulteration of food product).<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Filing_a_Complaint_against_Misleading_Advertisements\"><\/span>Filing a Complaint against Misleading Advertisements<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Moreover, you can also\nregister a complaint against any misleading ads. To do so, you need to take the\nfollowing steps;<\/p>\n\n\n\n<ul>\n<li>Visit the official website of the Advertising standards council of India<\/li>\n\n\n\n<li>Go to \u201c<strong>Lodge your complaint<\/strong>\u201d menu<\/li>\n\n\n\n<li>You will be redirected to the ASIC: Consumer online complaint form page<\/li>\n\n\n\n<li>Fill your personal details and the description of the complaint you are making<\/li>\n\n\n\n<li>Attach a video, link or image of advertisement if you have any<\/li>\n\n\n\n<li>Enter the Captcha code<\/li>\n\n\n\n<li>Then click on \u201csubmit your complaint.\u201d<\/li>\n<\/ul>\n\n\n\n<p><strong>Landmark Judgments<\/strong>:<\/p>\n\n\n\n<p>1.&nbsp; In the\ncase of <strong>Nestle India Ltd. v FSSAI<\/strong> ,\nthe food safety regulator held and directed the Nestle India to immediately\nwithdraw all the nine variants of Maggie noodles from the market as it was\nproved to be \u201cunsafe, unfit and hazardous \u201d for the consumption of public\nbecause of the high level of monosodium glutamate in its taste maker.&nbsp;<\/p>\n\n\n\n<p>2. In the case of <strong>United Distributors v UOI<\/strong>, the Delhi high court approved for the selling of an assortment of the Guliyan Belgian chocolates subsequent to when the petitioner (importer) rectified the labelling defects according to the FSSAI guidelines.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Penalties_imposed_on_defaulters_of_food_adulteration\"><\/span>Penalties imposed on defaulters of food adulteration<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>As per the Sections 51-\n64 of Food Safety and Standards Act, 2006, the following punishments are imposed\nupon the people who perpetrate acts that result in food adulteration:&nbsp;<\/p>\n\n\n\n<ol>\n<li>Any person who sells any\nmaterial which is not as per the consumer\u2019s demand is liable to pay a maximum\nfine of Rs. 5 lakh when finding guilty<\/li>\n\n\n\n<li>Anyone who manufactures\nsells, stores, distributes or imports any sub-standard food item; any food item\nwhich contains decayed matter, any article stored in unhygienic conditions is\nliable to pay the penalty<\/li>\n\n\n\n<li>Anyone who stores,\nmanufactures, distributes or imports any misbranded food-based product, is\nliable for a fine up to Rs. 3 lakh<\/li>\n\n\n\n<li>Any person who publishes\na misguided advertisement or falsely representing the quality of the food or\nprovides false guarantees to consumers might have to pay a fine up to Rs. 10\nlakh<\/li>\n\n\n\n<li>If anyone distributes a\nproduct containing a non-severe adulterant, they may be fined up to Rs. 1 lakh,\nbut if the adulterant is harmful to health, the fine may be extended to Rs. 10\nlakh<\/li>\n\n\n\n<li>Any person who violates\nany regulation specified in the Act may be asked to pay a fine up to Rs. 2 lakh<\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Food adulteration is a significant cause of death in India.
