Even if PSARA is centrally controlled by the Ministry of Home Affairs, still the Authority to issue the license is vested with State Government. PSARA License is issued to operate in more than one district of the states. offense in relation to the promotion or formation of a company.<\/li>\n\n\n\n<li>Convicted\nby the court for any offense, for which imprisonment is of not less than two\nyears.<\/li>\n\n\n\n<li>Keeping\nlinks with any organization or association which is banned under any law for\ntheir unlawful activities or pose a threat to national security or public order.\nAlso, if there is information about such a person indulging in activities that\nare prejudicial to national security or public order must be ban. <\/li>\n\n\n\n<li>Dismissed\nor removed from the Government service on the grounds of misconduct or moral\nturpitude.<\/li>\n\n\n\n<li>A\ncompany or firm or association of persons must not be considered for issuance\nof a license under this Act if they are not registered in India or having a\nmajority of proprietor, shareholder, partner, or a director is not a citizen of\nIndia.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Eligibility_to_be_a_Private_Security_Guard_under_PSARA_Act\"><\/span>Eligibility to be a Private Security Guard under PSARA Act<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>A private\nsecurity agency must employ or engage any person as a private security guard if\nhe has fallen under the following conditions\u2014<\/em><\/strong><\/p>\n\n\n\n<ul>\n<li>He\nmust be a citizen of India or such citizen of another country as the Central\nGovernment may specify by making a notification in the Official Gazette.<\/li>\n\n\n\n<li>If\nhe must have attained the age of eighteen (18) years but has not been more than\nof sixty-five (65) years in age<\/li>\n\n\n\n<li>He\nrequires to satisfies the agency about his character and antecedents in such\nmanner as may be required.<\/li>\n\n\n\n<li>He\nhas to complete the prescribed security training successfully. <\/li>\n\n\n\n<li>He\nmust fulfill such physical standards as may be specified.<\/li>\n\n\n\n<li>He\nhas to satisfy other such required conditions as may be provided by the Act.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"When_is_a_Security_Guard_not_eligible\"><\/span>When is a Security\nGuard not eligible?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>The person who\nis not eligible as a security guard under the Act is:<\/em><\/strong><\/p>\n\n\n\n<ul>\n<li>One\nwho has been convicted by a competent court or<\/li>\n\n\n\n<li>One\nwho has been dismissed or removed on the grounds of misconduct or<\/li>\n\n\n\n<li>If\nhe had moral turpitude while serving in any of the armed forces of the Union,\nState Police Organisations, Central or State Governments or <\/li>\n\n\n\n<li>If\nin any other private security agency must have employed or engaged as a private\nsecurity guard or a supervisor.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Preference_to_a_person_as_a_Security_Guard\"><\/span>Preference to a\nperson as a Security Guard<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Every private security agency may, while employing a person as a private security guard, give preference to a person who has served as a member in one or more of the following, namely:\u2014<\/p>\n\n\n\n<ul>\n<li>Army<\/li>\n\n\n\n<li>Navy<\/li>\n\n\n\n<li>Air\nForce<\/li>\n\n\n\n<li>other\narmed forces of the Union<\/li>\n\n\n\n<li>Police,\nincluding armed constabularies of States<\/li>\n\n\n\n<li>Home\nGuards<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"State_Government\"><\/span>State Government<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Each State Governments has an official ranked above, or the same as Joint Secretary must be appointed as the Controlling Authority (CA) for the state. The Controlling Authority has the right to issue, regulate, renew or cancel licenses of the security agencies. <\/p>\n\n\n\n<p>A private agency, therefore, requires permission from the Authority to function and provide security in the respective state. Also, the Act provides power to the State Government to bring into action rules governing the provisions of the Act.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Eligibility_for_CompaniesAssociationIndividual\"><\/span>Eligibility for\nCompanies\/Association\/Individual<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul>\n<li>Only\na company or an agency or an association of Indian origin can have a license.\nThe majority of shareholders must be an Indian.<\/li>\n\n\n\n<li>The\ncompany must have a clear record and must not be involved in any unlawful\nactivities or acts prohibited by the law. However, some of the States have accepted the Online Procedure, whereas some States are still in the process of acceptance.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Major_Amendments_in_2019\"><\/span>Major Amendments in\n2019 <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul>\n<li>The\nPrivate Security Agency Licensing Portal has been launched, thus now there will\nbe no need for manual police verification of details of\nDirectors\/Partners\/Proprietor at the time of applying for a grant of license\nfor a private security agency.<\/li>\n\n\n\n<li>Controlling\nAuthority must utilize electronic databases of crime &amp; criminals like\nCCTNS, ICJS, and similar facilities for verification of antecedents of the\napplicant.<\/li>\n\n\n\n<li>For\npayment of fees for license, electronic methods like Demand Draft or banker&#8217;s\ncheque will be accepted.<\/li>\n\n\n\n<li>Centre\nhas made (NSQF) National Skill Qualification Framework mandatory from 27th\nDecember.<\/li>\n\n\n\n<li>Based\non the complete training and requirement of the job, Private Security agencies\nwill allow their own designations under the rules subject to the condition that\nno agency shall adopt any of the ranks of the armed forces, paramilitary\nforces, or state police forces.<\/li>\n\n\n\n<li>Character\n&amp; Antecedent Certificate, if once issued, will be valid for three years\nirrespective of change in employment status.<\/li>\n\n\n\n<li>The\nControlling Authority, either by itself or by its officer, must verify the\npremises of the private security agency address as given by the agency.<\/li>\n\n\n\n<li>The\nControlling Authority must have the physical copy of the license to be\ndelivered by post within 15 days of issue to the registered office of the\nprivate security agency. The private security agency must be bound to display\nat its place of business.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Requirement_of_PSARA_license\"><\/span>Requirement of PSARA license<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul>\n<li><strong>Eligibility<\/strong><\/li>\n<\/ul>\n\n\n\n<p>Any Indian Company or the Firm or Association of Persons is qualified to get a Private Security Agency permit.
