The Report was on the \u2018Revision of the Patents Law\u2019 and\ngoverned the Patent framework of the country. Particularly, the <strong><em>Patent\nAct, 1970<\/em><\/strong>, allows Patentees to cover modifications or improvements in\nthe invention of the main Patent by requesting the grant of a Patent of Addition\nto them. The Patentee is required to pay no renewal fees for such Addition Patents. The advantages related to the Addition Patent are supported by the circumstance that the term of Addition Patent cannot surpass the main Patent which are availed after due process of <a href=\"https:\/\/corpbiz.io\/patent-registration\"><strong>Patent Registration<\/strong><\/a>.<\/p>\n\n\n\n<p>An Addition\nPatent allows the applicant of Patent to apply for any modifications or\nimprovements made on the invention which was disclosed in the complete\nspecification of the main Patent. The modification or the improvement in the\nPatent should be something more than a simple workshop improvement in the\noriginal Patent. The term for the parent or main Patent should not be exceeded\nby the term of the Addition Patent. The grant of Addition Patent should not be\ndone prior to the date of the main invention Patent. An application of Addition\nPatent cannot be questioned on the ground that the invention of inventor ought\nto have been the focus of an independent Patent.<\/p>\n\n\n\n<p>On the existing knowledge\nand with recent technological changes when an innovation is built, then the\ninnovation has a higher competence with the already existing products in the\nmarket. The conversion of any Addition Patent can be done into a standard\nPatent if the modification, variation, or improvement in the invention is\ninventive in its own right. In countries like India, Australia, New Zealand, the\nprovision of Addition Patent in the respective Patent Laws of the countries is in\nconformity with the (CIP) Continuous-in-part application provided under the\nAmerican Patent System.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_are_the_characteristics_of_Patent_of_Addition_in_India\"><\/span>What are the characteristics of Patent of Addition in India?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>Sections 54, 55 and 56 of the Patent Act, 1970, provides for the provisions related to Patent of Addition in India. The characteristics of the Addition Patent are as follows:<\/em><\/strong><\/p>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" width=\"576\" height=\"336\" src=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/04\/image-104.png\" alt=\"characteristics of Patent of Addition in India\" class=\"wp-image-7568\" srcset=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/04\/image-104.png 576w, https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/04\/image-104-300x175.png 300w\" sizes=\"(max-width: 576px) 100vw, 576px\" \/><\/figure>\n\n\n\n<ul>\n<li>The Addition Patent is\nan application made for any improvement or modification done in the invention\nwhich was described and disclosed in the main application of Patent by the\nPatentee;<\/li>\n\n\n\n<li>The applicant of the\napplication of Addition Patent should be the same as that of the main\ninvention;<\/li>\n\n\n\n<li>The main application of\nthe Patent should be already applied by the Patentee, or the has already been\nobtained by the Patentee;<\/li>\n\n\n\n<li>As per the provisions\nof the <strong><em>Patent Act, 1970<\/em><\/strong>, if the Addition Patent includes any new\nor additional applicant, the application of Addition Patent may not be pursued\nby the Indian Patent Office;<\/li>\n\n\n\n<li>The date of the\napplication for Addition Patent should be the same date or any date after the\nfiling of the main application of Patent;<\/li>\n\n\n\n<li>The application for\nAddition Patent can also be filed after the grant of the application of the\nmain Patent;<\/li>\n\n\n\n<li>The modification or\nimprovement over the application of the main Patent, is an issue of an\nindependent Patent, the Controller in this case, on Patentee&#8217;s request can\nrevoke the independent Patent and grant the same as an Addition Patent. The\nPatentee for both the inventions should be the same in the above case;<\/li>\n\n\n\n<li>The application of\nAddition Patent should include a reference to the main Patent as <strong><em>per Rule\n13(3) of the Patent Rules, 2003<\/em><\/strong>;<\/li>\n\n\n\n<li>There should be a\ndefinitive statement about the improvement or modification of the invention\nbeing an improved and modifies version of the already existing main Patent;<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_is_the_Term_and_Renewal_Fee_of_a_Patent_of_Addition\"><\/span>What\nis the Term and Renewal Fee of a Patent of Addition?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The Patent of\nAddition is granted for a term equal to that of the invention of the main\nPatent as per<strong><em> Section 55 of the Patent Act, 1970.<\/em><\/strong> Further, the\nterm of the main Patent should not have expired. In a case, if the application\nof the main Patent is revoked by the Controller or the court, the Patentee by\nmaking a request to the Controller or the court can have the Addition Patent to\nbe registered as an independent Patent for the term which is remaining. The request\nshould be made by the Patentee for the same in the manner prescribed by the\nprovisions of the <strong><em>Patent Act, 1970<\/em><\/strong>. Such an independent Patent\nwill continue in force as an independent Patent for the time left.<\/p>\n\n\n\n<p>There is no\nrequirement of paying any renewable fees in respect of filing of an Addition\nPatent. However, when such an Addition Patent changes into an independent\nPatent on the request made by the Patentee, the same fee is required to be paid\nby the Patentee, upon the same dates as prescribed.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_is_the_Novelty_and_Grounds_for_Revocation_of_a_Patent_of_Addition_in_India\"><\/span>What\nis the Novelty and Grounds for Revocation of a Patent of Addition in India? <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The grant of\nAddition Patent cannot be refused by the Controller or court or any other\nperson; hence, the revocation is also not possible under the provisions as\nprescribed under <strong><em>Section 56 of the Patent Act, 1970<\/em><\/strong>. The novelty\nof the Addition Patent cannot be challenged on the ground that the subject\nmatter of the invention is already a subject of an independent Patent already\nregistered with the Indian Patent Office.<\/p>\n\n\n\n<p><strong><em>The\ngrounds for Revocation of Addition Patent are as follows:<\/em><\/strong><\/p>\n\n\n\n<ul>\n<li>Lack of an inventive\nstep;<\/li>\n\n\n\n<li>The usage of the main\ninvention is already described in the complete specification of the Patent;<\/li>\n\n\n\n<li>The usage of the\nmodification or improvement is already described in the complete specification\nof the main Patent application of the invention;<\/li>\n<\/ul>\n\n\n\n<p>In case of <strong><em>Ravi\nKamal Bali v. Kala Tech and Ors.<\/em><\/strong> {Bombay High Court (HC), Order dated\n12<sup>th<\/sup> Feb 2008} the High Court of Bombay dismissed the argument of\nthe defendant that the Addition Patent can only be granted if there is an\ninventive step over the application of the main Patent.<\/p>\n\n\n\n<p><strong><em>The Patent Act, 1970, under Section 56(2),<\/em><\/strong> elucidates that the disclosure in the application of the main Patent, should be considered in determining the novelty or validity of the Addition Patent.<\/p>\n\n\n\n<p class=\"text-left\"><b>Read our article<\/b>:<mark style=\"background: #fffd03 !important;\"><a href=\"https:\/\/corpbiz.io\/learning\/revocation-of-patent-in-india\/\">Revocation of Patent in India: A Complete Overview\n<\/a><\/mark><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_are_the_conditions_for_filing_Patent_of_Addition_in_India\"><\/span>What\nare the conditions for filing Patent of Addition in India? <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>The\nPatents Act, 1970,<\/em><\/strong> provides for\nprovisions concerning the filing and granting of a special kind of application\nof Patent, i.e., &#8216;Patent of Addition&#8217; in India. The Patentee or the applicant, if\nso desires, he\/she can file a separate application for Patent in the manner\nprescribed for any improvement, variation, or modification for the invention in\nrespect of which he\/she has already filed or holds a Patent which has been granted\nby the Indian Patent Office.<\/p>\n\n\n\n<p><strong><em>Section\n48 of the Patents Act, 1970,<\/em><\/strong> states that\nrights conferred by Addition Patent are the same as that of other Patents. In brief,\na Patent, as an Addition Patent can be protected regarding any improvement,\nvariation or modification in an earlier invention called the parent invention or\nmain invention for which a Patent application for the said invention has been\nmade and is pending or can be granted and is in force by the Indian Patent\nOffice. <\/p>\n\n\n\n<p><strong><em>The\nmain conditions for filling Patent of Addition application are stated below:<\/em><\/strong><strong><em><\/em><\/strong><\/p>\n\n\n\n<ul>\n<li>Unless the Controller\nof Patent is requested for the examination of the parent application of the\ninvention, the Addition Patent cannot be examined. Further, the application of\nthe Addition Patent will not be accepted by the Controller unless the main or\nparent application of Patent is accepted by the Indian Patent Office.<\/li>\n\n\n\n<li>The application of the\nAddition Patent should have the same applicant as that of the previous\napplication of the main invention. The inventors of the invention need not be\nthe same for both the inventions. Hence, it can be said that the Addition\nPatent can neither be a Patent of invention nor can have an invention as Parent\nPatent.<\/li>\n\n\n\n<li>The parent application\nof the Patent should be pending before the Controller of Patent, if the\nAddition Patent concerns an application of Patent. <\/li>\n\n\n\n<li>The Patent should be in\nforce, if the Addition Patent is in respect of an already existing Patent.&nbsp; &nbsp;<\/li>\n\n\n\n<li>The application of\nAddition Patent will not be granted or accepted, if the main Patent is\nterminated. Due to non-payment of the annuity of Parent Patent, the Addition\nPatent would be terminated by the Controller of Patent. &nbsp;&nbsp;<\/li>\n\n\n\n<li>With the termination of\nthe Parent Patent, the Addition Patent will also terminate, otherwise the\nAddition Patent will run parallel to the Parent Patent.<\/li>\n\n\n\n<li>As per <strong><em>Section 54\nand 55 of the Patent Act, 1970,<\/em><\/strong> every Addition Patent is an independent\nPatent. <strong><em>Thus, each Addition Patent has the following<\/em><\/strong>:<\/li>\n<\/ul>\n\n\n\n<ol>\n<li>Render\na fresh application number;<\/li>\n\n\n\n<li>requirement\nof filing a separate examination request;&nbsp;\n<\/li>\n\n\n\n<li>the\npublication should be after 18 months; and<\/li>\n\n\n\n<li>undergoes\na separate examination. <\/li>\n<\/ol>\n\n\n\n<ul>\n<li>The filing of application date should be the same or a later date than that of the parent or main application of the Patent. <\/li>\n\n\n\n<li>Each Addition Patent should include a reference to the parent or main application of the Patent.<\/li>\n\n\n\n<li>Each Addition Patent should also include a conclusive statement that the invention of the inventor is a modification or variation or improvement of the invention, which is already claimed in the complete specifications of the parent or main application of Patent.<\/li>\n\n\n\n<li>The main point to be determined is that the subject matter of the Addition Patent should constitute a single invention and should not relate to two distinct inventions.<\/li>\n\n\n\n<li>The main invention should be specifying the novelty of the invention, or the Controller can cite the parent or main application the reason for rejection of Addition Patent on lack of novelty as per <em>Section 56 of the Patent Act, 1970<\/em>.<\/li>\n\n\n\n<li>No right of rejection is given to the Examiner to reject the Addition Patent application on the ground of lack of inventive step in the invention as per <strong><em>Section 56 of the Patent Act, 1970.<\/em><\/strong><\/li>\n\n\n\n<li>No renewal fee is required to be paid by the Patentee for Addition Patent.  <\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Can_a_Patent_of_Application_be_subject_matter_of_PCT_application\"><\/span>Can\na Patent of Application be subject matter of PCT application?&nbsp; <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The Patent of Addition\ncan be a subject matter of an application of PCT. <strong><em>Article 2 of the Patent\nCo-operation Treaty<\/em><\/strong> (PCT), defines a PCT application as an application\nfor the protection of an invention of the inventor.&nbsp; The different references to a PCT application\nshall be interpreted as references to applications for Patents for inventions, certificate\nof inventors, utility certificates, models of utility, inventor Certificate of\nAddition, Patent or Certificate of Addition, and Utility Certificate of Addition.\nOn the other hand, the different references to a \u2018Patent\u2019 shall be interpreted as\nreferences to Patent for new inventions, Certificate of inventors, Utility Certificate,\nModels of utility, Patent or Certificates of Addition, inventors&#8217; Certificate\nof Addition, and utility Certificates of Addition.<\/p>\n\n\n\n<p>The above\ndefinition of Patent and application elucidates that an Addition Patent can be\nthe subject matter of an application of PCT. When the Addition Patent\napplication is filed, the complete specification of the Addition Patent\napplication should have an explicit reference to the Patent number of parent or\nmain Patent, the application number of parent or main Patent, and to the\ninvention which is modified or improved.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_is_the_scope_of_Patent_of_Addition_in_other_countries_of_the_world\"><\/span>What\nis the scope of Patent of Addition in other countries of the world?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The concept of\ngranting Patent of Addition for any improvements or modifications over the main\ninvention, have been removed by several countries. However, some countries,\nincluding India, U.S., and Australia, are still in continuance with the\npractice. The U.S. CIP (Continuation in Part) application is like the Indian Patent\nof Addition concept. <\/p>\n\n\n\n<p>The developments\nor changes can be done on an existing application of Patent while the\napplication of Patent is still waiting for a grant from the Patent Office. In\nan application for CIP, claims may have variable priority dates, which are based\nupon the priority date of the first application in which the subject matter of\nthe invention is disclosed. However, the Patent shall expire 20 years from the date\nof filing of initial application form, which advantage is claimed by the\ninventor, similar to an Addition Patent.&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>In order to\nprotect a new modification or development in the invention, Patent of Addition\nis an additional benefit to the applicant. While working on Patent, if the\ninventor comes across some new inventions or modifications or improvements in\nthe invention, then the same can be claimed, and rights can also be acquired\nover them by filing of Addition Patent in India. Though, in the Addition Patent,\nthe subject matter must disclose over and above parent Patent application or\nthe main application and should not merely claim over the similar specification\nas of parent application of the Patent. Simply claiming in Addition Patent over\nPatent application from different characteristics does not accomplish the\npurpose of Section 54 of Patent Act, 1970. <\/p>\n\n\n\n<p>Hence, the claims of the inventor if they do not appropriately cover the invention, the same cannot be modified by filing an Addition Patent.
