The owner of Brand looks for remedies to protect the Brand whenever the brand value is used without the prior approval of the owner. The stoppage of non-permitted use of trademark is equally significant as <a href=\"https:\/\/corpbiz.io\/trademark-registration\"><strong><em>Trademark Registration<\/em><\/strong><\/a>. Hence, the Trademark Act, 1999, is introduced for the protection of Trade names. <\/p>\n\n\n\n<p><strong><em>The Trademark Act, 1999, aims to provide an exclusive right for the use of the brand name by the brand owner and also stops the unauthorized use of the brand name by any other users or competitors<\/em><\/strong>. Therefore, for the protection of the brand name and the value created, the brand logo and name are registered under the Trademark Act, 1999. In case there is deceptive usage of the brand name or logo, the Act also provides for remedies to the brand owner to sue the person using the brand name. The unauthorized usage of a brand mark is termed as Trademark Infringement. The Act provides remedies for Trademark Infringement. The Trademarks\nwhich are registered are designated with \u00ae symbol. &nbsp;<\/p>\n\n\n\n<p><strong><em>The\nneed of Trademarks to represent goods and services can be considered a\nthree-prong approach by:<\/em><\/strong><\/p>\n\n\n\n<ul>\n<li>Helping the consumers\nto recognize the source<\/li>\n\n\n\n<li>Helping the consumers\nto determine the quality <\/li>\n\n\n\n<li>Helping consumers to\nmake the right purchasing decision.<\/li>\n<\/ul>\n\n\n\n<p>It is very\nimperative to protect the misuses and Infringement of Trademark if any of the\nvalues are added to the trademark of products or services. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_is_Trademark_Infringement\"><\/span>What\nis Trademark Infringement?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The Trademarks are protected under the Trademarks Act, 1999. The Trademark Act, 1999, provides for the provisions dealing with protection, Registration, and penalties for Infringement regarding the Trademarks in India. The Trademarks across the globe are given the status of intellectual property. Many organizations, both international and national, are working for the protection of Intellectual Properties like Trademarks. The Indian Patent Office is the organization in India which is working for the protection of Trademarks. The <a href=\"https:\/\/corpbiz.io\/learning\/general-powers-of-controller-of-patent-in-india\/\"><strong>Controller General of Patent<\/strong><\/a>, Design, and Trademarks is the administrator of the Indian Patent Office in India.<\/p>\n\n\n\n<p>In simple words, Trademark Infringement is unauthorized use of a mark by an unauthorized person, which is identical or deceptively similar to an already registered Trademark. The term deceptively similar means that when a common consumer looks at the mark, it will be confusing the consumer with the other registered trademark. Hence, this confusion will affect the registered Trademark product and services.&nbsp;&nbsp; <\/p>\n\n\n\n<p><strong><em>The\nprovisions related to Trademark Infringement mainly focus upon three main\nobjectives of any person who is using the registered trademark but is not the\nregistered user of the trademark. The three main objectives are as follows:<\/em><\/strong><\/p>\n\n\n\n<ul>\n<li>Damaging the reputation\nand uniqueness of registered trademark,<\/li>\n\n\n\n<li>The intention of usage\nof trademark, despite having the knowledge of such usage is unlawful, or<\/li>\n\n\n\n<li>Having a dishonest\nintention of taking undue advantage.<\/li>\n<\/ul>\n\n\n\n<p>Furthermore, Trademark\ninfringement can also be caused by an advertisement. The advertisement should\ntake unfair advantage of the registered trademark and also damages the\nreputation and uniqueness of the registered trademark. If the visual\nrepresentation and spoken use of certain words affect the uniqueness of a\nregistered Trademark, then it will amount to Trademark Infringement.<\/p>\n\n\n\n<p>In light of advertisement, multiple courts have elaborated on what can constitute Infringement of Trademark. <strong><em>In the case of Reckitt India Limited vs. Hindustan Unilever Limited, the defendant company has portrayed the Dettol Soap (product of appellant) as ordinary soap in the advertisement of their product Lifebuoy soap.<\/em><\/strong> The ordinary soap in the advertisement allows the germs to enter the skin through cracks of the skin. The appellant company claimed that such advertisement is causing huge damage to the goodwill and reputation of their Company product. The appellant contended that the common consumers would recognize the familiar characteristics of Dettol soap even if the logo of Dettol soap is not shown in the advertisement. There\nare some elements that should be met before any direct breach to occur. The\nelements are as follows:&nbsp; <\/em><\/strong><\/p>\n\n\n\n<p><strong>Usage\nby an Unauthorized Person <\/strong><\/p>\n\n\n\n<ul>\n<li><strong><em>The violation of a\nregistered Trademark only happens when the use of a Trademark is done by a\nperson who is not authorized by the holder of a registered Trademark<\/em><\/strong>.\nHence, the use of the trademark by a person who is authorized by the holder of\nthe registered trademark will not amount to Trademark Infringement. <\/li>\n<\/ul>\n\n\n\n<p><strong>Identical\nor Deceptively Similar<\/strong><\/p>\n\n\n\n<ul>\n<li><strong><em>The trademark being\nused by the unauthorized person should be either deceptively similar or\nidentical to the registered trademark of the original holder. <\/em><\/strong>The\nmeaning of term Deceptively Similar is that the common consumer \u2018may\u2019 get\nconfused between two similar Trademarks and \u2018may\u2019 think that both the Trademarks\nare same. The word \u2018may\u2019 signify that it is only required to prove that there\nis a possibility of such kind of confusion and hence no need to prove the\nactual happening of such confusion. A mere chance of misrecognition of the Trademarks\nis enough to prove that there has been Trademark Infringement of a product or\nservices of a registered Trademark. &nbsp;&nbsp;&nbsp;<\/li>\n<\/ul>\n\n\n\n<p><strong>Registered\nTrademark<\/strong><\/p>\n\n\n\n<ul>\n<li><strong><em>The Trademark Act,\n1999, provides remedies to the Trademarks which are registered with the Trademark\nRegistry. In case of Infringement of an unregistered Trademark, the Act will\nnot apply.<\/em><\/strong> The common law of passing off is\nused in cases of unregistered Trademarks. Passing off is a tort law which is\nused where damage or injury is caused to the goodwill associated with the\nactivities of other persons or group of persons.&nbsp; <\/li>\n<\/ul>\n\n\n\n<p><strong>Goods\nor Services Class<\/strong><\/p>\n\n\n\n<ul>\n<li><strong><em>The unauthorized person\nshould use the trademark for the propagation of goods and services which fall\nunder the same category or class of products or services under which the\noriginal trademark is registered.<\/em><\/strong>\nIn such case, only it will be considered as Trademark Infringement of\nregistered Trademark. &nbsp;&nbsp;<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Indirect\nInfringement<\/h3>\n\n\n\n<p><strong><em>In the <\/em><\/strong><em><strong>Trademark Act, 1999<\/strong><\/em><strong><em>, there are no provisions which deal with indirect Infringement particularly<\/em><\/strong>. Hence, it cannot be said that there is no liability for Indirect Infringement. <strong><em>The Universal Principle of Law provides for the principle and application of Indirect Infringement. <\/em><\/strong>These principles hold not only accountable the principle infringer but also hold accountable the person who induces or abets the principal infringer for Infringement.<\/p>\n\n\n\n<p><strong><em>The different types of Indirect Infringement are as follows:<\/em><\/strong><\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter\"><img decoding=\"async\" width=\"576\" height=\"336\" src=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/04\/image-72.png\" alt=\"types of Indirect Infringement \" class=\"wp-image-7079\" srcset=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/04\/image-72.png 576w, https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/04\/image-72-300x175.png 300w\" sizes=\"(max-width: 576px) 100vw, 576px\" \/><\/figure><\/div>\n\n\n<p><strong>Vicarious\nLiability<\/strong><\/p>\n\n\n\n<ul>\n<li><strong><em>As per Section 114 of Trademark\nAct, 1999, any company committing an offense under this Act will be liable.<\/em><\/strong>\nThe Company will be liable as a whole, and this means that all the person will\nbe liable for the offense. Hence, it can be said that not only the principal\ninfringer but every person of the Company will be liable for indirect\nInfringement. An exception from Vicarious Liability is given to the person who\nacted in good faith and without any knowledge of Infringement. <\/li>\n<\/ul>\n\n\n\n<ul>\n<li><strong><em>The essential elements of Vicarious Liability are as follows:<\/em><\/strong><\/li>\n<\/ul>\n\n\n\n<ol>\n<li>When\nthe person is controlling the activities of the principle infringer<\/li>\n\n\n\n<li>When\nthe person had knowledge about the Infringement and still contributed to such\nInfringement<\/li>\n\n\n\n<li>When\nthe person is deriving financial benefits from Infringement<\/li>\n<\/ol>\n\n\n\n<ul>\n<li>The only <strong><em>exception\nto Vicarious Liability<\/em><\/strong> for the Company who is liable for Infringement\nis when the Company can prove that the Company has acted in good faith and had\nno idea or knowledge about the Infringement.<\/li>\n<\/ul>\n\n\n\n<p><strong>Contributory\nInfringement<\/strong><\/p>\n\n\n\n<ul>\n<li><strong><em>The essential elements\nof Contributory Infringement are as follows:<\/em><\/strong><\/li>\n<\/ul>\n\n\n\n<ol>\n<li>When the person knew about the Infringement<\/li>\n\n\n\n<li>When the person Materially contributed to direct Infringement<\/li>\n\n\n\n<li>When the person induced the principle infringer for committing Infringement<\/li>\n<\/ol>\n\n\n\n<ul>\n<li>There <strong><em>is no exception available<\/em><\/strong> in case of Contributory Infringement as there is no chance of the contributory infringer to act in good faith. <\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"When_will_it_not_be_considered_a_Trademark_Infringement\"><\/span>When\nwill it not be considered a Trademark Infringement? <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>Under the Trademarks Act, 1999, Section 30 lays down certain conditions\nwhen it is considered that there is no Infringement of Trademark. The\nconditions prescribed under Section 30 can be used as a defense by the alleged\ninfringer.
