It is responsible for the safety and quality control of medicines, medical devices, and diagnostic products. Proper risk classification is crucial with India’s medical device sector evolving rapidly. It determines the risk of a device and the required control.

According to the Medical Devices Rules, 2017, CDSCO has classified medical devices into four classes based on risk: Class A, B, C, and D. Out of these, Class A devices are considered “low-risk” while Class D is considered “high-risk.” CDSCO registration is of utmost importance in the current scenario to stay compliant.

Class A devices are generally noninvasive or do not enter the body, so the risks from them are relatively low. Class B, C, and D devices are subject to a relatively high level of regulation and licensing. Each device must be consistent with the CDSCO list. It will not be included in this class if the use of any device does not match with the intended purpose mentioned in the list.

Secondly, if a device is supplied in a sterile condition or has a measuring function, it will not be considered Class-A, and a separate license will be required.

Also, all manufacturers need to maintain a Quality Management System (QMS) for quality control. This ensures the quality, safety, and regulatory compliance of the production. These conditions help maintain transparency and safety in the medical device market in India.

Benefits and Impact of the New Classification List

Given below are the benefits and impact of the new classification list-

It simplifies the licensing process by reducing the time and cost for manufacturers and importers.

Brings safety in healthcare by controlling the registration system. Manufacturers of such devices will be exempted from certain licensing requirements, but registration on the CDSCO online portal is mandatory. This has simplified the regulatory process and made product marketing faster.

What are the regulatory obligations for a device classified as Class-A (non-sterile & non-measuring)?

Devices in this class are exempt from licensing under certain chapters (IV, V, VII, VIII, XI). However, online registration with CDSCO is mandatory as per Chapter IIIB. In addition, manufacturers and importers will have to follow the general rules of labeling, quality control, safety, and post-market surveillance.

What happens if my device is similar to one on the list but is sterile or has a measuring function?

If your device is sterile or has a measuring function, it will not fall under the Class-A list. Rather, it may fall under the higher risk category: Class B, C or D. It will be mandatory to follow the applicable licensing, strict supervision, and additional approval process.

Will the risk classification list remain fixed or can it change in future?

No, CDSCO has stated that this list is a dynamic document and may be updated from time to time. Therefore, manufacturers and importers should regularly monitor the list and ensure that their products are still in the non-sterile and non-measuring categories. Ignoring changes to the list may lead to compliance issues.

How does this development contribute to India’s medical device industry and ease of doing business?

CDSCO has reduced regulatory burden by exempting low-risk devices from licensing. This has enabled manufacturers to bring products to market faster and at a lower cost. This move is the “Make in India” initiative, and making India’s medical device sector more competitive and transparent.

What key steps should a manufacturer/importer take now in response to this list?

First, verify whether your product is on the list. Ensure that it is non-sterile and non-measuring. Then register it in the CDSCO online system. Keep all documents, labeling, and intended use correct. Keep an eye on future changes and maintain records. Seek the help of regulatory consultants if necessary.

Does being listed in Class A eliminate all regulatory risks?

The Class-A list eases some of the conditions but does not completely remove regulatory responsibilities. You will need to register with CDSCO, maintain safety standards, ensure post-market surveillance and correct classification. Misclassification or irregularity can create legal complications.

What should buyers or healthcare providers check when procuring a Class-A device?

The product needs a valid CDSCO registration number before purchasing. Check that the labeling and purpose match the CDSCO list. Verify whether any measuring or sterile features have been added to the product. Obtain a declaration of compliance as per the Medical Device Rules, 2017 from the manufacturer or importer.

How can Corpbiz support companies making use of the Class-A list?

Corpbiz specializes in medical device regulatory services.
