The Trademark when gets registered entry for the same is done in the Registry of Trademark. <strong><em>The Trademark Register purity is the vital concern, and for this reason, the Indian Trademark Act, 1999, has a scrutiny procedure to check and ensure the purity of Register of Trademark.<\/em><\/strong> The scrutiny procedure is 3 tires as the purity of Register is utmost. The first scrutiny is conducted by the office of Trademark. The office checks for the Trademark database and check whether a similar or identical trademark is already registered with the Registry or not. In case there is a need to issue office actions, the office will issue the same. The Registration process of Trademark can only move ahead once the office action is overcome by filing a proper response to them. Once the Registrar of Trademark is satisfied with the response, then only the application is advertised in the Trademarks Journal. According to Section 21 of the Trademarks Act, 1999, &#8216;any person&#8217; can initiate Trademark Opposition proceedings against the Trademark. The Opposition of Trademark should be raised in the prescribed period only. The Opposition of Trademark is filed against the Registration of Trademark by a third party. The third stage of scrutiny is <a href=\"https:\/\/corpbiz.io\/trademark-rectification\"><strong><em>Trademark Rectification<\/em><\/strong><\/a>, which occurs only if the Trademark is already registered with the Registry.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/p>\n\n\n\n<p>The guidelines under which the third party can file the Opposition are prescribed under <strong><em>Trademark Rules, 2017<\/em><\/strong>. The primary motive to make an advertisement for the application of Registration is that the common public should get to know about the overall content of the application. If any person finds that his\/her Intellectual Property Rights are violated due to the privileges stated in the Registration application, he\/she can file for Opposition of Trademark for the violation in the stipulated time period. The Opposition should be filed within stipulated time period. Otherwise, if not filed in the time period, the opportunity to file an application for Opposition if lost forever. Once the deadline to file an application for Opposition of Trademark is over, and no Opposition is filed, the Registry can go further with the Registration of Trademark by providing Trademark Privileges to the applicant. \u00a0\u00a0\u00a0\u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Who_can_file_Trademark_Opposition\"><\/span>Who\ncan file Trademark Opposition?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>As\nper Section 21 of the Trademark Act, 1999,<\/em><\/strong>\n<strong><em>\u2018any person\u2019 can file for notice of Opposition for Trademark.<\/em><\/strong> The\nwords &#8220;any person&#8217; include companies, individuals, trusts, and partnership\nfirms. Furthermore, in the case of 2 or more persons have the same issues\nagainst the same Trademark, then all the persons can be joined together as\nopponents.&nbsp;&nbsp; <\/p>\n\n\n\n<p><strong><em>Ordinarily,\non the other hand, the application for Opposition of Trademark can be filed:<\/em><\/strong><\/p>\n\n\n\n<ul>\n<li>By the owner of an\nearlier registered Trademark or application associated with a similar Trademark\nfor similar goods.<\/li>\n\n\n\n<li>By any person who is\nusing the same or similar Trademark prior to the new applicant, but till now,\nRegistration of Trademark is not sought out by the Registry. {PRIOR USE} &nbsp;&nbsp;<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_is_the_time_limit_for_Filing_Trademark_Opposition\"><\/span>What\nis the time limit for Filing Trademark Opposition?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>The\ntime limit for filing of the application for Opposition of Trademark is 4\nmonths from the date of advertisement or re-advertisement of Registration\napplication of Trademark<\/em><\/strong>. Once the time period\nprescribed for filing of the Opposition of Trademark is finished, the person\nloses its chance to file for Opposition forever. &nbsp;&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_are_the_grounds_for_Trademark_Opposition\"><\/span>What\nare the grounds for Trademark Opposition?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>An\napplication pending for Trademark Registration can be opposed on the following\ngrounds:<\/em><\/strong><\/p>\n\n\n\n<ul>\n<li>The Trademark used is\nobscene, scandalous or immoral;<\/li>\n\n\n\n<li>The Trademark used is\nprevented by law or is contrary to law;<\/li>\n\n\n\n<li>The applicant used by\nthe Trademark only as a licensee of some other party;<\/li>\n\n\n\n<li>The Trademark used is\ndevoid of its distinctive character;<\/li>\n\n\n\n<li>The Trademark used is\nof descriptive nature;<\/li>\n\n\n\n<li>The Trademark\napplication was made in bad faith;\u2019<\/li>\n\n\n\n<li>The Trademark is likely\nto confuse and deceive the common public;<\/li>\n\n\n\n<li>The Trademark is\npriorly used, or another party uses a confusingly similar Trademark;<\/li>\n\n\n\n<li>The Trademark contains\nsuch matter which can hurt the religious feelings of any section or class of\npeople;<\/li>\n\n\n\n<li>The use of Trademark is\nprohibited under the Emblem and Names Act, 1950;<\/li>\n\n\n\n<li>The Trademark is\nsimilar to an already registered Trademark, an Olympic mark, Official Mark or a\ngeographical indication registered in India;<\/li>\n\n\n\n<li>&nbsp;The Trademark is merely a surname;<\/li>\n\n\n\n<li>The Trademark is a\ngeneric term for the associated services or wares;<\/li>\n\n\n\n<li>The Trademark used is\ncustomary in the current language or already established practices of business.\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_are_the_pre-requisites_for_Trademark_Opposition\"><\/span>What\nare the pre-requisites for Trademark Opposition?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>The pre-requisites depend on different grounds of the Oppositions. In addition to the\ndetails of the licensee, an indication which indicates that licensee is\nauthorized to enter the Opposition of Trademark.<\/li>\n\n\n\n<li>In the case where the\nopposing party is a foreigner, and having no place of business in India, then\nthe name of the opponents and the address for service in India is required.<\/li>\n\n\n\n<li>The Opposition of\nTrademark is based on an already existing well-known trademark or a Trademark\nhaving good reputation in the market; the opponent is required to submit any\ndocument which will act as an evidence of such already existing well-known\nTrademark. Further, the opponent should mention an indication of the countries\nwhere the earlier registered Trademark is recognized to be a well-known\nexisting Trademark. The opponent can also present the proof of the Registration\nof Trademark or application for Registration of Trademark.&nbsp; &nbsp;&nbsp;<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_are_the_contents_of_notice_for_Trademark_Opposition\"><\/span>What\nare the contents of notice for Trademark Opposition?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>&nbsp;<strong><em>As\nper Rule 43 of Trademark Rules, 2017, the notice of Opposition of Trademark\nshould contain the following:<\/em><\/strong><\/p>\n\n\n\n<ul>\n<li>The application number of the Trademark against which Opposition is filed;<\/li>\n\n\n\n<li>An indication of all the goods or services listed in the application of Trademark against which the notice for Opposition is filed;<\/li>\n\n\n\n<li>The name of the applicant for Trademark against whom Opposition is filed; <\/li>\n\n\n\n<li>A statement declaring that the Trademark against which Opposition is filed is a well-known Trademark within the Section 11(2) of the Trademark Act, 1999. The notice\nshould state all the details of the opposite parties and the grounds of filing\nthe Opposition of Trademark.&nbsp; The notice\nof Opposition first reaches the trademark registry, where the officials check\nthe notice application that whether all the requirements are fulfilled or not.\nOnce the officials are satisfied with all the requirements, the notice\napplication is sent to the applicant of Trademark. The applicant of Trademark,\nthen goes through all the issues raised and concerns of the opponents and\nprepare for the hearing in the court. The court hearing will take place in the\nsame place where initially the Opposition was filed by the opponent.<\/p>\n\n\n\n<p>The notice of\nOpposition of Trademark should be filed in the same office where the applicant\nfiles the original application for Trademark Registration. For example- The\nHead Office of Trademark Registry is at Mumbai, and the application for\nTrademark Registration is filed in Mumbai. So, the notice of Opposition of\nTrademark will be filed at Head Office in Mumbai. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Filing\nof Counter-Statement<\/h3>\n\n\n\n<p><strong><em>Rule\n44 of The Trademark Rules, 2017, states that after notice of Opposition is\nfiled, the applicant for Trademark Registration can file a counter statement<\/em><\/strong>.\n<strong><em>The counter-statement should be filed in form TM-O. <\/em><\/strong>The time\nperiod prescribed for filing of counter-statement is 2 months from the date of\nreceipt of the Opposition notice, and the time period of 2 months is not\nexpendable. The counter-statement files should comprise of the following: <\/p>\n\n\n\n<ul>\n<li>A paragraph wise\nencounter of every ground made in the Opposition notice by the opponent. <\/li>\n\n\n\n<li>Any fact alleged in the\nOpposition notice is admitted by the applicant, then that fact should be set\nout in the counter statement.<\/li>\n\n\n\n<li>The verification of the\ncounter-statement should be signed by the person making the counter statement\nand should state the place at which and date on which the statement is signed.<\/li>\n\n\n\n<li>The counter-statement\nshould be verified at the foot of the opponent or by his authorized agent. The\nagent should specifically state referring to the numbers of the paragraph of\nthe Opposition notice that what the agent verifies himself on his knowledge and\nwhat he verifies on an information believed and received to be true. &nbsp;<\/li>\n<\/ul>\n\n\n\n<p>The failure to file the counter statement by the applicant will make the application of <a href=\"https:\/\/corpbiz.io\/trademark-registration\"><strong><em>Trademark Registration<\/em><\/strong><\/a> abandoned and deserted, and the Registrar will take the Registration application down from the Trademark Journal. After taking down the application of Registration, the Registrar will not approve the application for the <strong><em>Register of Trademark<\/em><\/strong>. The applicant can also file the counter-statement on the basis of the electronic copy of the Opposition of Notice made available on the website of the Trademark Registry.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Production\nof Evidences<\/h3>\n\n\n\n<p><strong><em>The\ndifferent types of evidences which need to be filed by the opponent and\napplicant of the Trademark are as follows:<\/em><\/strong><\/p>\n\n\n\n<ul>\n<li><strong>Evidence in Support of\nOpposition<\/strong><\/li>\n<\/ul>\n\n\n\n<p><strong><em>Under\nRule 45 of the Trademark Rules, 2017,<\/em><\/strong>\nthe opponent has to provide for evidences in support of the Opposition in the\nform of an affidavit. The evidences in support of Opposition should be filed\nwithin 2 months from the date of receipt of the counter statement.&nbsp; <\/p>\n\n\n\n<p><strong><em>The\nopponent can also choose to waive the filing of an affidavit under Rule 45 of\nTrademark rules, 2017, if the opponent solely wants to rely on the facts which\nare stated in the Opposition notice.<\/em><\/strong>\nThe opponent has to inform the other party and officials of the Trademark\nRegistry of such waiver, otherwise the notice of Opposition will be treated as\nabandoned.&nbsp;&nbsp; <\/p>\n\n\n\n<ul>\n<li><strong>Evidence in Support of\nApplication <\/strong><\/li>\n<\/ul>\n\n\n\n<p>The applicant of\nthe Trademark Registration is required to provide for evidences in support of\nthe application for Registration of Trademark. <strong><em>The evidences in support\nof the application are files as per Rule 46 of the Trademark Rules, 2017.<\/em><\/strong>\nThe support evidences for application should be filed by the applicant within 2\nmonths of filing of receipt of the evidences\/intimation of waiver by the\nopponent.<\/p>\n\n\n\n<ul>\n<li><strong>Evidence in Reply<\/strong><\/li>\n<\/ul>\n\n\n\n<p><strong><em>The\nopponent again is given the option to present more evidences in support of his\nOpposition as per Rule 47 of Trademark Rules, 2017.<\/em><\/strong>\nThe presentation of such evidence should be done within 1 month of receipt of\nthe evidence under Rule 46 of Trademark Rules, 2017. To achieve some\nconclusiveness in the proceedings of Opposition and to rebut the produced\nevidences by the applicant and rest the case, this provision of reply is\nprovided.&nbsp; &nbsp;&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Hearing<\/h3>\n\n\n\n<p>After the\ncompletion of the evidence submission stage, the Registry of Trademark appoints\nfor a hearing, and the parties are notified about the same. The date of hearing\nshould be at least one month after the date of the first notice of hearing. The\nparties to the hearing are given an opportunity to notify the Registrar about\nthe intention of appearing in the hearing. <strong><em>The adjournment request can be\nmade under form TM-M. The adjournment request should be made at least 3 days\nbefore the date of hearing.
