Food\nBusiness Operators (FBO) for the lapsed financial year. <\/p>\n\n\n\n<p>Hence, it can be said that obtaining the Food License is not enough for\nthe Food Business Operator (FBO). It is equally essential to comply with FSSAI\ncompliances and file for the FSSAI Annual Return. On the other hand, <\/em><\/strong><em><a href=\"https:\/\/corpbiz.io\/fssai-state-license\"><strong>State FSSAI License<\/strong><\/a><\/em><strong><em> registration is done by Food Business Operator (FBO), who have a turnover range between 12 lakhs to 20 crore Rupees and <\/em><\/strong><em><a href=\"https:\/\/corpbiz.io\/central-fssai-license\"><strong>Central FSSAI License registration<\/strong><\/a><\/em><strong><em> is done when turnover is above 20 crore Rupees. <\/em><\/strong>Furthermore, any entity which is engaged in import or export business activity is also required to register for Central FSSAI License. &nbsp;&nbsp;<\/p>\n\n\n\n<p>The Licensing Authority issues a single <a href=\"https:\/\/corpbiz.io\/fssai-license\"><strong><em>FSSAI License<\/em><\/strong><\/a> for single premises. The storage, manufacture, and selling of food is done at different places then the Food Business Operator (FBO) is required to apply for a separate License for each premise. <strong><em>The FSSAI License is mandatory for the following individuals and entities as per the rules provided under the Food Safety and Standard Act, 2006:<\/em><\/strong><\/p>\n\n\n\n<ul><li>The\nFood Traders<\/li><li>The\nUnits for Food Packaging<\/li><li>The\nUnits for Food Storage<\/li><li>The\nCaterers or Hotels<\/li><li>The\nSuppliers of raw food<\/li><li>The\noperators of wholesale food business<\/li><li>The\nretailers of food products<\/li><li>The\nonline operators of food business<\/li><li>The\ntransporter of food products <\/li><li>The\ndistributor of food products<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_essentials_things_the_Food_Authority_should_confirm_for_every_Food_Article\"><\/span>What essentials things the Food Authority should\nconfirm for every Food Article?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>The\nFood Authority should confirm the following things for every Food Article\nbefore issuing a License to the Food Business Operator (FBO):<\/em><\/strong><\/p>\n\n\n\n<ul><li>The use of any <strong><em>food\nadditive or any food processing aid<\/em><\/strong> should be as per the FSSAI Act\nrules and regulations;<\/li><li><strong><em>There\nshould not be any insecticides or pesticides contained<\/em><\/strong> in the food article;<\/li><li>The <strong><em>labeling\nand marking of food article should be done as per FSSAI guidelines<\/em><\/strong>;<\/li><li>Is there a\npresence of any <strong><em>contaminated, toxic substance or any impurities in the\nfood article that may cause harm to human health.<\/em><\/strong> <\/li><\/ul>\n\n\n\n<p>The FSSAI is\nrequired to monitor the system control. The Food Commissioner appointed by the\nState Government is responsible for doing the effective implementation of food\nsafety and standards.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_are_the_types_of_FSSAI_Annual_Return\"><\/span>What are the types of FSSAI Annual Return?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>Unlike other business activities, the food business activity consists of filing only 2 kinds of returns every year. Under the FSSAI Act, FSSAI Annual Return is of two types which are as follows:<\/em><\/strong><\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter\"><img decoding=\"async\" width=\"593\" height=\"258\" src=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/04\/image-22.png\" alt=\"types of FSSAI Annual Return\" class=\"wp-image-6395\" srcset=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/04\/image-22.png 593w, https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/04\/image-22-300x131.png 300w\" sizes=\"(max-width: 593px) 100vw, 593px\" \/><\/figure><\/div>\n\n\n\n<h3 class=\"wp-block-heading\">Annual\nReturn in Form D1<\/h3>\n\n\n\n<ul><li><strong><em>The food manufacturers,\nimporters, labelers, packers, re-packers, and re-labelers, are mandatorily\nrequired to file Form D1 to the Licensing Authority<\/em><\/strong>.\n<strong><em>Form D1<\/em><\/strong> can be filed online or in physical form as prescribed by\nthe Food Safety Commissioner of the food licensing authority.<\/li><li><strong><em>Form D1 should be filed\non or before 31<sup>st<\/sup> May of every financial year <\/em><\/strong>to\nLicensing Authority, depending on the types of food products sold in the\npreceding financial year by the Food Business Operator (FBO). &nbsp;&nbsp;&nbsp;&nbsp;<\/li><li>Irrespective of the\ntypes of food produced in the previous year by Food Business operator (FBO), it\nis mandatory to file Form D1 to the Licensing Authority. &nbsp;<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Half-Yearly\nReturn in Form D2<\/h3>\n\n\n\n<ul><li><strong><em>The Form D2 is a\nhalf-yearly<\/em><\/strong> return and need not be filed every\nFood Business Operator (FBO). <strong><em>The FSSAI license holders who are involved\nin the business of importing or manufacturing of milk or milk products are\nrequired to file Form D2<\/em><\/strong>. <\/li><li>The FSSAI Annual return\nForm D2 should be filed on a half-yearly basis. This caused many problems for the license holders of small restaurants,\nsmall eateries, and grocery shops as they were not able to keep track of all\nthe transactions and stock of their business. The FSSAI, through a notification\nof exemption, exempted certain entities from filing the Annual FSSAI Return.<\/em><\/strong>\n<strong><em>The entities exempted from filing FSSAI Annual return are as follows:<\/em><\/strong><\/p>\n\n\n\n<ul><li>The <strong><em>Fast Food\nJoints<\/em><\/strong><\/li><li>The <strong><em>Restaurants<\/em><\/strong><\/li><li>The <strong><em>Grocery\nStores<\/em><\/strong><\/li><li>The <strong><em>Canteens<\/em><\/strong><\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_is_the_penalty_for_delay_in_filing_the_FSSAI_Annual_Return\"><\/span>What\nis the penalty for delay in filing the FSSAI Annual Return?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>The FSS (Licensing and Registration) Regulations, 2011, under Section\n2.1.13 (3)<\/em><\/strong> provides for penalty\nif there is a delay in filing the FSSAI Annual Return by the Food Business\nOperators (FBO). <strong><em>As per Section 2.1.13 (3),<\/em><\/strong> the Food Business\nOperator (FBO) if does not file the returns in the stipulated time, a fine of\nRupees 100 will be imposed on the Food Business Operator (FBO) every day. The\ndefault, if continues, the penalty will keep on increasing. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_are_the_Additional_Regulations_under_the_FSSAI_Act\"><\/span>What are the Additional Regulations under the FSSAI Act?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>The\nFood Business Operator (FBO) should adhere with the following compliances in\naddition to the FSSAI Annual Return filings:<\/em><\/strong><\/p>\n\n\n\n<ul><li>As specified in\nthe FSSAI rules, the maintenance of hygiene and sanitary standards of the\nfactory and the hygiene of workers should be done.<\/li><li>The daily\nrecords of the production, raw materials, utilization, and sales should be\nmaintained separately;<\/li><li>The source and\nstandards of the raw materials used should be of optimum quality;<\/li><li>The cleaning of\nthe machines and equipment\u2019s should be done regularly;<\/li><li>At least once in\nsix months, the testing of microbiological or chemical contaminants in food\nproducts should be ensured;<\/li><li>No manufacturing,\nstoring or exposing of any food products in any premises nearby the drain,\nsullage, urinal, sully, or place where the waste matter is stored.<\/li><li>The temperature\nshould be accurate throughout the supply chain from the place of procurement\ntill the time it reaches the consumer&#8217;s end. &nbsp;<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p> FSSAI License is an assurance for consumers that the food business is running as per the guidelines prescribed by FSSAI.
