The Supreme Court of India is the only body that is\nresponsible for the proper establishment of Public Interest Litigation (PIL). <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Who_is_eligible_to_file_PIL\"><\/span><strong>Who is eligible to file\nPIL?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Any Indian citizen can file the Public Interest Litigation\nthrough the proper channel. It should be noted that the PIL cannot be filled\nwith a private interest. Instead, it has been developed over the year only to\nprovide strength to the public interest.&nbsp;\n<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_is_the_PIL_Filling_Procedure\"><\/span><strong>What\nis the PIL Filling Procedure?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>One must do a comprehensive research before the filling of\nPublic Interest Litigation. The petitioner must get in touch with all affected\ninterest groups and jot down all the weak point before addressing the court. <\/p>\n\n\n\n<p>Next, gather all the pertinent documents and information to back\nyour case. As per the law, you are entitled to appoint an advocate for your\ncase. However, if you wish to fight the case on your own, then you must\nconfront the court\u2019s guidelines thoroughly. <\/p>\n\n\n\n<p>Next, you need to submit two copies of the petition to the high\ncourt. Also, distribute a copy of the petition to each respondent in advance\nwho is associated with the case. This action should be conducted in the consent\nof the law. A fee of Rs.50 has to be paid for each respondent and later attach it\nwith the petition. However, the cost of hiring an advocate may vary to a great\nextend. The experienced lawyers are more likely to charge big money as compared\nto the new one. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_is_the_difference_between_the_Writ_Petition_and_PIL\"><\/span><strong>What\nis the difference between the Writ Petition and PIL?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Writs are filed in the context of the private interest;\nmeanwhile, Public Interest Litigation is entirely dedicated to the public\ninterest. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_are_the_issues_not_served_by_PIL\"><\/span><strong>What\nare the issues not served by PIL?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>As per the Supreme Court guidelines, PIL is only intended to\nserve a specific interest, not the following matters. <\/p>\n\n\n\n<ul><li>Landlord-tenant matters<\/li><li>Service affairs<\/li><li>Matters concerning to gratuity and\npension, <\/li><li>Accusations against State or\nCentral government departments and Local Bodies except those mentioned in the\nlist of guidelines. <\/li><li>Admission to the educational\ninstitutions<\/li><li>Cases were pending in subordinate\ncourts.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"PIL_in_the_context_of_Indian_Law\"><\/span><strong>PIL\nin the context of Indian Law<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>In Indian law, PIL means lawsuits for the assurance of the public interest. It is litigation presented in a court of law, not by any other private party. It is not mandatory, for the exercise of the court\u2019s discretion, that the victim should personally approach the <strong>court<\/strong><sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/Court\"><strong>[1]<\/strong><\/a><\/sup>. <\/p>\n\n\n\n<p>PIL has today acknowledged as a powerful weapon to combat\npolitical anarchy and social persecution. The judicial communications\ntransmitted through PIL cases provide legal support against the abuses of\npower. The Indian PIL has developed regarding the political history of State\ncontrol. It arose as a tool to rejuvenate judicial ability to motivate the\ngovernment to live up to its pledges. <\/p>\n\n\n\n<p>PIL is meant for the implementation of the legal rights of the\npeople who are in a disadvantageous position due to poor social or economic\nbackground. Such litigation can be used for the cure of a public injury or\ndefending interest of public nature. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Aspects_of_Public_Interest_Litigation\"><\/span><strong>Aspects\nof Public Interest Litigation<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li><strong>Remedial in Nature<\/strong><\/li><\/ul>\n\n\n\n<p>The remedial nature of PIL doesn\u2019t follow the footprint of\ntraditional locus standi rules. It indirectly fused the principles consecrated\nin Part IV of the Constitution of India into Part III of the Constitution. This\nimplementation had changed the procedural nature of Indian law into an active\nwelfare one. <\/p>\n\n\n\n<ul><li><strong>Representative Standing<\/strong><\/li><\/ul>\n\n\n\n<p>Representative standing can be seen as a productive augmentation\nof the standing difference, which permits a third party to file a habeas corpus\npetition on the ground that the victim cannot address the court himself. And in\nthis regard, the Indian concept of PIL is much more explicit as compared to\nAmericans. <\/p>\n\n\n\n<ul><li><strong>Citizen standing<\/strong><\/li><\/ul>\n\n\n\n<p>The concept of citizen standing marks a significant augmentation\nof the court\u2019s rule, from a defender of personal rights to protector of the\nstate of law wherever threatened by official anarchy.<\/p>\n\n\n\n<p>PIL needs a judge that provides immediate relief to the victims\nof human rights or by exempting the suitor to verify the alleged facts which\nare reviewed by the court itself. If all the things are not present, the matter\nconcurrently cannot be called a PIL. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span><strong>Conclusion<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>\n\nThe\nnorms for supporting a PIL should be established to overcome prejudiced choices\nof the judges to treat anything under the sun as a PIL. PIL should only be used\nto defend the rights of the victims of political anarchy and social\npersecution.
