The assets include the marital property, which the couple acquired before and after the marriage. However, the question arises of whether the couple is open to negotiating and agreeing on their own on how they will be dividing the assets and liabilities, or whether, in the case of disagreements, they want the court to decide for them.<\/p>\n\n\n\n<p>The ownership of matrimonial property could be determined by the model on which it is based. Under this model, if property\nhas been acquired or bought by an individual before the marriage or even after\nthe marriage, it will continue to be retained by that spouse only. The other\nspouse has no right to claim ownership of the property. This particular model is\nmostly practised in those countries where the couple, collectively as well as\nindividually, holds financial independence and has a stable economic\nbackground. Due to this, there is no scope for tension between the spouses\nregarding the ownership of the property after the dissolution of their\nmarriage. Thus, in countries where a separate ownership model is followed, it\nis easier to division of assets between the spouses on the basis of the title\ndeeds to the property.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Community Ownership Model <\/h3>\n\n\n\n<p>This\nmodel is based on the assumption that the spouses commonly own the property,\nand after their divorce it has to be equally division of assets between them.\nThe fundamental idea behind this concept is that spouses should not only\ncontribute monetarily to purchasing the property, but also make non-financial\ncontributions. Section 4 of this Act explicitly prohibits the right to recover\nproperty held by Benami. For example, if a husband purchases a property in the\nname of his wife, he will not be allowed to have title to that property unless\nthe husband proves that he was the one who paid the consideration for\npurchasing the property in the name of his wife from his known sources. If he\nis able to prove that, then Section 4 of the said Act will not be applicable.\nSec. 2 (9) A(iii) of the said Act states that &#8220;any person being an\nindividual in the name of his spouse or in the name of any child of such an\nindividual and the consideration for such property has been provided or paid\nout of the known sources of the individual;&#8221; hence, the husband will be\nable to claim title over the property even if the property was purchased in the\nname of his wife.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"When_The_Agreement_To_Division_Of_Assets_And_Debt_Is_Absent\"><\/span>When The Agreement To Division Of Assets And Debt Is\nAbsent?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>In the\ncase where the agreement of division of assets and debts between the spouses\ndoes not exist and the couple fails to divide their marital property, the\ncourt, as per Section 27 of the Hindu Marriage Act 1955, will divide the\nmarital property in a fair manner. Furthermore, the marital property also\nincludes the property that was gifted or presented to any of the spouses during\ntheir marriage ceremonies as well as before and after the marriage.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Procedure_of_Court_Dividing_the_Marital_Property\"><\/span>Procedure of Court Dividing the Marital Property<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The courts, when dividing marital property, follow a common practise based upon individual contribution and ownership. Ownership of the property is an essential question that is asked by the court at the beginning of the division of assets proceedings.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter is-resized\"><img decoding=\"async\" src=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2023\/05\/image-12.png\" alt=\"Procedure of Court Dividing the Marital Property\" class=\"wp-image-56925\" width=\"477\" height=\"222\" srcset=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2023\/05\/image-12.png 834w, https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2023\/05\/image-12-300x140.png 300w, https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2023\/05\/image-12-768x358.png 768w\" sizes=\"(max-width: 477px) 100vw, 477px\" \/><\/figure><\/div>\n\n\n\n<h3 class=\"wp-block-heading\">Joint Ownership- Both Contributed<\/h3>\n\n\n\n<p>If the\ncouple holds joint property that was purchased with the contributions of both\nspouses, then it will be divided proportionally based on the ratio of their\ncontributions. The individual\u2019s equity will be considered by the court during\nthe division of assets of marital property. For example, if the husband had\npaid 70% of the total expenses incurred during the purchase of the property, he\nwould be entitled to 70% of the current value of the property, which would be\ndetermined by the court.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Joint Ownership \u2013 Only One Contributed<\/h3>\n\n\n\n<p>In cases\nwhere marital property is owned by both spouses but only one of them\ncontributed to purchasing it, if the spouse is able to prove he or she paid the\namount through his or her known sources, he or she may acquire the full\nproperty, irrespective of the fact that the property was owned jointly. But if\nthe spouse is not able to prove the same, then the division of assets in equal\nshares between the spouses.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">One Has Contributed Other Has Title<\/h3>\n\n\n\n<p>In these\ncases, the first and foremost duty of the court is to determine the nature of\nthe property and whether it will fall into the category of a Benami transaction\nor not. If a husband purchases a property in the name of his wife, he will not\nbe allowed to have title over that property unless the husband proves that he\nwas the one who paid the consideration for purchasing the property in the name\nof his wife from his known sources. If he is able to prove that, then Section 4\nof the said Act will not be applicable.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>During the divorce of the couple, it becomes essential to division of assets between them in a just and fair manner. This can be possible if any agreement regarding the same exists prior to the divorce proceedings, or the court will have to decide.
