spousal support, maintenance, aliment and spouse\nmaintenance, it is the legal obligation of an individual to provide financial\nassistance to their spouse before\/after their divorce or separation, it could\nbe decided between them through agreement or by the court itself.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Purpose_of_Alimony_Spousal_Support\"><\/span>Purpose of Alimony\/ Spousal Support<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>After the\nspouses are separated through divorce, then the court might award a specific\namount as alimony\/ spousal support to one of the spouses, who is economically\nweaker or has no means of financial support to take care of his\/her basic needs.\nThe said arrangement could either pre-decided by the spouses through an\nagreement or is decided by the court itself. This said alimony\/spouse support\namount is not inclusive of the divided marital property, child support. Although the wife is working and is earning decent\nincome, if there is considerable difference between the income of the husband\nand wife and husband is earning way more than her, then wife will be granted\nthe support so she could maintain the same living standard as her husband\nprovided her. If wife is not earning, then alimony\/ spouse support amount will\nbe decided by considering the factors such as her age, educational\nqualifications and her ability to earn in future, etc. in the case where wife\nis earning more than husband and husband is either disabled or not fit for work,\nthen husband will be granted the alimony\/ spouse support.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"How_Does_A_Court_In_India_Calculate_Alimony_Spouse_Support_Amount\"><\/span>How Does A Court In India Calculate Alimony\/ Spouse Support Amount?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>However,\nthere is no such set mathematical formulae to calculate the certain amount of\nalimony\/ spouse support, the alimony money could be availed as periodical\npayment i.e., monthly or it could be paid at once, in the form of lump-sum\namount as a one-time payment. As per the supreme court of India the amount of\nalimony\/ spouse support ranges from 1\/5<sup>th<\/sup> to 1\/3<sup>rd<\/sup> of the\ntotal net worth of husband. If the alimony is provided as monthly payment than\nit should not be less than 25% of the total income of that particular month.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Factors_Considered_At_the_Time_of_Fixing_the_Amount_of_AlimonySpouse_Support\"><\/span>Factors Considered At the Time of Fixing the Amount of Alimony\/Spouse\nSupport<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li>Standard of living and financial status of both\nthe spouses<\/li><li>Other assets of the couple<\/li><li>If, there is any existing liability of the husband\nor not<\/li><li>Expenses on children education, if any child is\nborn out of this marriage<\/li><li>Current health conditions of both spouses<\/li><li>The duration of the marriage<\/li><\/ul>\n\n\n\n<p>These factors differ from case to case; hence alimony\/ spouse support amount is decided accordingly. While in cases of <strong><a href=\"https:\/\/corpbiz.io\/mutual-divorce\">divorce<\/a><\/strong> by mutual concern, the amount of alimony\/spouse support is decided priorly through an agreement between the spouses.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"If_The_Once_Decided_Amount_Of_Alimony_Spouse_Support_Could_Be_Altered_Or_Not\"><\/span>If The Once Decided Amount Of Alimony\/ Spouse Support Could Be Altered Or\nNot?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>An\nAlimony\/Spouse support order by the court tends to remain same through out the\nyears, even if the spouses have big increment in their salaries or receives\nlarge bonuses at work. The former spouse is not entitled to receive such\nbenefits after the divorce.<\/p>\n\n\n\n<p>On the\nother hand, if there is some significant drop in income of the spouse to the\npoint, where the individual could no longer provide the maintenance, the spouse\ncould file the petition in the court regarding same, and pray for reducing the\namount of alimony\/ spouse support.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Could_Be_Claim_And_What_Not_Could_Be_Claimed_After_The_Separation_By_The_Wife\"><\/span>What Could Be Claim And What Not Could Be Claimed After The Separation By\nThe Wife?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The items\nlike jewellery including gold, silver, alloy, and precious stones, fixed assets\nsuch as property, and other assets such as cars, furniture, paintings,\nappliances, and artifacts that was presented to wife during, before or even\nafter the marriage could be claimed by her, these abovementioned gifts could be\ngifted by her husband, in-laws, relatives, friends and acquaintances. The\nearnings of the wife before or after marriage are also her property.<\/p>\n\n\n\n<p>Similarly,\nany asset, that was bought by the husband in the wife\u2019s name, without passing\nit on as a gift, also does not belong to the wife. If the wife has spent any of\nher earnings on the household, those cannot be claimed.&nbsp;Also, the wife\ndoes not hold any right on the jewellery, valuables or gifts gifted to the\nhusband by the wife\u2019s parents before, after or during the marriage.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>After the divorce litigation proceedings are finalised, either spouse could claim their right for seeking alimony\/ spouse support. Although there is no absolute right, it is upon the court to decide whether the need of alimony even exist or not. During the divorce litigation alimony\/ spouse support is very essential issue to deal the very perception of right to claim the financial support for post-divorce maintenance was not quite a familiar concept among the Indian divorce seekers, especially women few years back. But now not only women even the men are claiming for the right to seek financial support in certain cases.
