Long lines might be\nseen outside the government offices due to manual data gathering and\nverification procedures.<\/p>\n\n\n\n<p>The MCA\n21 Programme was subsequently implemented in order to bring about business\nreforms, good governance, and regulation. It provides many levels of cyber security\nassistance for sensitive data transmission and numerous online transactions.<\/p>\n\n\n\n<p>According to the Government of India under\nthe Information Technology Act of 2000, all tax returns, registration forms,\nand e-procurement must be accompanied by Digital Signature Certifications. This\nconfirms the identity of the signer and guarantees that the provided\ninformation has not been changed or altered. These certificates offer security\nfrom damaging cyberattacks, forgeries, and data breaches. Therefore for the\nsame purpose under the Trademark Act must have DSC in trademark registration. It\ncan be granted as ordered by the Controller of Certifying Authority CCA.<\/p>\n\n\n\n<p>DSC applicants may apply for any applicable\nDSC type depending on their signature needs. The various types of digital\nsignatures are briefly outlined below.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Are_The_Different_Classes_Of_A_Digital_Signature_Certificate\"><\/span>What Are The Different Classes Of A Digital Signature\nCertificate?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Before we move to the process of DCS in <strong><a href=\"https:\/\/corpbiz.io\/trademark-registration\">trademark registration<\/a><\/strong>, let us first look at the three different categories of Digital Signature Certificates (DSC), which are covered below:<\/p>\n\n\n\n<p><strong>Class\n1 Certificate:<\/strong><\/p>\n\n\n\n<p>Individuals and private subscribers are\nawarded Class 1 Digital Signature Certificates. Class 2\nDigital Signing Certificates can be applied to government e-documents such as\nIncome Tax Returns (ITR) and GST Returns (GSTR).<\/p>\n\n\n\n<p><strong>Class\n3 Certificate:<\/strong><\/p>\n\n\n\n<p>Class 3 digital signatures certificates are\ngiven out to both people and businesses. High assurance certifications are\nmostly used for online tenders and e-auctions.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Use_of_DCS_in_Trademark_Registration\"><\/span>Use of DCS in Trademark Registration<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>A valid digital signature\ncertificate also known as DSC is required to use the online filing system for\ntrademarks. The same has been mandated by the Information Technology (IT) Act\nof 2000, the act also mandates the use of digital signatures on electronic\ndocuments to ensure their security and authenticity.<\/p>\n\n\n\n<p>It is now necessary to obtain a\nClass 3 Digital Signature Certificate in order to use the trade mark e-filing\nsystem. Therefore, to proceed with registering a trademark, any individual,\nlawyer, or agent must first obtain a Class 3 DSC.<\/p>\n\n\n\n<p>You must get a Class 3 Digital Signature\nCertificate because only these with Class 3 DSC one can file an application for\ntrademark registration. With that the Class 3 DSC offers the highest level of\nsecurity and has the validity of 1-2 years. The DSC must be renewed at the end\nof this time frame.<\/p>\n\n\n\n<p>Therefore, submit a DSC first\nif you intend to submit an application for trademark registration in India.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Is_Class_3_DSC_In_Trademark_Registration\"><\/span>What Is Class 3 DSC In Trademark Registration?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>With a validity duration of\nbetween one and two years, the Class 3 digital signature certificate offers the\nhighest level of security. The DSC needs to be refreshed after this point. According to the Act, a\ndigital signature is a specific kind of electronic signature that uses\nasymmetric cryptographic keys to verify the signer&#8217;s identity and guarantee the\nintegrity of the document.<\/p>\n\n\n\n<p>The Information Technology (Certifying\nAuthorities) Regulations, 2000 set forth the requirements for the issuance and\nupkeep of Digital Signature Certificates (DSCs) in India by Certifying\nAuthorities (CAs) that possess a current licence. Rule 6 of the Regulations\nmandates that CAs confirm the applicant&#8217;s identity and the accuracy of the\ninformation provided before issuing a DSC.<\/p>\n\n\n\n<p>Additionally, DSCs must be used to submit\ntrademark applications and other paperwork online to the Indian Trademark\nRegistry in accordance with the Trade Marks Act, 1999 and the Trade Marks\nRegulations of 2017. The use of DSCs ensures the accuracy and reliability of\nthe submitted documents.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Mandatory_Requirements_for_DSC_in_Trademark_Registration\"><\/span>Mandatory Requirements for DSC in Trademark Registration<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>A DSC is required for the online submission\nof trademark applications and supporting documents with the Indian Trademark\nRegistry.
