Any natural\nperson who has been granted power through the power of attorney is legally\nbound by any decisions made by the principal with regard to the matter for\nwhich the POA was given.<\/p>\n\n\n\n<p>According\nto definition 1A of <strong>the Power of Attorney Act of 1882<\/strong><sup><a href=\"https:\/\/www.indiacode.nic.in\/bitstream\/123456789\/2360\/1\/A1882-07.pdf\"><strong>[1]<\/strong><\/a><\/sup>, any document\nappointing a particular person legally referred to as an attorney to serve for\nthe executor or on behalf of the principal is considered a power of attorney\n(POA).<\/p>\n\n\n\n<p>Although the <strong><a href=\"https:\/\/corpbiz.io\/power-of-attorney\">power of attorney<\/a><\/strong> is typically revocable, there are also irrevocable POAs. However, in most circumstances, the use of a power of attorney is restricted to situations when complicated legal issues arise. However, there are no specific\nguidelines or laws for revoking a power of attorney in India&#8217;s contracts or\npower of attorney laws. As a result, the courts have established the conditions\nunder which a power of attorney may be revoked or terminated. The power of\nattorney may be revoked in the following ways:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">By the Acts of the Principal<\/h3>\n\n\n\n<p>There\nare many situations in which the principal can revoke and terminate the\nprincipal-agent relationship. The principal can revoke the power of attorney in\nthe following cases:<\/p>\n\n\n\n<ul><li>Principal on his own will\ncan express revocation of power of attorney.<\/li><li>When the subject matter\nfor which the power of attorney was made has ended.<\/li><li>In the case when the POA\nagent becomes bankrupt or insolvent.<\/li><li>If the POA agent becomes\nunsound mind.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Breach of<strong> <\/strong>Agreement<\/h3>\n\n\n\n<p>If\na POA agent acts grossly negligently, in violation of the terms of the\nagreement made, or outside the scope of his or her authority or powers granted\nby the principal, then the principal may revoke the power of attorney. In these\ncircumstances, a declaration or notice of revocation may also be used to revoke\nan irrevocable power of attorney. The principal may also ask a court of\nappropriate jurisdiction to withdraw this irrevocable power of attorney, if\nnecessary.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conditions_That_Prevent_the_Power_Of_Attorney_from_Being_Revoked\"><\/span>Conditions That Prevent the Power Of Attorney from Being Revoked<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>If\nthe authorised POA agent has a stake or interest in the subject matter of the\npower of attorney, the principal cannot cancel the power of attorney without\nthe POA agent&#8217;s approval. According to Section 202 of the Indian Contract Act,\nif the agent gains an interest in the subject matter of the power of attorney,\nthe principal cannot revoke the power of attorney because doing so would be\ndetrimental to the agent&#8217;s interests.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Procedure_for_Revocation_of_Power_Of_Attorney\"><\/span>Procedure for Revocation of Power Of Attorney<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\nprocedure for revocation or termination of a power of attorney is given below:<\/p>\n\n\n\n<ul><li>The principal is required\nto produce a certificate or declaration revoking the power of attorney. The\ncertificate or declaration must specify the grounds for the revocation of the\nPOA and should also include the date on which the revocation took effect and\nthe effects of such an action or revocation.<\/li><li>To begin the revocation\nprocess, the aforementioned certificate or declaration notice of revocation\nmust be properly delivered to the agent in order to proceed with the further\nrevocation process.<\/li><li>The abovementioned\ncertificate or declaration of revocation should be published in a local or\nnational newspaper to inform those with whom the agent is dealing or\ncommunicating on behalf of the principal that the powers given to the POA agent\nare now revoked.<\/li><li>The same body that\nregistered the power of attorney must also register the revocation or\ntermination of the power of attorney.<\/li><li>A copy of the revocation\ncertificate or declaration of the power of attorney should be duly sent to the\nauthorised POA agent to inform him that the revocation of the power of attorney\nhas been registered legally.<\/li><li>A newspaper publication\nof the registered revocation certificate must be made in order to notify the\npublic that the power of attorney has been revoked.<\/li><li>To stop any activity or\ntransaction with the POA agent, copies of the POA revocation certificate or\ndeclaration may also be given to those whom the agent has dealt with on the\nprincipal&#8217;s behalf.<\/li><\/ul>\n\n\n\n<p>The\npower of attorney shall terminate or be revoked automatically in the event of\nthe death, insanity, or bankruptcy of the individual, principal, or POA agent,\nor where the primary purpose of the power of attorney has ceased to exist.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>As a result, it can be said that a power of attorney, once registered, might be cancelled under a variety of circumstances. One of these scenarios is the end of the connection or relationship between the principal and the POA agent. The process for cancelling or revoking the POA has not been mentioned in any Indian laws or acts, but the court has established the conditions under which a power of attorney may be revoked or terminated.
