Legal metrology as the part of metrology which treats units of weights\nand measurement, methods of weight and measurement and weighing and measuring\ninstruments concerning the mandatory technical and legal requirements which have\nthe object of ensuring public guarantee from the point of view of security and\naccuracy of the weight and measurements.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Is_Section_11_Under_Legal_Metrology_Act_2009\"><\/span>What Is Section 11 Under Legal Metrology Act, 2009?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Section 11 under Legal Metrology Act, 2009\nprohibits quotation in the package, otherwise than in terms of standard units\nof weight, measure or numeration.<\/p>\n\n\n\n<ol><li>No\nperson shall, concerning any goods, things or service can perform the\nfollowing.<\/li><li>Quote\nor make the announcement of, whether by word of mouth or otherwise, any price\nor charge or<\/li><li>Issue\nor exhibit any price list, invoices, cash memo or another document, or prepare\nor publish any advertisement, poster or other documents of the product or<\/li><li>Indicate\nthe net or total quantity of a pre-packaged commodity, or<\/li><li>Express\nconcerning any transaction or protection, any quantity or dimension, otherwise\nthan under the standard unit of weights, measure or numeration.<\/li><li>The\nprovisions of sub-section (1) under the Act shall not be applicable for the\nexport of any goods, things or services. Concerning any goods, things or\nservices, no one can (i) quote or announce any price-charge or; (ii) issue or\nexhibit price list, invoice, cash any memo or other document, or; (iii) prepare\nor publish any advertisement, poster or other documents, or; (iv) indicates the\nnet quantity of a pre-packaged commodity, or; (v) express concerning any\ntransaction or protection, any quantity or dimension otherwise than under the\nstandard unit of weight, measure or numeration. Exporting goods, things, or\nservices is exempt from the above social provisions.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Which_Weights_And_Measures_Are_Non-Applicable_For_Stamping_And_Verification\"><\/span>Which Weights And Measures Are Non-Applicable For Stamping And Verification?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The <strong><a href=\"https:\/\/corpbiz.io\/legal-metrology-act-registration\">Legal Metrology Act<\/a><\/strong> ensures the usage of weights and measures by properly verifying and stamping weights and measures. These verifications and stamping shall not apply to any weights and measures which are:<\/p>\n\n\n\n<ol><li>Used in any industry exclusively engaged in the manufacture of arms, ammunition or both for the use of the armed forces by the Government.<\/li><li>Used for scientific investigation or research purposes.<\/li><li>Manufactured exclusively for export purposes.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"How_Is_The_Prohibition_Of_Quotation_Ensured\"><\/span>How Is The Prohibition Of Quotation Ensured?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Section 11 under Legal Metrology Act, 2009\ndeals with the prohibition of quotation, etc., other than in terms of standard\nunits of weight, measure or numeration. This Section provides that no Person,\nas in Sec.2 (m) i.e.<\/p>\n\n\n\n<ol><li>A Hindu undivided family,<\/li><li>Every department or office,<\/li><li>Every organization established or constituted by Government,<\/li><li>Every local authority that operates within the territory of India, a company,<\/li><li>Firm and association of individuals,<\/li><li>Trust constituted under an Act,<\/li><li>Every cooperative society is constituted under an Act,<\/li><li>Every other society registered under the Societies Registration Act 1860 (21 of 1860);<\/li><\/ol>\n\n\n\n<p><strong>Shall, Concerning Any Goods, Things or\nService<\/strong><\/p>\n\n\n\n<ul><li>Quote, or make the announcement of, whether by word of mouth or      otherwise, any price or charge, or<\/li><li>Issue or exhibit any price list, invoice, cash memo or other documents, or<\/li><li>Prepare or publish<strong> <\/strong>any advertisement, poster or other documents, or<\/li><li>Indicate the net or total quantity of a pre-packaged commodity, or<\/li><li>Express concerning any transaction or protection, any quantity or dimension,<\/li><\/ul>\n\n\n\n<p>Otherwise, measure or numeration in accordance with the standard unit of weight.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Are_The_Penalties_And_Offences\"><\/span>What Are The Penalties And Offences?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong>If section 11 under Legal Metrology Act, 2009 has been\nviolated, then the following penalty and punishment<\/strong><strong><\/strong><\/p>\n\n\n\n<ul><li>Penalty for quoting or publishing non-standard units under Section 29 \u2013 violation of Section 11 shall be punishable with an Rs. 10,000\/-fine. For the second or subsequent offence, the person shall be punished with imprisonment extending to 1 year or with a fine with both.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Rules_that_apply_to_the_Legal_Metrology_Act_2009\"><\/span>Rules that apply to the Legal Metrology Act 2009<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Following are\nsome important rules that apply to the Legal Metrology Act 2009:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">The Legal Metrology (National Standards) Rules, 2011<\/h3>\n\n\n\n<p><strong>This\nrule is used <\/strong>to\nspecify Units of Weight or Measures, National Standards, Reference, Secondary\nand Working Standards to bring uniformity in Indian standards.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">The Legal Metrology (Numeration) Rules, 2011<\/h3>\n\n\n\n<p>To\nenforce procedure and manner for writing numbers in the packages or goods<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">The Legal Metrology (Approval of Models) Rules, 2011<\/h3>\n\n\n\n<p>To\napprove the metrological and technical characteristics of weights and qualities\nof physical weight representation or measure with prescribed tolerance.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">The Indian Institute of Legal Metrology Rules, 2011<\/h3>\n\n\n\n<p>The\ninstitute ensures and imparts short-term and long-term training to enforcement\nofficers of the Act.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">The Legal Metrology (Packaged Commodities) Rules, 2011<\/h3>\n\n\n\n<p>This\nlaw ensures and regulates net quantity errors, standardises Net contents,\nmandatory declarations on all pre-packed commodities, and the role of importers\nof the pre-packaged commodities sold in India.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">The Legal Metrology (General) Rules, 2011<\/h3>\n\n\n\n<p>To\nspecify details of standards and commercial Weight or Measure with the\ndenomination, physical characteristics, material, tolerance, design and\nperformance.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The Legal Metrology Act has been enacted to establish and enforce standards of weights and measures and regulate trade and commerce weights and measures.
