As a result, permission to\noccupy is issued on a leave and licence basis rather than a tenancy basis. Such\na contract facilitates eviction and gives the landlord more authority overall.<\/p>\n\n\n\n<p>The\ndifference between a leave and licence agreement and a lease is that the latter\ncreates an interest in the property, whereas the former does not. Additionally,\nunlike a Leave and Licence arrangement, a lease can be transferred.<\/p>\n\n\n\n<p>A\n&#8220;Licence&#8221; is a right conferred by one person to another person or\ngroup of people in accordance with Indian law. These rights typically apply to\nactivities carried out on or in relation to immovable property that otherwise\nappear to be illegal. Personal rights granted by a licence are\nnon-transferable.<\/p>\n\n\n\n<p>The\nperson who provides the licence is known as the licensor, while the person who\npurchases the licence and uses its rights is known as the licensee. You have limited options to vacate the tenant and increase rent.<\/p>\n\n\n\n<p>To avoid such a situation, execute a\nrental agreement only for 11 months. An 11-month rent agreement doesn\u2019t come\nunder the Rent Control Act.<\/p>\n\n\n\n<p>To make your agreement even safer,\nchoose Leave and License agreement for 11 months. Post 11 months, renew the\nagreement for another 11 months. Keep your agreement limited to 11 months.<\/p>\n\n\n\n<p>A tenant should not understay or\noverstay. I mean, financially, it&#8217;s not healthy if the tenant terminates the\nagreement within 11 months, as you may spend again on renovation, painting,\ncleaning, repairs, and broker fees.<\/p>\n\n\n\n<p>The tenant should not stay more than\n10 years as well, as this may become legally challenging for you.<\/p>\n\n\n\n<p>The ideal tenancy is around 5 years.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Heres_A_Format_to_What_and_How_a_Leave_Agreement_Is_Made\"><\/span>Here\u2019s A Format to What\nand How a Leave Agreement Is Made:<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">Leave and License Agreement<\/h3>\n\n\n\n<p>This Leave and License Agreement\n(&#8220;Agreement&#8221;) is made and entered into on [Date] by and between\n[Licensor Name] (&#8220;Licensor&#8221;), residing at [Licensor&#8217;s Address], and\n[Licensee Name] (&#8220;Licensee&#8221;), residing at [Licensee&#8217;s Address].<\/p>\n\n\n\n<p>WHEREAS, Licensor is the owner of the property located\nat [Property Address] (&#8220;Property&#8221;), and Licensor desires to grant a\nlicense to Licensee to use the Property on the terms and conditions set forth\nin this Agreement.<\/p>\n\n\n\n<p>NOW, THEREFORE, in consideration of the mutual\ncovenants and agreements contained herein, the parties agree as follows:<\/p>\n\n\n\n<p><strong>Grant\nof License:<\/strong> Licensor hereby grants to Licensee a\nnon-exclusive, non-transferable license to use the Property for residential\npurposes only, commencing on [Start Date] and ending on [End Date].
