class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Section 48 under Legal Metrology Act, 2009 discusses the<strong> <\/strong>compounding of offences. <\/p>\n\n\n\n<ol><li>Any offence\npunishable under sec 25, sec 27 to 39, sec 45 to 47, or any rule made under\nsub-sec (3) of section 52 either before or after the institution of the prosecution,\nbe compounded on payment for credit to the Government of such sum as may be\nprescribed.<\/li><li>The Director\nor legal metrology officer, as may be specially authorised by him on this\nbehalf, may compound offences punishable under section 25, sections 27 to 39,\nor any rule made under sub-section (3) of section 52.<\/li><li>The\nController or legal metrology officer specially authorised by him may compound\noffences punishable under sec 25, sec 27 to 31, sections 33 to 37, sections 45\nto 47, and any rule made under sub-sec (3) of section 52: Provided that such\nsum should not exceed the maximum amount of the fine, which is imposed under\nthis Act for the offence so compounded.<\/li><li>Nothing in\nsub-section (1) shall apply to a person who commits the same or similar offence\nwithin three years from the date the first offence he committed was compounded.\nExplanation. \u0097For this sub-section, any subsequent offence\ncommitted after the expiry of a period of three years from the date on which\nthe offence was previously compounded shall be deemed to be a first offence.<\/li><li>Where an\noffence has been compounded under sub-section (1), no proceeding or further\nproceeding, as the case may be, shall be taken against the offender regarding\nthe offence so compounded.<\/li><li>No offence\nunder this Act shall be compounded except as this section provides.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Objectives_of_the_Legal_Metrology_Act\"><\/span>Objectives of the Legal Metrology Act<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong>The following are the primary objectives of the Legal\nMetrology Act:<\/strong><strong><\/strong><\/p>\n\n\n\n<ul><li>To adopt weights &amp; measure trade and commerce.<\/li><li>To introduce and enforce weight and measurement standards.<\/li><li>Weights, measurements, or numbers adapt product manufacturing, sale, and usage.<\/li><li>To rationalise the Indian Metric process (meter, kilogram, etc.)<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Features_of_the_Legal_Metrology_Act\"><\/span>Features of the Legal Metrology Act<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\nLegal Metrology Act of 2009, in particular, provides for the following:<\/p>\n\n\n\n<ul><li>Weight or measure regulation used in a transaction or for protection.<\/li><li>Approval of a weight or measurement model<\/li><li>Verification of stipulated weight or measurement by a government-approved testing facility.<\/li><li>Specifying the qualifications of legal metrology officials appointed by the Central or State Governments.<\/li><li>Exemption from weight and measure regulations for export items;<\/li><li>Fees for specific services are levied<\/li><li>Nomination of a director by a corporation who will be accountable for enactment compliance.<\/li><li>Penalty for offences and offences combined<\/li><li>Appeals against various agencies\u2019 decisions <\/li><li>Empowering the central Government to create regulations for upholding the enactment&#8217;s provisions.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Non-compliance_with_Notices_of_the_Legal_Metrology_Act\"><\/span>Non-compliance with Notices of the Legal Metrology Act<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Section\n48 under legal metrology act, 2009 provides provisions for the compound\noffences punished under this Act.<\/p>\n\n\n\n<p>The\nLegal metrology department issues notice to the companies for non-compliance\nwith various provisions enumerated under this Act. If the company further avoid\nthe notice, it shall be punished under section 48 of legal metrology act, 2009.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Follow_the_Standard_Weights_and_Measures_of_the_Legal_Metrology_Act_to_avoid_penalisation\"><\/span>Follow the Standard Weights and Measures of the Legal Metrology Act to\navoid penalisation<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The followings are the Standard and fundamental units of weights and measures of the Act. Section 48 under Legal Metrology Act, 2009<strong> <\/strong>discusses the compounding of offences if any of these weights and measures has been violated.<\/p>\n\n\n\n<ul><li>Mass in kilogram<\/li><li>Time in second<\/li><li>The electric current in ampere<\/li><li>The thermodynamic temperature in kelvin<\/li><li>The luminous intensity in Candela<\/li><li>Amount of substance in the mole.<\/li><li>Every numeration in the decimal system.<\/li><li>The decimal multiples and their sub-multiples of\nthe numerals should be written as prescribed in the Act.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Every business using weights or measures in their business transaction or for protection should follow all the procedures under the Legal Metrology Act, 2009. Section 48 under Legal Metrology Act, 2009 talks about the compounding of offences where any offence punishable under sec 25, secs 27 to 39, sections 45 to 47, or any rule made under sub-section (3) of section 52 may, either before or after the institution of the prosecution, be compounded, on payment for credit to the Government of such sum as may be prescribed.
