Any person who manufactures, distributes or\nsells weights and measures should mandatorily obtain the Legal metrology\ncertificate to run their business in India. Section 47 under legal metrology act, 2009 penalizes anyone tampering\nwith a licence. If a person alters or tampers with any licence issued or\nrenewed under this Act or rules made on this behalf will be penalized. If a person alters or tampers with\nany licence issued or renewed under this Act or rules made on this behalf, otherwise\nunder any authorization made by the controller of the Act on this behalf, shall\nbe punished with a fine which may extend to Rs.20, 000\/-, or with imprisonment which\nmay extend up to 1 year or with both.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Is_The_Role_Of_The_Legal_Metrology_Act\"><\/span>What Is The Role Of The Legal Metrology Act?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The Legal Metrology Act<sup> <\/sup>replaces the standard weights and Measures Act. The following are considered the role of the Legal Metrology Act.<\/p>\n\n\n\n<ul><li>Establishing and regulating the weights and measures of Law<\/li><li>Supervising and controlling the weights and measures Law<\/li><li>They facilitate traceability for measurement and measuring devices.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Understanding_of_the_Legal_Metrology_Act_and_Its_Rules\"><\/span>Understanding of the Legal Metrology Act and Its Rules<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\nLegal Metrology Act encompasses over 40 measuring and weighing instruments such\nas electronic, weighbridges, fuel pumps, water metres, sphygmomanometers,\nclinical thermometers, and other similar things.<\/p>\n\n\n\n<p>This\nAct aims to set and enforce standards for weights and measures and measuring\ninstruments, regulate trade and commerce involving weight, measure, or many\ngoods, and address related matters and incidents. Even the section 47 under\nlegal metrology act, 2009 penalizes anyone tampering with a licence.<\/p>\n\n\n\n<p>The\nstate or federal government officers do routine inspections on these weighing\nand measuring devices using the Standard Weights and Measures and the process\ndefined in the Rules.<\/p>\n\n\n\n<ul><li>In India, it regulates pre-packaged commodities, mandates labelling requirements before the sale, and strictly ensures the package&#8217;s weights and measures.<\/li><li>According to <strong>the Legal Metrology Act, 2009<\/strong><sup><a class=\"text-primary\" href=\"https:\/\/www.indiacode.nic.in\/bitstream\/123456789\/2102\/1\/a201001.pdf\"><strong>[1]<\/strong><\/a><\/sup>, standards of weights and measures should be regulated and enforced by the Legal Metrology department officer, trade and commerce in weights or measures, and other goods sold or distributed by weight, measure or number are regulated, and any related matters are dealt with.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Who_Can_Obtain_The_Legal_Metrology_Certificate\"><\/span>Who Can Obtain The Legal Metrology Certificate?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Any\nperson defined under section 2(m) of the Legal Metrology Act, 2009, which\nincludes a Hindu divided family, every department, every office, established\norganization, company, firm, trust, and co-operative society in India, who\nwishes to perform any trade about manufacturing, importing, packing of any such\nweights and measures or measuring instruments must mandatorily get themselves\nregistered under the Legal Metrology Act. So the person after obtaining the\nlicense should not alter or tamper the license which may leads to penalty. Section 47 under legal metrology act, 2009\npenalizes anyone tampering or altering the licence.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Procedure_to_Obtain_a_Legal_Metrology_Certificate\"><\/span>Procedure to Obtain a Legal Metrology Certificate<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Obtaining\na legal metrology certificate in India, getting registered and approvals and\nobtaining license counts for a vital process discussed below.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Registration of Companies\/firm<\/h3>\n\n\n\n<p>Any\ncompany dealing in manufacturing, importing, or packaging weights and measures\nshould register itself as a manufacturer, importer, or packer under the Legal\nMetrology Act.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Registration of Importer<\/h3>\n\n\n\n<p>Any\nimporter who imports weights and measures, who wishes to import or pack any\nweights and measurements or any measuring instruments and any importer or\npacker who wishes to import or pack any pre-packaged commodity must get\nthemselves registered under the Act accordingly within the prescribed time\nlimit, i.e. within 90 days from import. Similarly, the packer also should\nregister with the legal metrology Act. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Licenses under the Legal\nMetrology Act<\/h3>\n\n\n\n<p>The\nDepartment of Consumers Affairs has provided strict procedures and issued\nguidelines on providing permits needed under Legal metrology. License as a\nmanufacturer, license as a dealer, and license as a repairer are required under\nlegal metrology.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Approval of Models by the Test Centres<\/h3>\n\n\n\n<p>As\nper the Legal Metrology Act, to get the license, the manufacturers, importers\nor dealers&#8217; weights and measures must be approved by the established test\ncentres recognized by the Government of India. An application for approval of\nthe model has to be filed along with all the supporting documents. After\ninspection of the model at the business premises, the controlling authority\nreviews the respective application, and the concerned certified laboratory\ngrants an approval certificate.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Declarations on the Commodities\nAre Mandatory<\/h3>\n\n\n\n<p>An\never pre-packaged commodity which requires the LMPC license must bear\ndeclarations containing the name, address of manufacturer\/ packer, date of\norigin, and a principal display panel in the package of the commodity. The\nsizes and patterns of these declarations can vary depending on the pre-packaged\ncommodity type.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Verification and Stamping Of\nWeights and Measures<\/h3>\n\n\n\n<p>As\nper the rules of the Act, the weights and measures and measuring instruments\nmust be verified and stamped, depicting the year placed by the legal metrology\nofficer, who confirms whether the measurement instruments are as per the\nprescribed standards of the Legal Metrology Act.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The role of the <strong><a href=\"https:\/\/corpbiz.io\/legal-metrology-act-registration\">Legal Metrology Act<\/a><\/strong> is to regulate and ensure the proper usage of weights and measures.
