For these offences, the officer shall be punished\nwith imprisonment for one year, or with fine which may extend to Rs.10000\/- or\nwith both.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Qualifications_of_Legal_Metrology_Officer\"><\/span>Qualifications of Legal Metrology Officer<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Section 42 under Legal Metrology Act, 2009 penalizes the officer who does a vexatious search and actions. To avoid that penalization and loss to the Government, the following procedures should be followed while appointing the officers.<\/p>\n\n\n\n<p>A person who is appointed as a legal metrology officer should possess the following qualification to avoid penalization in section 42 under the legal metrology act, 2009.<\/p>\n\n\n\n<ul><li>The officer should mandatorily be a graduate from a recognized university in science or technology or engineering or hold a recognized engineering diploma with 3 years of professional experience.<\/li><li>The person should have the ability to speak, read and write at least one of the regional languages of the State.<\/li><li>The person appointed as the Legal Metrology officer post should complete their introductory training course at the Indian Institute of Legal Metrology established by the Federal Government under section 11 of the Act.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Procedure_of_Appointment_of_Director_Legal_Metrology_Officers_and_Other_Employees_of_the_Legal_Metrology_Department\"><\/span>Procedure of Appointment of Director, Legal\nMetrology Officers and Other Employees of the Legal Metrology Department<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Section 42 under Legal Metrology Act, 2009\npenalizes the officer who does a vexatious search and actions. To avoid that\npenalization and loss to the Government, the following procedures should be\nfollowed while appointing the officers.<\/p>\n\n\n\n<ol><li>The Central or State Government may appoint a Director of legal\nmetrology or Additional or Joint\nDirector, Deputy and Assistant Director and other\nemployees to exercise their powers and discharge the duties imposed on them\nunder this Act concerning inter-State trade and commerce.<\/li><li>The qualifications of the director and any officer of legal metrology\nare appointed under sub-section (1)\nshall be prescribed in the Act.<\/li><li>The director and any legal metrology officer appointed under sub-section\n(1) of the Act, The officer shall exercise the powers and discharge such\nfunctions in respect of their local limits as the Central Government notified\nor specified.<\/li><li>Every legal metrology officer whether controller or any other officer\nare appointed under sub-section (1) shall exercise powers and discharge duties under\nthe general supervision, direction and control of the director of the Legal\nmetrology department.<\/li><li>The director, the controller and every legal metrology officer\nauthorized to perform any duty under this Act will be a public servant within\nthe meaning of section 21 of the Indian Penal Code (45 of 1860).<\/li><li>No suit, prosecution, or another legal proceeding shall be against the\ndirector, the controller and\nthe legal metrology officer authorized to perform\nany duty under this Act. <\/li><li>The Central Government may, with the consent of the State Government and\nsubject to conditions, limitations and restrictions on their behalf, delegate such\npowers of the director under this Act as it may think fit the controller of legal\nmetrology in the State. The\ncontroller may, if he thinks that it is necessary\nfor the public interest to, delegate such of the powers delegated to him\nas he may think fit any legal metrology officer and where such controller makes\nany such delegation of powers, the person to whom such powers are delegated shall exercise those\npowers in the same manner and effect as if they had been conferred on him directly by\nthis Act and not by way of delegation.<\/li><li>Where any delegation of powers is made under subsection (7), the powers\nso delegated shall be exercised under the director&#8217;s general superintendence, direction and\nguidance.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Standard_Weights_and_Measures_of_the_Legal_Metrology_Act\"><\/span>Standard Weights and Measures of the Legal Metrology Act<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The following are the Standard weights and\nmeasures of the Act. Section 42 under Legal Metrology Act, 2009 ensures the\nstandards that an officer should have while handling these weights and\nmeasures.<\/p>\n\n\n\n<ul><li>Mass &#8211;\nkilogram<\/li><li>Time &#8211; second<\/li><li>Electric\ncurrent &#8211; ampere<\/li><li>Thermodynamic temperature\nshall be the kelvin<\/li><li>Luminous\nintensity &#8211; candela<\/li><li>Amount of\nsubstance -mole.<\/li><li>Every\nnumeration shall be made under the decimal system.<\/li><li>The decimal\nmultiples and their sub-multiples of the numerals should be of such\ndenominations and be written in such manner as prescribed in the Act.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Every person using weights or measures in any business transaction or for protection should follow all the rules under the Legal Metrology Act (LM) 2009. Section 42 under <strong>Legal Metrology Act, 2009<\/strong><sup><a class=\"text-primary\" href=\"https:\/\/www.indiacode.nic.in\/bitstream\/123456789\/2102\/1\/a201001.pdf\"><strong>[1]<\/strong><\/a><\/sup> penalises the officer who does a vexatious search and actions at his discretion without any proper evidence.
