Then the\noffence is punishable under this Act, kept or concealed in any premises or in\nthe course of transportation.<\/li>\n\n\n\n<li>The authority can go to such premises and search or\ninspect any weight, measure or other goods in relation to which an offensive trade\nor commerce has taken place or is intended to take place. The officer can seize\nany record, register or other document relating to the offence.<\/li>\n\n\n\n<li>The officer can seize any weights, measures and\nrecords, register or other relevant document or article which he has reason to\nbelieve that the evidence indicates an offence punishable under this Act.<\/li>\n\n\n\n<li>The\ndirector, controller or any authorised legal metrology officer produce every\ndocument or other record relating to the weight or measure, and the person\nhaving the custody of such weights or measures shall comply with such\nrequisition.<\/li>\n\n\n\n<li>Suppose the\nweights and measures or goods seized by the controlling officer under\nsub-section (1) are subject to speedy or natural decay. In that case, the\ndirector, controller or authorised legal metrology officer may dispose of such\ncommodity in such manner as may mention in the Act.<\/li>\n\n\n\n<li>Every search\nor seizure made under section 15 under the legal metrology act, 2009 shall be\ncarried out under with the provisions of the Code of Criminal Procedure (Crpc),\n1973, relating to searches and seizures.<\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Objectives_of_Section_15_under_Legal_Metrology_Act_2009\"><\/span>The Objectives of Section 15 under Legal Metrology Act, 2009<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\nfollowings are the objective and role of section 15 under Legal Metrology Act,\n2009, which search and seizes the non-standard weights and measures<\/p>\n\n\n\n<ul>\n<li>Does the inspection and search of the premises if the complaint is arises.<\/li>\n\n\n\n<li>Search for the offensive weights and measures<\/li>\n\n\n\n<li>Seizure of the offensive goods<\/li>\n\n\n\n<li>The timely inspection and seizure ensures the fair trade practices<\/li>\n\n\n\n<li>The inspection by the authority at time-to-time on the premises gives consumers trust in the product and measures.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Penalties_under_Legal_Metrology_Act\"><\/span>Penalties under Legal Metrology Act<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\nfollowing are the penalties given to the premises owner from where the\nauthority seized the weights and measures.<\/p>\n\n\n\n<ul>\n<li>Every non-standard or unverified weight or measure\nand package used in any trade and commerce seized under\nsection 15 shall be liable to be forfeited.<\/li>\n\n\n\n<li>If such seized unverified weight or measure shall\nnot be forfeited, then the same may be verified and stamped\nwithin\nthe prescribed time.<\/li>\n\n\n\n<li>Every weight, measure or other goods of the owner\nseized in section 15 under legal metrology act, 2009 is not forfeited and shall\nbe disposed of by such authority in a manner as may be\nspecified in the Act.<\/li>\n\n\n\n<li>The imprisonment may extend to 5\nyears and shall also be punished with imprisonment for 2 years for the\nsubsequent offence.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Section_15_under_Legal_Metrology_Act_2009_%E2%80%93_Disposal_of_Seized_Weights_And_Measures\"><\/span>Section 15 under Legal Metrology Act, 2009 &#8211; Disposal of Seized Weights, And Measures<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The following are the steps that a legal\nmetrology officer should follow in disposing of the seized <\/p>\n\n\n\n<ul>\n<li>Any unverified weight or measure shall be returned to the\nimporter, manufacturer, or retailer from whom those weights or measures were\nseized. If that person gets the same corrected, then it is again verified and\nstamped within 15 daysof\nthe return.<\/li>\n\n\n\n<li>If the controlling authority seizes any weight or measure or\nany relevant document or thing or goods seized and detained by section 15 under\nLegal Metrology Act,&nbsp; 2009, is subject to\nproceedings in a court, it shall be dealt with in accordance with a court\norder.<\/li>\n\n\n\n<li>If the goods seized under section 15 of the Act are subject\nto speedy decay. Then the legal metrology officer shall obtain the signature of\nthe trader who committed the offence for recording purposes.<\/li>\n\n\n\n<li>When the goods seized under sub-section (1) of Section 15 of\nthe Act are contained in a package or container. The package is false, which\ndoes not contain the declaration or does not comply with the provisions of the\nAct, which is subject to speedy or natural decay, the legal metrology officer\nmay dispose of the goods in such a package under the provisions of sub-rule (3)\nof section 15 of the Act.<\/li>\n\n\n\n<li>Suppose the goods seized under sub-section (1) of Section 15\nunder Legal Metrology Act, 2009 are not subject to speedy decay. The legal\nmetrology officer may retain the package or container for prosecution under\nthis Act after giving the trader or owner of the product a notice of such\nseizure. In cases the offence is not subject to proceedings in a court, after\nsixty days of its seizure of the goods, the controlling authority may deal with\nthose goods as directed by the court.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The <strong><a href=\"https:\/\/corpbiz.io\/legal-metrology-act-registration\">Legal Metrology Act<\/a><\/strong> provisions apply to individuals or manufacturers using any weight or measure in any transaction, industrial production, or protection.
