The Non-standard weights and measures are not to be imported to India. No\nweight or measure, whether complete, one or component of any machine or part of\nthe machine shall be imported unless it conforms and qualifies standards of\nweight or measure established under this Act.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Is_Standard_Weight_Or_Measure_Section_20_Under_Legal_Metrology_Act_2009\"><\/span>What Is Standard Weight Or Measure Section 20 Under Legal Metrology Act,\n2009?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Chapter II\nof the Act declares that the standard weight or measures will be any weight or\nmeasurement that conforms to the standard unit of such weight or measure (based\non the metric system or prescribed derived units) and also envisages the\nprovisions of Sec. 7(i.e., the physical characters, configuration, premises\ndetails, materials used, equipment, period of re-verification, methods or\nprocedures of tests should be such as may be prescribed). Non-standard or\nunverified weights and measures are subject to seizure and forfeiture.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Objectives_of_Section_20_under_Legal_Metrology_Act_2009\"><\/span>Objectives of Section 20 under Legal Metrology Act, 2009<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\nfollowings are the objectives of section 20 under Legal Metrology Act, 2009<\/p>\n\n\n\n<ul>\n<li>To govern and ensure weights and measurements of trade and commerce.<\/li>\n\n\n\n<li>To establish and enforce weight and measurement standards equivalent to international standards.<\/li>\n\n\n\n<li>Weights, measurements, or numbers govern item manufacturing, sale, and usage. So it is necessary to ensure that section 20 of the Act allows only the standard weights and measures and avoids non-standard weights and measures.<\/li>\n\n\n\n<li>To Keep the Indian Metric system on par with National Standards (metre, kilogram, etc.)<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Standards_of_Weights_and_Measures_under_the_Act\"><\/span>Standards of Weights and Measures under the Act<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The followings are the weights and measures eligible for Legal Metrology Act. Every unit of weight or measure is in relation metric system based on the international system of units.<\/p>\n\n\n\n<ul>\n<li>Length shall\nbe in metres.<\/li>\n\n\n\n<li>Mass shall\nbe in kilograms.<\/li>\n\n\n\n<li>The time\nshall be in seconds.<\/li>\n\n\n\n<li>Electric\ncurrent shall be in ampere<\/li>\n\n\n\n<li>The\nthermodynamic temperature in Kelvin<\/li>\n\n\n\n<li>The luminous\nintensity in Candela<\/li>\n\n\n\n<li>Amount of\nsubstance in mole<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Objectives_of_Weighing_and_Measuring_Equipment\"><\/span>Objectives of Weighing and Measuring Equipment<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\nWeighing and Measuring equipment have been discussed below and is necessary for\nevery importer. If any of the weighing and measuring instruments do not meet\nthe requirements below, then that equipment may not be given a license by\nsection 20 under the Legal Metrology Act.<\/p>\n\n\n\n<ul>\n<li>The equipment used for measures\nand weights for goods must be accurate and determined with specific tolerances\nand standards. Here are a few examples of weighing and measuring equipment that\nmust be stamped.<\/li>\n\n\n\n<li>Weighing and measuring equipment used\nfor day-to-day activities like fruit and vegetables, meat, fish, postal\nservices, sweets etc.<\/li>\n\n\n\n<li>The measure of volume: edible oil\nmeasuring jars, milk measuring jars, wine glasses and carafes, beer glasses and\nautomatic measuring meters, petrol pumps, etc.<\/li>\n\n\n\n<li>Length Measure: commonly known as\n&#8216;yardsticks&#8217;, usually used in metre measures used for fabrics, material,\nelectrical, ribbon, cable, etc.<\/li>\n\n\n\n<li>Flexible tapes used for carpet\nand floor coverings.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Government_Legislation_to_Regulate_Legal_Metrology_Act\"><\/span>Government Legislation to Regulate Legal Metrology Act<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\ngovernment enacted <strong>the Legal Metrology Act 2009<\/strong><sup><a class=\"text-primary\" href=\"https:\/\/www.indiacode.nic.in\/bitstream\/123456789\/2102\/1\/a201001.pdf\"><strong>[1]<\/strong><\/a><\/sup> to eliminate\nanomalies and simplify the laws. It also became vital to maintain regulation on\nweights and measures to defend consumers&#8217; interests and keep the trade free of\nunnecessary intrusion. The government has specific &#8220;Government-authorised\nTest Centres&#8221; to verify stipulated weight or measure.<\/p>\n\n\n\n<p><strong>Specific Laws to regulate\nLegal Metrology Act are as follows:<\/strong><\/p>\n\n\n\n<ul>\n<li>The Legal Metrology Act, 2009&nbsp;<\/li>\n\n\n\n<li>The Legal Metrology (Packaged Commodities) Rules, 2011<\/li>\n\n\n\n<li>The Legal Metrology (General) Rules, 2011<\/li>\n\n\n\n<li>The Legal Metrology (Approval of Models) Rules, 2011<\/li>\n\n\n\n<li>The Legal Metrology (National Standards) Rules, 2011<\/li>\n\n\n\n<li>The Legal Metrology (Numeration) Rules, 2011<\/li>\n\n\n\n<li>The Indian Institute of Legal Metrology Rules, 2011<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Verifications_of_Weights_and_Measures\"><\/span>Verifications of Weights and Measures<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The weights\nor measures in a transaction should be validated and verified. The Central and\nState governments will specify the weights and measurements that Government\nApproved Test Centres must verify. The Federal and State Governments will\nnotify the Test Centres at time-to-time based on the requirement.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Enhancements_in_the_Legal_Metrology_Act\"><\/span>Enhancements in the Legal Metrology Act<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Any\nperson or manufacturer who uses a weight or measure in a business transaction\nor trade must provide the weights or measurements for verification at the\nfollowing locations:<\/p>\n\n\n\n<ul>\n<li>At the specified legal metrology department\u2019s premises, the state of manufacturing and state of import should be verified.<\/li>\n\n\n\n<li>The legal metrology officers where the business uses weight or measure must re-verify and stamp it regularly when the license expires.<\/li>\n\n\n\n<li>Weights and measurements utilised by industries for internal purposes and which do not have a link with the quantity given to the customer need not be re-verified.<\/li>\n\n\n\n<li>Declarations of the weights and measures essential in their web page.<\/li>\n\n\n\n<li>If a pre-package includes a commodity, then there should be \u2018Best before\u2019 or \u2018Use by Date, Month, and Year\u2019 must be marked.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Penalties_under_the_Legal_Metrology_Act\"><\/span>Penalties under the Legal Metrology Act<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\nAct\u2019s offences and penalties are outlined of the Act is outlined in Chapter 5.\nSuppose the importer does not abide by section 20 under Legal Metrology Act,\n2009. The following penalties may be given.<\/p>\n\n\n\n<ul>\n<li>Section\n27 of the Act states that if the manufacturer or importer imports the\nnon-standard weights or measures to India against section 20 of the Act, then\nthey are punished by a fine of Rs.20, 000 for the first offence, imprisonment\nfor up to 3 years for other subsequent crimes.<\/li>\n\n\n\n<li>Sec.\n36(1) of the Act ensures punishment of up to Rs.25, 000\/- for the first crime,\na fine of up to Rs.50, 000\/- for the second, and a fine of up to Rs. 1 lakh for\nthe third violation.<\/li>\n\n\n\n<li>Section\n38 of the Act establishes that if an importer imports a non-registration of\nweights and measures. The violation is punished by a fine of up toRs.25, 000\/-,\nand for the consecutive crime, by imprisonment up to six months, or by fine, or\nboth.<\/li>\n\n\n\n<li>Section\n32 of the Act penalises the product&#8217;s importer, packer for failure to register\nunder the Act.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The Legal Metrology Act, 2009 is the primary legislation that deals with weights and measurements.
