Offices, Godowns,\nstorerooms, workspaces, or warehouses used for trade or business, regardless of\nwhether they are situated on the same ground.<\/li>\n<\/ul>\n\n\n\nThe\nShops and Establishments Act does not apply to some businesses such as:<\/strong><\/p>\n\n\n\nDue\nto the fact that the Shops and Establishment Act exempts some enterprises, the\nfollowing establishments and shops are often not eligible for Shops and\nEstablishment Business Registration:<\/p>\n\n\n\n
\n- Apart from corporations,\nthere are federal agencies, state governments, and local governments.<\/li>\n\n\n\n
- Each business or organization\nthat travels by sea, railways, or air must make light, power, and water\naccessible to the general people.<\/li>\n\n\n\n
- Dining carriages on trains.<\/li>\n\n\n\n
- Food Corporation of India\nEstablishments (FCI).<\/li>\n\n\n\n
- Establishments for\nmaintaining or treating the disabled, ill, or mentally ill.<\/li>\n\n\n\n
- Offices of a financial\ninstitution.<\/li>\n<\/ul>\n\n\n\n
There\nare different business or establishment exemptions in different states. The\ncompanies and establishments that are exempt from the Shops and Establishments\nAct have been independently designated by the state governments. In light of\nthis, the government of the state may choose to exclude from the need to\nregister, among other businesses and organizations, establishments that are not\nincluded in the preceding list.<\/p>\n\n\n\n
The\nfollowing companies are exempt from the Act’s provisions governing their\nopening and closing hours, as well as their observance of weekly holidays: <\/p>\n\n\n\n
\n- Shops that offer medical,\npharmaceutical, surgical, or other supplies. <\/li>\n\n\n\n
- Societies, lodging\nfacilities, residential hotels, and accommodations connected to educational\ninstitutions. <\/li>\n\n\n\n
- Barbershops and salons.<\/li>\n\n\n\n
- Shops that sell fish, meat,\neggs, poultry, bread, dairy products, sweets, confectionery, ice cream,\nchocolates, fruits, prepared meals, vegetables, flowers, and green vegetation. <\/li>\n\n\n\n
- Shops that provide the\nnecessary goods for funerals, cemeteries, or cremations.<\/li>\n\n\n\n
- Shops that allow customers\nto consume tobacco, cigarettes or alcoholic beverages on the premises of the\nstore. <\/li>\n\n\n\n
- Shops that sell periodicals\nand newspapers, news agencies, and newspaper editing departments.<\/li>\n\n\n\n
- Theaters, cinemas, public\nentertainment venues, and kiosks or concession stalls that are related to\ntheatres, cinemas, and public entertainment venues.<\/li>\n\n\n\n
- Fuel is sold at the pump at\nestablishments.<\/li>\n\n\n\n
- Shops located inside garrisons,\nregimental institutions, and soldier canteens located within cantonments.<\/li>\n\n\n\n
- Tanneries.<\/li>\n\n\n\n
- If the major purpose of the\ndisplay is not to generate revenue from retail sales, then such sales should be\nconsidered incidental or secondary.<\/li>\n\n\n\n
- Mills that produce oil and\nwheat but are not registered under the Factories Act of 1948.<\/li>\n\n\n\n
- Establishments that make\nuse of various forms of information technology.<\/li>\n\n\n\n
- Centers for the\ninvestigation of the pandemic and other diseases via the use of biotechnology.<\/li>\n<\/ul>\n\n\n\n
