manufacturers and dealers act\nupon the rules and regulations of LMPC and Legal Metrology. The following are\nthe activities of the auditor that undergoes legal metrology auditing.<\/p>\n\n\n\n<ol>\n<li>The auditor\u2019s first and foremost\nduty is to check and verify whether the product and package of the commodities\nare in accordance with the compliance of the Legal Metrology Packaged\nCommodities rules.<\/li>\n\n\n\n<li>The auditor verifies whether the\nmanufacturer and dealers have complied with the rules of LMPC regulation along\nwith other regulations such as the Companies Act, Environment Impact\nAssessment, etc.,<\/li>\n\n\n\n<li>Verification of existing license\nand other related documents under the Legal Metrology Act.<\/li>\n\n\n\n<li>Verification of other complete\ncompliance under LMPC.<\/li>\n\n\n\n<li>Verification of warehousing\nlicense and others.<\/li>\n\n\n\n<li>If the firm is an E-commerce\ncompany, then verification and review of the E-commerce registration\ncertificate and license certificate.<\/li>\n\n\n\n<li>The auditor checks under Legal Metrology (numeration) rules, 2011. Checking\nfor the manner in which the number shall be written is mandatory.<\/li>\n\n\n\n<li>Under Legal Metrology\n(approval of model) rules, 2011, the auditor checks whether the authorities\nduly approve the model.<\/li>\n\n\n\n<li>Verifies the\ncompliance of stamping of weight and measure under the Legal Metrology Act.<\/li>\n\n\n\n<li>Whether the compliance related to the principle display panel is\ndone correctly as per the LMPC rules.<\/li>\n\n\n\n<li>Checks the LM (national\nstandards) rules to verify that all products are packaged based on the base\nstandards such as mass, volume, length etc.<\/li>\n\n\n\n<li>Verification of manufacturing and printing of labels.<\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Inspection_of_the_Officer_Regarding_the_Quantity_and_Errors_in_the_Package\"><\/span>Inspection of the Officer Regarding the Quantity and Errors in the Package<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The LMPC inspection from Legal metrology officers can be done in\nthe form of a quality check or test in relation to the net quantity contained\nin a package. It shall be carried out at the premises of the retail or\nwholesale dealer or wholesale dealer in the following situations.<\/p>\n\n\n\n<ol>\n<li>The inspection by the director, the Controller, or any other legal metrology officer is done after receiving the compliant that the package sold or delivered to the complainant where the consumer does not contain the quantity declared on the package&#8217;s label.<\/li>\n\n\n\n<li>The director, Controller, or any other legal metrology officer suspects that any package has been damaged or opened or that any leakage of the commodity contained in the package.<\/li>\n\n\n\n<li>If the director or the Controller of any legal metrology officer found any package or any label affixed in the package does not bear on all or any&nbsp;LMPC declaration on the package, which is required to be made under the rules of the LMPC act and in case the manufacturer does not comply with the legal metrology packaging rules the inspection will be based on the violation of the law.<\/li>\n\n\n\n<li>The inspection is done based on a specific test that was carried out according to the provision of the Act. The following are the verifications done by the Controller or any other legal metrology officer.\n<ul>\n<li>The inspection is done based on the quantity contained in the package relates to the quantity declared on the package or any label affixed to the package.<\/li>\n\n\n\n<li>Whether the quantity contained in the package is less than the declared quantity in the package.<\/li>\n\n\n\n<li>Inspects if the deficiency is more than the minimum permissible error that any commodity can have.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>Suppose the Controller or any other legal metrology officer finds in a test. In that case, he carries that the dealer has more than the maximum permissible error or deficiency in the package kept for sale, distribution, or delivery at the premises of the retail or wholesale dealer. In such cases, the legal metrology officer shall seize such a package and take appropriate action against the offender, who may be the retail or wholesale dealer.<\/li>\n\n\n\n<li>During the inspection, if the officer found the package bearing the word &#8220;when packed&#8221;, no      action shall be taken against the retail or wholesale dealer. If they are satisfied after the entire necessary test that the deficiency in the net quantity contained in the package is due to environmental conditions.<\/li>\n\n\n\n<li>In the inspection procedure, if it is found that any package or any label affixed in the package does not declare the required information to be made on the package, it shall be lawful for the Controller or any other legal metrology officer to make a such inquiry about the manufacturers.<\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_objective_of_LMPC_Inspection_and_Audit_for_Legal_Metrology_Laws\"><\/span>The objective of LMPC Inspection and Audit for Legal Metrology Laws<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\nfollowing are some objectives for conducting LMPC inspection and audit of\nweights and measures and packaged commodities.<\/p>\n\n\n\n<ul>\n<li>The effective, timely LMPC inspection and audits conducted help to establish the preparation of Annual plans with an imperative perspective.<\/li>\n\n\n\n<li>The Auditing ensures mandatory licensing, Calibration, Verification, Stamping, and Enforcement of applicable laws in the country, indirectly assuring the company&#8217;s credibility among the customers.<\/li>\n\n\n\n<li>The timely LMPC inspection and audit monitoring and evaluations ensure no defects or faults in the weights and measurement instruments.<\/li>\n\n\n\n<li>The Auditing affects the financial management of the Legal Metrology Department for being efficient, economically feasible, and effective in accordance with the financial provisions.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Understanding_the_Legal_Metrology_Enforcement_Process_%E2%80%93_LMPC_Inspection_and_Audit\"><\/span>Understanding the Legal Metrology Enforcement Process &#8211; LMPC Inspection and\nAudit<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\nfollowing are the enforcement processes the Legal metrology department must\nensure while performing LMPC inspection and audit.<\/p>\n\n\n\n<p><strong>Steps for Licencing of Manufacturer,\nrepairer and Dealer of Weights and Measures:<\/strong><\/p>\n\n\n\n<p>The following are the steps that an LMPC\ninspection and audit person should consider while auditing the license of the\ndealers.<\/p>\n\n\n\n<ul>\n<li>Every\nmanufacturer, repairer, or dealer in weight or measure must apply to the\nController legal metrology or any other officer authorised on his behalf in the\nissuance of such licence. <\/li>\n\n\n\n<li>Every\nmanufacturer or repairer, or dealer in weight or measure is necessary to make\nan application for the renewal of a licence within thirty daysprior to the validity expiry of the earlier\nlicence. <\/li>\n\n\n\n<li>The\nlicence issued to a manufacturer, repairer or dealer shall be in the\nappropriate form mentioned in Schedule III of the Act.<\/li>\n\n\n\n<li>The licence issued to a manufacturer, repairer, or\ndealer shall be valid for a minimum of one to a maximum of five years after\nthat when such dealers have to renew their license. <\/li>\n\n\n\n<li>The\nfee for the alteration of a licence or the issue of a duplicate licence shall\nbe one-half of the licence fee as specified in Schedule IVof the Act.<\/li>\n\n\n\n<li>The\nController or any other officer as may be authorized by him on his behalf as\nper Schedule 5 of the Act shall maintain a register of licenced manufacturers,\ndealers and repairers for verification\npurposes.<\/li>\n\n\n\n<li>The manufacturer \/ repairer \/ dealer licenced under the Act\nshould maintain such workshop \/ equipments \/ tools\/ registers etc., as per the\nconditions of the licence.<\/li>\n\n\n\n<li>Every repairer licenced under the\nLegal Metrology Act should furnish a security deposit to their respective State\nGovernment for each licence.<\/li>\n\n\n\n<li>The licence issued or renewed under this Act shall be\ndisplayed in a proper place in the principal premises where the licensee\ncarries on business. <\/li>\n\n\n\n<li>Under this Act, a licence issued or renewed shall not be\nsalable nor transferable.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conditions_for_Suspension_and_Cancellation_of_the_Licence_Granted\"><\/span>Conditions for Suspension and Cancellation of the Licence Granted<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Following are the conditions for suspension\nand cancellation of the license granted:<\/p>\n\n\n\n<ul>\n<li>The Controller or any\nother officer on his behalfmay suspend the license if he\nbelieves that the holder of any licence issued, renewed or continued under this\nAct has got the license through false material facts or has contradicted any\nprovision of the Act or order this Act.<\/li>\n\n\n\n<li>The Controller or any such\nother officer authorized by him on his behalf may cancel the license if he\nthinks fit after making such inquiry with the license holder who has\nmade any false or incorrect statement of the nature referred to in sub-rule (1) of the Actor has\ncontravened any law or order referred to in that subsection. <\/li>\n\n\n\n<li>Every person, manufacturer, or dealer whose LMPC licence has\nbeen suspended shall immediately stop functioning as a licensee and shall not\nresume business as a license holder until the order of such suspension has\nbeen, or stands, vacated. <\/li>\n\n\n\n<li>The owner whose licence has been suspended or cancelled\nshould surrender the such licence to the authority.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Are_The_Records_To_Be_Maintained_By_Manufacturers_As_Per_The_Rules\"><\/span>What Are The Records To Be Maintained By Manufacturers As Per The Rules?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Every manufacturer,\nrepairer, or dealer in weight or measure licenced under the Act should maintain\nrecords and registers and submit such periodical reports\/returns to the\nauthority.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Necessary_Periodical_Interval_for_the_Authorities_Verification_of_Weights_or_Measures\"><\/span>Necessary Periodical Interval for the Authorities&#8217; Verification of Weights or\nMeasures<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul>\n<li>The legal metrology officer shall\nverify and stamp every weight or measure used in any transaction. <\/li>\n\n\n\n<li>Every weight or measure verified and stamped in situ shall be\ndismantled and re-installed.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Verification_and_Inspection_of_Weights_or_Measures\"><\/span>Verification and Inspection of Weights or Measures <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The following are the steps that an LMPC\ninspection and audit person should consider while inspecting the weights and\nmeasures of the dealers.<\/p>\n\n\n\n<ul>\n<li>Every person or manufacturer who is using any weight or\nmeasure for a transaction should present such weight or measure for\nverification.<\/li>\n\n\n\n<li>To verify the weight or measure referred to in sub-rule (2)<strong>, <\/strong>the user should provide\nsuch facilities in his premises as specified by the Controller. <\/li>\n\n\n\n<li>Every weight or measure presented for verification by the\ndealer shall be complete. <\/li>\n\n\n\n<li>The weight or measure should be verified in a clean\ncondition. The Legal Metrology officer shall require the proprietor or user to\nmake necessary arrangements if necessary. <\/li>\n\n\n\n<li>During the inspection, the legal\nmetrology officer shall cancel the stamping on any weight or measure if any\nweight or measure due for re-verification has yet to be submitted. <\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Stamping_of_Weights_and_Measures\"><\/span>Stamping of Weights and Measures<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\nLegal Metrology officerwill stamp every weight or measure if satisfied after testing\nand verifying that the weight or measure is to the standards established by the\nAct.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Disposal_of_Seized_Weights_And_Measures_to_the_Respective_Persons\"><\/span>Disposal of Seized Weights, And Measures to the Respective Persons<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The following are the steps that an LMPC\ninspection and audit person should consider while auditing the papers of the\ndealers<\/p>\n\n\n\n<ul>\n<li>Any unverified weight or measure shall be returned to the\nperson or manufacturer from whom such weight or measure was seized if that\nperson gets the same verified and stamped within 15 daysof the return.<\/li>\n\n\n\n<li>If the officer seizes any weight or measure or document or\nthing or goods seized and detained under section 15 of the Act, which is to be\nthe subject of proceedings in a court, it shall be dealt with in accordance\nwith the orders of the court.<\/li>\n\n\n\n<li>Suppose any goods seized under section 15 of the Act are\nsubject to speedy natural decay. The legal metrology officer with the goods\nshall obtain the signature of the trader who committed the offence.<\/li>\n\n\n\n<li>When the goods seized under sub-section (1) of Section 15 of\nthe Act are contained in a package, and the package is false or not comply with\nthe provisions of the Act, which is subject to speedy or natural decay, the\nlegal metrology officer may dispose of the goods in such package under the\nprovisions of sub-rule (3)<\/li>\n\n\n\n<li>Where the goods seized under sub-section (1) of Section 15 of\nthe Act are not subject to speedy decay, the legal metrology officer may retain\nthe package for the purpose of prosecution under this Act after giving the\ntrader a notice of such seizure. In cases which are not to be the subject of\nproceedings in a court, after the expiry of sixty days of its seizure, the\nController may deal with it as directed by the court.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Validity_of_Weights_or_Measures_Duly_Stamped_By_the_Authority\"><\/span>Validity of Weights or Measures Duly Stamped By the Authority<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul>\n<li>A weight or measure duly verified and stamped under this Rule\nshall be deemed to conform to the standards at every place within the State in\nwhich it is stamped.<\/li>\n\n\n\n<li>No weight or measure that is duly verified and stamped under\nthis Act shall require to be re-stamped for the reason that it is used at any\nplace within the State other than the place at which it was initially verified\nand stamped.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Qualifications_of_Legal_Metrology_Officer\"><\/span>Qualifications of Legal Metrology Officer<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>A person who is appointed\nas a legal officer should possess the following qualification.<\/p>\n\n\n\n<ul>\n<li>The person should be a graduate of a recognized university in\nScience, technology or engineering or holds a recognized diploma in engineering\nwith three years of professional experience.<\/li>\n\n\n\n<li>The person should be able to speak, read and write at least\none of the regional languages of the State. <\/li>\n\n\n\n<li>The person appointed to the Legal Metrology Officer post must\nsuccessfullycomplete the\nbasic training course at the Indian Institute of Legal Metrology established by\nthe Federal Government under section 11 of the Act.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Provisions_Relating_To_the_Use_of_Weights_Measure\"><\/span>Provisions Relating To the Use of Weights Measure<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The following are the steps that an LMPC\ninspection and Audit should follow while inspecting the usage of weights and\nmeasures.<\/p>\n\n\n\n<ul>\n<li>Every weight or measure shall be used in a clean condition\nand with a proper lighting arrangement. <\/li>\n\n\n\n<li>To ensure a proper check of the accuracy of a weighing\ninstrument, the user shall keep at the site of each weighing instrument duly\nverified and stamped weights equal to one-tenthof the instrument&#8217;s capacity, and the consumer can also check the\naccuracy of the weighing instrument. <\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Penalty_for_Contravention_of_Rules\"><\/span>Penalty for Contravention of Rules<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Whoever contravenes any\nprovision of these rules or does not abide by the rules and regulation of the\nAct, if that contravention of which no punishment has been separately provided\nin the Act, then they shall be punished with a fine up to Rs.5000. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The purpose of the LMPC Act is to ensure that the manufacturer, importer or dealers should comply with the rules and regulations laid down under the Act to keep themselves away from legal metrology disputes and penalization. The authorized Legal Metrology officer has the right to inspect the unit as per the complaint from the customer or to provide a license to the dealer.
