These courts are established under the Consumer Protection\nAct, which was enacted in 1986 in India and has been recently updated in 2019.<\/p>\n\n\n\n<p>The\n<strong>Consumer\nProtection Act<\/strong><sup><a class=\"text-primary\" href=\"https:\/\/consumeraffairs.nic.in\/sites\/default\/files\/CP%20Act%202019.pdf\"><strong>[1]<\/strong><\/a><\/sup> aims to protect the interests of consumers by\nproviding them with an effective mechanism for seeking redressal for any\ngrievances they may have against manufacturers, service providers or sellers.\nThe Act also provides for the establishment of three-tier consumer forums,\ndepending on the value of the dispute, as follows:<\/p>\n\n\n\n<ul><li><strong>District Consumer Dispute Redressal Forum (DCDRF):<\/strong><\/li><\/ul>\n\n\n\n<p>This\nis the first level of consumer forum established in each district of the\ncountry. It has the jurisdiction to entertain complaints where the value of\ngoods or services and compensation claimed does not exceed Rs. 1 crore. The\nforum is headed by a President, who is a District Judge, and two other members,\nwho are appointed by the State Government.<\/p>\n\n\n\n<ul><li><strong>State Consumer Dispute Redressal Commission (SCDRC):<\/strong><\/li><\/ul>\n\n\n\n<p>This\nis the second level of consumer forum established in each state of the country.\nIt has the jurisdiction to entertain complaints where the value of goods or\nservices and compensation claimed exceeds Rs. 1 crore but does not exceed Rs.\n10 crores. The commission is headed by a President, who is a retired Judge of\nthe High Court, and two other members, who are appointed by the State\nGovernment.<\/p>\n\n\n\n<ul><li><strong>National Consumer Dispute Redressal Commission (NCDRC):<\/strong><\/li><\/ul>\n\n\n\n<p>This\nis the highest level of consumer forum established at the national level. It\nhas the jurisdiction to entertain complaints where the value of goods or\nservices and compensation claimed exceeds Rs. 10 crores. The commission is\nheaded by a President, who is a retired Judge of the Supreme Court, and four\nother members, who are appointed by the Central Government.<\/p>\n\n\n\n<p>The\nconsumer forums are quasi-judicial bodies and have the powers of a civil court.\nThey are not bound by the strict rules of evidence and procedure that apply in\nregular courts, and can adopt a more flexible and consumer-friendly approach.\nThe forums are designed to provide relief to consumers in a hassle-free manner\nand are known for providing speedy resolution to disputes. The legal notice should be sent through a registered post with acknowledgment due or through email.<\/p>\n\n\n\n<ul><li><strong>Approach a Consumer Forum:<\/strong><\/li><\/ul>\n\n\n\n<p>If\nthe seller or service provider does not respond to your legal notice or does\nnot provide satisfactory redressal, you can approach a consumer forum. The\nConsumer Protection Act provides for the establishment of three-tier consumer\nforums, namely District Consumer Dispute Redressal Forum, State Consumer\nDispute Redressal Commission, and National Consumer Dispute Redressal\nCommission, depending on the value of the dispute.<\/p>\n\n\n\n<ul><li><strong>File a Complaint:<\/strong><\/li><\/ul>\n\n\n\n<p>To\nfile a complaint with the consumer forum, you need to fill out a complaint form\nand attach relevant documents such as the legal notice, purchase receipt,\nwarranty card, and any other relevant documents. The complaint form should be\nfiled in the consumer forum that has jurisdiction over the matter.<\/p>\n\n\n\n<ul><li><strong>Attend the Hearing:<\/strong><\/li><\/ul>\n\n\n\n<p>Once\nthe complaint is filed, the consumer forum will issue a notice to the opposite\nparty asking them to file a written reply. The forum will then fix a date for\nthe hearing, and both parties will be required to attend the hearing. You\nshould attend the hearing along with your advocate, and present your case\nbefore the forum.<\/p>\n\n\n\n<ul><li><strong>Await Judgment:<\/strong><\/li><\/ul>\n\n\n\n<p>After\nhearing both parties, the forum will pass a judgment. If the judgment is in\nyour favour, the seller or service provider will be required to comply with the\norder within the specified time.
