As it involves\nreligion, many personal laws have been enacted to decide all the provisions\nrelated to marriage. A marriage between people belonging to Hindu, Jain, and\nSikh or Buddhist communities is governed by the Hindu Marriage Act. For people\nnot defined in the above-stated Act, the Special Marriage Act has been enacted\nfor the registration of marriage. As per Section 7 of the Hindu Marriage Act, a\nmarriage is considered to be complete when both the bride and the groom take 7\nsteps around the holy fire together. After the completion of all the religious\nacts involved in a marriage, the parties should register their marriage.<\/p>\n\n\n\n<p>There are a lot of\nbenefits to marriage registration. After the proper evaluation of the [arties\nand the submitted documents, the concerned authority provides a marriage\ncertificate to the parties as proof of their legal and valid marriage. For\nconstituting a legal marriage, parties should not marry people from sapinda or\nprohibited relationships unless there lays a contrary custom existing in their\nrespective community. A marriage registration has proven to be beneficial in\nvarious situations and acts as a legal requirement for changing of name,\npassport, etc.<\/p>\n\n\n\n<p>Many judgments\nhave been laid down by the judicial system of India which have stated the\nimportance of marriage registration. The Hindu Marriage Act lays down provisions\nwith regard to marriage registration under Section 8. There is no such mandate under the personal marriage laws.\nMarriage is still a valid marriage if it is been completed following all the\nnecessary rituals stated in the personal laws. As per Section 8 of the Hindu\nMarriage Act, 1955 the provisions related to the registration of marriage have\nbeen stated. Such provisions under the Act do not put a mandate on the parties\nto compulsorily get their marriages registered.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Section_8_of_the_Hindu_Marriage_Act\"><\/span>Section 8 of the Hindu Marriage\nAct<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Section 8 provides\nclauses related to the marriage registration. The clauses state that:<\/p>\n\n\n\n<ul>\n<li>As per the Act, the state\ngovernment has the authority to make rules for the parties to a marriage for\nregistration of their marriage.<\/li>\n\n\n\n<li>The Act puts a\nresponsibility on the state government to ensure that the parties are following\nthe rules made by the state government. The section provides provisions with\nregard to punishment for contravention of the rules. The government can impose\na penalty of Rs. 25 on the parties.<\/li>\n\n\n\n<li>The section lays a duty\non the registrar to inspect the marriage of a person who has applied for\nregistration and find out sufficient evidence to prove a marriage to be a valid\nmarriage.<\/li>\n<\/ul>\n\n\n\n<p>It is mandatory that both parties to the marriage must be present at the time of registration along with witnesses. They do not accept details of traditional marriage as valid proof. <\/li>\n\n\n\n<li><strong><a href=\"https:\/\/corpbiz.io\/marriage-registration\">Marriage registration<\/a><\/strong> is helpful in cases of claiming bank deposits or insurance deposits if such a person dies without stating a name for the nominee.<\/li>\n\n\n\n<li>If the female wishes to change her middle name after her marriage, a marriage certificate is necessary.<\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Requirements_for_Marriage_Registration_in_India\"><\/span>Requirements for Marriage Registration in India<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>In India, marriages\nare governed through personal laws and other laws governing inter-caste\nmarriages. These are:<\/p>\n\n\n\n<ol>\n<li>The Hindu Marriage Act, 1955 for the people belonging to the Hindu religion<\/li>\n\n\n\n<li><strong>The Special Marriage Act, 1954<\/strong><sup><a class=\"text-primary\" href=\"https:\/\/www.indiacode.nic.in\/bitstream\/123456789\/15480\/1\/special_marriage_act.pdf\"><strong>[1]<\/strong><\/a><\/sup> is for the people willing to register an inter-caste marriage.<\/li>\n<\/ol>\n\n\n\n<p>In order to\ncomplete the registration process, there are certain requirements and documents\nthat the parties need to carry with them for the registration of their\nmarriage. These are:<\/p>\n\n\n\n<ol>\n<li>The\napplicants are required to submit the application form to the marriage\nregistrar\u2019s office for registration of their marriage. It should contain the\nproper names and addresses of both parties. <\/li>\n\n\n\n<li>Documents\nsuch as Aadhar card, voter ID, PAN Card, or electricity bill, etc for proving\nthe residential address and birth certificate or a passport as birth proof must\nbe submitted before the authority. <\/li>\n\n\n\n<li>As\nper the prevailing law, there is well-defined age for the parties to get\nmarried. The age of the female should be 18 years and a male should be at least\n21 years of age to marry. This is the minimum age to make a marriage valid and\nlegal.<\/li>\n\n\n\n<li>Both\nparties are required to submit passport-size photographs to the authority.<\/li>\n\n\n\n<li>The\nwitnesses and guardians of both parties shall be required to be present at the\ntime of the registration.<\/li>\n\n\n\n<li>If\nthe parties to a marriage are willing to register their marriage under the\nSpecial Marriage Act, they are required to submit an ID proving their present\nresidential address.<\/li>\n\n\n\n<li>In\ncase the parties are willing to register their marriage under the Hindu\nMarriage Act, a fee of Rs.100 is required to be submitted before the registrar\nfor marriage registration. For parties who want to get their marriage\nregistered under the Special Marriage Act, then the amount of fee to be\nsubmitted is Rs. 150.<\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Marriage_Certificate\"><\/span>Marriage Certificate<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>After the competent authority verifies the authenticity of the application form and the required documents submitted by the parties to a marriage, the authority issues a marriage certificate to the parties. Such certificate is a legal proof of one\u2019s marriage and is useful for several purposes.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Consequences_of_Not_Registering_Marriages_in_India\"><\/span>Consequences of Not Registering Marriages in India<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Even though\nregistration of marriage is not compulsory, the parties must ensure that they\nget their marriages registered. If parties do not get their marriages\nregistered, they might suffer a lot of losses or disadvantages. Registration of\nmarriage is important as it becomes valid and recognized in the eyes of law.\nSeveral issues being faced by the females are:<\/p>\n\n\n\n<ul>\n<li>Child marriage<\/li>\n\n\n\n<li>Marital rape against their consent <\/li>\n\n\n\n<li>Domestic violence and cruelty <\/li>\n\n\n\n<li>Mental and physical harassment, etc<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The Supreme Court has mandated marriage registration. There should be amendments made to the provisions of personal laws for making the registration of marriage compulsory or a new Act should be enacted containing the procedure for compulsory registration of marriages. Marriage should be registered by the citizens who have got married in India for the benefit and the betterment of society.
