It is usually\npreferred and suggested that before approaching the court, the party must send\na legal notice providing a reasonable time for the opposite party to make a\nrational decision. There are certain grounds on which a party to a marriage\nwishes to send a divorce notice to the other party. One such ground where the\nhusband sends a divorce notice to wife when the wife leaves without any valid\nreason. The aggrieved party being the husband reaches the court to send an\norder to bring her wife back home as defined under Section 9 of the Hindu Marriage Act and if\nshe doesn\u2019t come back within a defined time period, then it becomes a ground\nfor divorce and husband is eligible to seek divorce from his wife. The court after considering all the facts and\nreasons stated by the husband can send an order stating the wife to come back\nto his matrimonial home.<\/p>\n\n\n\n<p>Before approaching the court to pass an\norder under Section 9 of the Act, the husband can send a well-drafted divorce notice\nto wife and give her a chance to return to him and solve the problems between\nthem.<\/p>\n\n\n\n<p>The burden of proof for such withdrawal\nfrom the society of the husband lies on the wife who has left his husband\u2019s or\nthe matrimonial house and started living at his paternal home. If the wife does\nnot honour with the clauses stated in the notice, the husband can approach the\ncourt.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Order_under_Section_9\"><\/span>Order under Section 9<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The husband can file a suit for\nrestitution of conjugal rights before the competent civil court, and the court\nafter considering the valid arguments of the husband passes a decree against the\nwife to return back to home.<\/p>\n\n\n\n<p>The court while considering all the\narguments made by the wife must ensure that the details mentioned in the\npetition are true and the intent of the husband is not malicious. The court\nalso provides an opportunity to be heard to the wife following the principles\nof natural justice. This will help the court to find out that were there any\nvalid reasons for the wife to leave the matrimonial house or not.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Decree_for_Restitution_of_Conjugal_Rights\"><\/span>Decree for Restitution of Conjugal Rights<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>If the court passes a decree for restitution\nof conjugal rights, the wife is under an obligation to follow the orders of the\ncourt. If the wife does not honor the decree for restitution of conjugal rights\nwithin the time period of one year from the date of the decree, it becomes a\nground for husband to seek divorce.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Divorce_Notice_to_Wife\"><\/span>Divorce Notice to Wife<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>As per Section 13 (1A) of <strong>the Hindu Marriage Act<\/strong><sup><a class=\"text-primary\" href=\"https:\/\/highcourtchd.gov.in\/hclscc\/subpages\/pdf_files\/4.pdf\"><strong>[1]<\/strong><\/a><\/sup>, when parties to\nthe marriage do not resume the cohabitation after the decree for restitution of\nconjugal rights has been passed and a time period of more than one year has\nbeen passed, it becomes a ground for divorce.<\/p>\n\n\n\n<p>When it has been found by the court that\nthe party against whom a decree has been passed does not obey the decree, the\nhusband can initiate the process of divorce. The first step to initiate the\nprocess is serving a divorce notice to wife showing his intentions to terminate\nthe marriage or reconcile the marriage.<\/p>\n\n\n\n<p>The aggrieved party should contact a legal\nprofessional who is an expert in matrimonial matters to draft a detailed legal\ndivorce notice containing:<\/p>\n\n\n\n<ul><li>Personal details and\naddress of the parties<\/li><li>Reasons for applying for\ndivorce and a valid recourse<\/li><li>Challenges being faced by\nthe parties to the marriage<\/li><li>Details of the decree for\nrestitution of conjugal rights<\/li><li>The notice should be duly\nsigned along with the date and it should be printed on the letterhead of the\nadvocate.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Procedure_of_Serving_Notice\"><\/span>Procedure of Serving Notice<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ol><li>The\naggrieved party should appoint an advocate for drafting a divorce notice.<\/li><li>It\nshould contain all the basic and important details related to the divorce.<\/li><li>The\nadvocate should consider all the facts narrated by the party and draft case\nnotes.<\/li><li>With\nthe help of such notes, the advocate should draft the legal notice duly\naddressed to the intended party.<\/li><li>The\nadvocate shall mention a reasonable time in the notice for the wife to send a\nreply to the divorce notice served. <\/li><li>The\nwife has the option to send a reply to such notice for initiation of the\ndivorce proceedings by filing a petition before the court or trying to resolve\nthe matter by way of discussion or mutual understanding.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>If the wife agrees to return back to home after the notice or a decree has been sent to her for restitution of conjugal rights, then the purpose of serving such notice or decree by the court is fulfilled.
