The study of EIA for CMSWMF\nintegrates the environmental concerns of various activities into the processes\nof decision-making.<\/p>\n\n\n\n<p>The Project\/activity is covered\nunder category B of item 7 (i) Common Municipal Solid Waste Management Facility\n(CMSWMF)&#8217; of the Schedule to the EIA Notification, 2006 and its amendments, and\nrequires appraisal (EC) at State Level (SEIAA). However, due to the absence of\nSEIAA\/SEAC, the proposal has been appraised at the Central level by sectoral\nEAC.<\/p>\n\n\n\n<p>The\nfollowing is the categorisation for project that requires EIA\nfor Common Municipal Solid Waste Management Facility for obtaining prior Environmental\nClearance:<\/p>\n\n\n\n<ul><li><strong>Category \u2018B\u2019 projects<\/strong>:\nRequires an EIA for CMSWMF (In case of\nLandfill disposal site)<\/li><\/ul>\n\n\n\n<p><strong>Note: <\/strong>In\ncase of General conditions, the project will be treated as Category \u201cA\u201d. <\/p>\n\n\n\n<div class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>As\nper EIA Notification 2006 and its subsequent OM and circular dated 7.11.2017 Expert\ngroup revisited the process of obtaining prior EC regarding:<\/p>\n\n\n\n<ul><li><strong>Applicability of EC:<\/strong>\nProposing a new Landfill Disposal Site<\/li><li><strong>Non-Applicability of EC: <\/strong>Door-to-door\ncollection<strong>, <\/strong>segregation, composting, refused derived fuel (RDF)<\/li><\/ul>\n\n\n\n<p>Locating a landfill site or municipal solid waste (MSW) disposal site is a contentious issue, and there is a tendency to locate them far from the habitation but near forests, rivers, ponds, wetlands and low-lying areas that are critical from environmental points, of view, it may not be appropriate to exempt this activity of MSW disposal site or landfill site from the requirement of prior EC.<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" width=\"1024\" height=\"489\" id=\"The_Objective_of_Conducting_EIA_for_CMSWMF\"><\/span>The Objective of Conducting EIA for CMSWMF<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li>The major purpose of this report\nis to prepare an environmental statement on the assessment of the likely environmental\nimpacts of the proposed Integrated Municipal Solid Waste Management Facility.<\/li><li>Management of solid waste is of\ngrowing concern to the general public at large, local authorities and business\ncommunities in cities and towns across India. In order to comply with Municipal\nSolid Waste (Management and Handling) Rules, 2016, proper collection,\nsegregation, recycling and disposal are much needed.<\/li><li>Conducting an EIA for Common\nMunicipal Solid Waste Management Facility develop mitigation measures so as to minimize\npollution, environmental disturbance and nuisance during the operation period\nof the proposed project.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Clearance_and_NOCs_Required_For_Conducting_EIA_for_CMSWMF\"><\/span>Clearance and NOCs Required For Conducting EIA for CMSWMF<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ol><li>Forest Clearance<\/li><li>Wildlife Clearance (NBWL)<\/li><li>CRZ Clearance (Coastal Regulation Zone) as per issued notification 2011<\/li><li>Central Ground Water Authority (CGWA) NOC<\/li><li>Forest Certificate<\/li><li>Site-specific conservation plan &amp; Wildlife Management Plan (in case of the presence of schedule-I species in the study area) approved by the chief wildlife warden.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Applicable_Laws_Legislations\"><\/span>Applicable Laws &amp;\nLegislations<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li>Municipal Solid Waste (M&amp;H)\nRules, 2016<\/li><li>Plastic waste management Rules\n2016 amended in 2022<\/li><li>The Hazardous Waste (M&amp;H)\nRules, 1989<\/li><li>Hazardous Waste (Management,\nHandling &amp; Transboundary Movement) Rules 2008<\/li><li>Environment (Protection) Act,\n1986<\/li><li>EIA Notification, 2006<\/li><li>Air (P&amp;CP) Act, 1981<\/li><li>Water (P&amp;CP) Act, 1974<\/li><li>Forest (Conservation) Act, 1988<\/li><li>Wildlife (Conservation) Act, 1972<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"How_to_Carry_Out_EIA_for_CMSWMF\"><\/span>How to Carry Out EIA for CMSWMF<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Submission\nof EIA for Common Municipal Solid Waste Management Facility on the basis of approved\nToR letter issued by SEAC\/SEIAA further requires prior EC as per EIA\nNotification.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Stages Involved In the EIA Process<\/h3>\n\n\n\n<ul><li><strong>Screening-\n<\/strong>This stage aware the\nproject proponent of their obligations before deciding on the budget, project\ndesign and execution plan. Also, decides if an EIA is required or not.<\/li><li><strong>Scoping<\/strong>\n\u2013 To identify the environmental impacts of the project and defines the scope of\nstudy in the EIA report.<\/li><li><strong>Term\nof Reference<\/strong> (ToR)\u2013 After the scoping stage, the project\nproponent\/consultant applies at the state level (SEIAA\/SEAC). It consists of\nthe scope of the project and the timeline for carrying out an EIA.<\/li><li><strong>Draft\nEnvironmental Impact Assessment <\/strong>Report \u2013 The draft report\nof an EIA includes all the baseline details of the project, its impacts and the\ndevelopment of mitigation measures accordingly.<\/li><li><strong>Public\nConsultation <\/strong>\u2013 This stage plays a major role in the entire\nstage of the EIA for CMSWMF. A public hearing conducts at the project site, and\nthe proposal is presented in front of the public for their opinion and views on\nthe existing or proposed project.<\/li><li>Final EIA \u2013 Final EIA for CMSWMF is\nprepared after the incorporation of PH minutes by the Pollution control board\nand submitted to the central or state level for review.<\/li><li><strong>Appraisal\n<\/strong>\u2013 It decides whether the Environmental Impact\nAssessment is satisfactory or not.
