{"id":53580,"date":"2023-03-18T12:59:55","date_gmt":"2023-03-18T07:29:55","guid":{"rendered":"https:\/\/corpbiz.io\/learning\/?p=53580"},"modified":"2023-03-18T12:59:56","modified_gmt":"2023-03-18T07:29:56","slug":"importance-of-site-inspection-by-spcb-pcc-during-consent-noc","status":"publish","type":"post","link":"https:\/\/corpbiz.io\/learning\/importance-of-site-inspection-by-spcb-pcc-during-consent-noc\/","title":{"rendered":"Importance of Site Inspection by SPCB\/PCC during Consent NOC"},"content":{"rendered":"\n<p>State Pollution Boards (SPCBs) and Pollution Control Committees are\nresponsible for implementing environmental legislation in the state, such as\nthe Water Act, 1974, the Air Act, of 1981, the Water (Cess) Act 1977 and some\nof the provisions under Environmental (P) Act, 1986 and the rules framed there\nunder like, Biomedical Waste Rules, 1998, Hazardous Waste Rules, 2000, MSW\nRules, 2000, etc. The SPCBs regulate industries, industrial processes and\nbusinesses etc., through the mechanism of consent management. Consent is\nrequired to ensure adherence to pollution control norms. Site inspection by SPCB\/PCC is conducted at two\nseparate stages of business setup, i.e. before establishment (Consent to\nEstablish) and before starting operation (Consent to Operate). While CTE is\nrequired only at the time of establishing a new unit or before carrying out\nexpansion \/modernization in the existing unit, CTO is granted for a specific\nperiod and needs to be renewed every time after expiry.<\/p>\n\n\n\n<p>A system of categorization was introduced in June 2012 on the basis\nof size and resource consumption by an industrial unit. Industries were\ncategorized as red, orange, green and white. In December 2019, the Central Pollution Control Board (CPCB) directed\nthe SPCBs to reset inspection frequencies for industries to once in 3 months\nfor red category (or highly polluting industries) and once in two years for\nlesser-polluting industries. Before this, the frequency of Site inspection by SPCB\/PCC was once in 3 years for\npolluting industries and around seven years for less-polluting industries.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Role_and_Responsibilities_of_SPCBPCC\"><\/span>Role and Responsibilities of SPCB\/PCC<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li>To conduct programmes to\ncontrol and abate water and air pollution in their respective state.<\/li><li>To advise the State Government\non preventing and ablating water and air pollution.<\/li><li>To collect information relating\nto water and air pollution and disseminate it in the interest of pollution\nprevention.<\/li><li>Inspect discharges from\nindustrial units such as sewage, trade effluent, and industrial plants or\nmanufacturing processes.<\/li><li>To Issue an environmental\nno-objection certificate to start an industry<\/li><li>To inspect air pollution\ncontrol areas to assess the quality of air therein and to take steps for the\ncontrol, prevention or abatement of air pollution in such areas.<\/li><li>Regulate and control noise-producing\nand generating sources.<\/li><li>Monitor the compliance of the\nstandards regarding groundwater, ambient air, leachate quality, compost quality\nand incineration standards.<\/li><li>Close down a defaulting\nindustrial plant or withdraw its power or water supply.<\/li><li>To lay down effluent standards\nfor the trade effluents or sewage for the emission of air pollutants.<\/li><li>To evolve the best economically\nviable technology for treatment for sewage and trade effluents.<\/li><li>To collect samples of trade\neffluents, sewage and emissions of air pollutants and to analyze the same for\nspecific parameters.<\/li><li>To perform such other functions\nas may be prescribed by the State Government or Central Pollution Control\nBoard.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"But_What_Is_Inspected_During_Site_Inspection\"><\/span>But What Is Inspected During Site Inspection?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The role of Site inspection by SPCB\/PCC\nis crucial at the time of CTO when the project proponent is ready to start\noperation. To inspect any unit or project, the time and date are conveyed to\nthe applicant. The following factors are taken into account at the time of site\ninspection.<\/p>\n\n\n\n<p><strong>Step 1<\/strong>: At the inspection stage, the site inspector visually inspects the\nplant periphery from the outside first. The officer assesses the emission status\nfrom the stacks and fugitive emissions. He then continues to look on the\neffluent discharge channel for any abnormality in the flow and discharge.<\/p>\n\n\n\n<p><strong>Step 2:<\/strong> Next, after serving the notice of inspection to the occupant or the\nauthorized personnel and after entering the plant, gets the acknowledgement of\nreceipt of notices from the concerned person on the office copy.<\/p>\n\n\n\n<p><strong>Step 3<\/strong>: At the next stage of Site inspection by SPCB\/PCC, the officer will then take stock of the operational status of various operations in the units which are potentially polluting and plan stack &amp; AAQ monitoring activities to be conducted. The officer will then inspect the key process that has the potential for air pollution, fugitive emission or effluent generation, stormwater drainage network or solid waste generation.<\/p>\n\n\n\n<p><strong>Step 4<\/strong>: Next, the officer will verify the water management aspects, solid\nwaste disposal site, e hazardous waste storage etc., to verify the water\nconsumption figures and verify the compliance status of consent conditions.<\/p>\n\n\n\n<p><strong>Step 5: <\/strong>Next the officer will verify the status of the plantation programme\nand get acknowledgement from the representative on notices intended for sample\ncollection for air\/effluent samples that were collected. In the case of ETP,\nthe officer will verify the log book on ETP operation, ascertain the\noperational status, and ask for any other document as deemed necessary to\nascertain the functioning of ETP in the preceding period.<\/p>\n\n\n\n<p><strong>Step 6:<\/strong> After the completion of Site inspection by SPCB\/PCC, a brief\nmeeting is conduct with the senior level officials and management\nrepresentative and apprise them of all major deficiencies\/ lapses\/\nnon-compliances observed during the inspection and suggest remedial measures and\ninstruct them to take immediate corrective actions without waiting for\ncommunication\/ direction from the Board and report the compliances.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Importance_of_Site_Inspection_by_SPCBPCC\"><\/span>Importance of Site Inspection by SPCB\/PCC<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The implemented mode of industrial categorization indicated by red,\norange and green colour codes also defines the extent of inspection and testing\nthe unit will be subjected to. The following sections deal with the importance\nof site inspection for an industrial project or business.<\/p>\n\n\n\n<ul><li>While granting consent, SPCB\nhas to check that the unit has installed all required pollution control\nmeasures as per the category in which they fall and the operation it will\nperform.<\/li><li>The Site inspection by SPCB\/PCC\nalso ensures that any industrial facility doesn\u2019t come up in a\nrestricted\/control area (e.g. air pollution control area) or in areas where\nspecific business activities are prohibited. For instance, many businesses may\nperform unauthorized operations in the facility for which they are not\nauthorized as part of their operation and produce harmful industrial discards that\nare not easy to dispose of.<\/li><li>Therefore, the Boards demand\nthe details of the manufacturing process and the list of products that will be\nmanufactured at the time of CTE application. Before issuing CTE too, the Board\nhas the authority to inspect the proposed site. <\/li><\/ul>\n\n\n\n<p>Site inspection by SPCB\/PCC are thus considered a cross-check on\npollution control by industry. SPCBs also integrate the stipulations for the\nabetment of water and air pollution in the case of <strong><a class=\"text-primary\" href=\"https:\/\/corpbiz.io\/environmental-clearance\">Environment Clearance<\/a><\/strong> as a proactive\nmeasure. Therefore, industries try to control pollution to comply with norms\nand send reports to SPCBs and PCC periodically. Industries hire laboratories to\nmonitor pollution and submit quarterly data to respective SPCBs or as per the\nagreed compliance conditions in the CTO. Some of these boards own XGN software\nsystems through which the industries can report pollution level data on a\nmonthly basis.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>After issuing Pollution NOC, the SPCBs\/PCC regularly monitor compliance by these industrial\/project units\/entities through periodic compliance reports. Under the Air Act and Water Act, SPCBs can obtain information, take samples, enter and inspect, punish polluters and restrain any non-complying entity through courts. Apart from Site inspection by SPCB\/PCC, these Boards also have the power to give directions for stoppage\/closure\/disconnection of electricity etc. Therefore, a smooth site inspection must be ensured to obtain CTO swiftly and hassle-free.
