For setting up an industry or any project, the project\nproponent must have a Pollution NOC from the Pollution Control Board or\nPollution Control Committee under the Water Act, 1974 and Air Act, 1981, in 2\nstages, i.e. CTE and CTO, before starting production. follows:<\/p>\n\n\n\n<ul><li>The Environmental (Protection) Act, 1986, amended\n1991<\/li><li>Air (P&amp;CP) Act, 1981<\/li><li>Hazardous Waste (Management &amp; Handling) Rules\n1989<\/li><li>Bio-medical Waste (Management &amp; Handling)\nRules, 1998<\/li><li>Public Liability Insurance Rules, 1991 amended\n1993<\/li><li>Manufacture, Storage and Import of Hazardous\nChemicals Rules, 1989<\/li><li>Municipal Solid Waste (Management &amp; Handling)\nRules, 2000.<\/li><li>Water (P&amp;CP) Act, 1974, amended 1988<\/li><li>Water Cess Act, 1977<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Requirement_of_CTO_after_Environmental_Clearance\"><\/span>Requirement of CTO after Environmental Clearance<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Any Mining unit, Industrial\nunit, Hospital, etc., which cause air and water pollution or discharge effluent\ninto streams, ponds, lakes, land, or any other water body must obtain Consent\nfrom SPCB, i.e. consent to operate (CTO).<\/p>\n\n\n\n<p>The project proponent requires\nconsent to operate (CTO) prior to the commencement of operation of any\nindustry, project, or activity under the provisions of the Water (P&amp;CP)\nAct, 1974, and Air (P&amp;CP) Act, 1981. The project proponent or manufacturer\nis required to secure this consent to ensure that the industry or project\nmaintains standards related to the operations.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">List of Industries or Projects Categorised\nBy the Pollution Control Board That Require CTO<\/h3>\n\n\n\n<p>CPCB re-categorised the industries, projects or activities under <strong>the Air (P&amp;CP) Act, 1981<\/strong><sup><a class=\"text-primary\" href=\"https:\/\/www.indiacode.nic.in\/bitstream\/123456789\/1389\/1\/Prevwater1981__41.pdf\"><strong>[1]<\/strong><\/a><\/sup> and the Water (P&amp;CP) Act, 1974, into three major categories based on the <strong>\u201cRange of pollution index\u201d<\/strong> for consent management, which is given in the table below:<\/p>\n\n\n\n<table class=\"wp-block-table table table-bordered\"><tbody><tr><td>\n  <strong>S.No.<\/strong>\n  <\/td><td>\n  <strong>Category<\/strong>\n  <\/td><td>\n  <strong>Pollution Index Score<\/strong>\n  <\/td><\/tr><tr><td>\n  1\n  <\/td><td>\n  Red\n  <\/td><td>\n  60 and above\n  <\/td><\/tr><tr><td>\n  2\n  <\/td><td>\n  Orange\n  <\/td><td>\n  41-59\n  <\/td><\/tr><tr><td>\n  3\n  <\/td><td>\n  Green\n  <\/td><td>\n  21-40\n  <\/td><\/tr><tr><td>\n  4\n  <\/td><td>\n  White\n  <\/td><td>\n  Upto 20\n  <\/td><\/tr><\/tbody><\/table>\n\n\n\n<h3 class=\"wp-block-heading\">The Consolidated List Of Industries\/Projects\nIs As Follows:<\/h3>\n\n\n\n<p><strong>Red\nCategory Of Industries\/Projects\/Processes\/Activities\/Mines: <\/strong>River\nvalley projects, Nuclear power plants, Isolated storage of Hazardous chemicals,\nLead acid battery manufacturing, mining or beneficiation, Airports,\nCement\/clinker manufacturing, CETP, TSDF, DG set of capacity more than or equal\nto 5 MVA capacity, Hotels, pesticides specific intermediates, Pharmaceuticals\n(excluding formulation), synthetic rubbers, Tanneries etc.<\/p>\n\n\n\n<p><strong>Orange\nCategory Of Industries\/Projects\/Processes\/Activities\/Mines: <\/strong>Aluminium\nand copper extraction from scrap, Biofuel (with boiler), Coal washeries, Flour\nmills (with washing), Mineral processing plant, New highway construction\nproject, restaurant with more than 25 seats, Stone crusher, water treatment\nplant etc.<\/p>\n\n\n\n<p><strong>Green\nCategory Of Industries\/Projects\/Processes\/Activities\/Mines: <\/strong>All types\nof commercial testing labs (except diagnostic centres), Ayurvedic and\nHomeopathic medicines (without boiler), Ready mix cement concrete, mineralised\nwater, Personal protective gear such as face masks, personnel protective\nequipment (PPEs) etc.<\/p>\n\n\n\n<p><strong>White Category\n(Exempted From Consent Mechanism): <\/strong>Agarbatti making units, Bio-fertilizer\nand bio-pesticides without using inorganic chemicals, Cold Storage, Diesel pump\nrepairing and servicing, Electric lamp and CFL manufacturing by assembling\nonly, Fly ash bricks\/ block manufacturing, packing of powdered milk, Rope\n(plastic and cotton), Wax Candles (excluding manufacturing of wax), etc. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Process_for_Applying_For_CTO_after_Environmental_Clearance\"><\/span>Process for Applying For CTO after Environmental Clearance<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" width=\"716\" height=\"1024\" src=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2023\/03\/image-4-716x1024.png\" alt=\"Process for Applying For CTO after Environmental Clearance\" class=\"wp-image-53456\" srcset=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2023\/03\/image-4-716x1024.png 716w, https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2023\/03\/image-4-210x300.png 210w, https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2023\/03\/image-4-768x1098.png 768w, https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2023\/03\/image-4.png 959w\" sizes=\"(max-width: 716px) 100vw, 716px\" \/><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Documents_Required_for_CTO\"><\/span>Documents\nRequired for CTO <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The project proponent will submit\nall documents in serial order as given by SPCB, along with scrutiny fees,\nthrough the online portal. The list of documents is as follows:<\/p>\n\n\n\n<ol><li>Application for CTO in prescribed format under Air\nand Water Act duly filled and signed by the authorised signatory<\/li><li>The SPCB calculates consent fees in accordance\nwith the notifications<\/li><li>Authority letter in favour of applicant\/Board of\nResolution\/Power of Attorney<\/li><li>Affidavit or undertaking in the prescribed format<\/li><li>Copy of land documents<\/li><li>CA Certificate in the prescribed format<\/li><li>Previous CTE\/CTO Compliance report, including\nmonitoring reports from Gazette-notified laboratories<\/li><li>Details of raw materials, products, and processes<\/li><li>CGWA NOC\/Contract with any agency for the supply\nof water<\/li><li>Copy of\nEC<\/li><li>Environmental statement in prescribed format under\nEnvironmental (Protection)Rules (For Red category Industries)<\/li><li>Copy&nbsp; of Public Liability Insurance Act (wherever\napplicable)<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Site_Inspection_for_CTO_after_Environmental_Clearance\"><\/span>Site\nInspection for CTO after Environmental Clearance<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>After\nsubmitting the consent to operate (CTO) application form to the concerned SPCB,\ngovernment officials visit the site to inspect the unit and verify compliance\nand implement all the conditions of the previous grant consent to establish the\nfollowing:<\/p>\n\n\n\n<ol><li>To confirm that the construction at the site is as\nper the site plan and proposal submitted for consent to establish.<\/li><li>Verification of information provided in profile\nand application for consent\/authorisation.<\/li><li>Verification of site layout plan with details of\nthe location of a source of air pollution (Boiler, furnace, reactor, process\nemission etc.) and water pollution (ETP, STP, CETP, SLF, treated water disposal\narea, outlet etc.) as proposed during CTE application.<\/li><li>Verification of compliance with the conditions\ngiven in consent to establish.<\/li><li>Ensuring the complete installation of air and\nwater pollution Control arrangements (technical specifications) as proposed\nduring CTE {ETP, STP, APCS (Air Pollution Control System)} before grant of\nconsent to operate.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Fees_for_Obtaining_CTO\"><\/span>Fees\nfor Obtaining CTO<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>State pollution control Board generates\nconsent fees depending upon the following:<\/p>\n\n\n\n<ul><li>Category of the Industry<\/li><li>Capital Investment cost of Industries\/Projects<\/li><\/ul>\n\n\n\n<p><strong>Note: <\/strong>Consent\nfee may vary from state to state.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Validity_and_Renewals_for_CTO_after_Environmental_Clearance\"><\/span>Validity\nand Renewals for CTO after Environmental Clearance<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Usually, The State Pollution\nControl Board (SPCB) will issue consent to operate for 5, 10, and 15 years in\nthe case of red, orange, and green categories, respectively.<\/p>\n\n\n\n<table class=\"wp-block-table table table-bordered\"><tbody><tr><td>\n  <strong>S.No.<\/strong>\n  <\/td><td>\n  <strong>Category<\/strong>\n  <\/td><td>\n  <strong>Validity Period<\/strong>\n  <strong>(In years)<\/strong>\n  <\/td><\/tr><tr><td>\n  1\n  <\/td><td>\n  Red\n  <\/td><td>\n  5 \n  <\/td><\/tr><tr><td>\n  2\n  <\/td><td>\n  Orange\n  <\/td><td>\n  10\n  <\/td><\/tr><tr><td>\n  3\n  <\/td><td>\n  Green\n  <\/td><td>\n  15\n  <\/td><\/tr><\/tbody><\/table>\n\n\n\n<p><strong>Note:<\/strong> It may\nvary from state to state.<\/p>\n\n\n\n<ul><li>CTO Renewal application will be made within the\nprescribed time limit before consent expiry.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Penalties_Levied_By_the_Pollution_Control_Board\"><\/span>Penalties\nLevied By the Pollution Control Board<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Suppose\nthe project proponent operates any project\/ industry\/ plant without obtaining\nconsent to operate. In that case, the PP will be liable for imprisonment for a\nterm or issued show cause notice with a fine which may extend.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>India\u2019s vision towards the National clean air program (NCAP) is to prevent, manage and control air pollution by at least 40% by 2026 and, likewise, prevent and control water pollution under the National Water Mission. Given this mission, all the industrial sectors\/projects require consent to establish and operate from the pollution control board under Air &amp; Water Act.
