No\nwonder India&#8217;s cement industry is vital to its economy, providing employment to\nmore than a million people directly or indirectly. In some of the recent major\ngovernment initiatives taken in October 2021, Prime Minister, Mr Narendra Modi,\nlaunched the &#8216;PM Gati Shakti National Master Plan (NMP)\u2019 for multimodal\nconnectivity and created an excellent, seamless multimodal transport network in\nIndia. With the increasing demand for cement in the future, the demand for this\nindustry is bound to rise and will attract strict scrutiny from governmental\nagencies. The requirement of prior Environmental Clearance\nfor Cement plants which is listed as 3(b) in the schedule as per EIA\nNotification, 2006, defines the categorization for the project based on the\nproduction capacity and grinding units falling under:<\/p>\n\n\n\n<ul><li><strong>Category A<\/strong> ( MoEF&amp;CC and EAC): \u2265\n1.0 Million Tonnes\/annum production capacity<\/li><li><strong>Category B<\/strong> (SEIAA and SEAC): &lt;1.0\nMillion Tonnes\/annum production capacity, All stand-alone grinding units<\/li><\/ul>\n\n\n\n<p><strong>&nbsp;Table 1.1:\nList of the Project in Schedule I as Per EIA Notification, 2006 (Amended Notification\non 23.11.2016)<\/strong><\/p>\n\n\n\n<table class=\"wp-block-table table table-bordered\"><tbody><tr><td>\n standards.The manufacturing of composite cement by having\n  environmental clearance for cement plants for the manufacturing of Ordinary\n  Portland Cement (OPC) and Portland Pozzolana Cement (PPC) and Portland Slag\n  Cement (PSC) shall be exempt provided the production is within sanctioned\n  capacity.\u201d\n  \n  <\/td><\/tr><\/tbody><\/table>\n\n\n\n<p>Before\nstarting any project, preparation of land except for securing the land is\nstated on the project or activity such as:<\/p>\n\n\n\n<ol><li>All new projects<\/li><li>Expansion and modernization of the existing\nproject<\/li><li>Any change in product mix in an existing\nmanufacturing plant\/unit<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Process_for_Obtaining_Environment_Clearance\"><\/span>Process for Obtaining Environment\nClearance<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\nprocess of obtaining environmental clearance for cement plants consists of the following\nstages are as follows: <\/p>\n\n\n\n<ol><li>Screening<\/li><li>Scoping <\/li><li>Public consultation, including the process of Process for\nEnvironmental Clearance<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ol><li>Identification of Site Selection by the Project\nProponent<\/li><li>Carrying out a pre-feasibility study required for\nthe prior environmental clearance for cement plants using Form 1 given in <strong>Annexure\nIV<\/strong> of EIA Notification 2006. <\/li><li>The project proponent has to submit the filled-in\nForm 1 along with the pre-feasibility report and draft ToR (for Cement Plants)\nfor EIA studies to the concerned authority (through Parivesh portal), i.e.,\nMoEF&amp;CC, Government of India for Category A projects and the SEIAA in case\nof Category B projects.<\/li><li>After scrutinizing the documents, the concerned\nauthority declares the results on the portal, whether the project is approved\nor not. If the project requires an EIA study, the committee releases a ToR\nletter to the proponent.<\/li><li>Draft EIA will be submitted in hard copy to SPCB,\nZila Parishad, Collector etc., with the incorporation of ToR points required\nfor Public consultation.<\/li><li>After incorporating the Public hearing minutes in\nthe final EIA report, the project proponent has to submit the required\ndocuments (i.e. ToR letter, Final EIA Report, Form-2 etc.) with the help of a\nconsultant on the portal with the same credentials.<\/li><li>Appraisal and clearance by the concerned authority\n(i.e. EC letter issued either in hard\/soft copy)<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Laws_and_Regulations_Applicable_For_Environment_Clearance\"><\/span>Laws and Regulations Applicable\nFor Environment Clearance<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Various laws and regulations\napplicable at the stage of environmental clearance are as follows:<\/p>\n\n\n\n<ul><li>The Environmental (Protection) Act, 1986, amended\n1991<\/li><li><strong>EIA Notification, 2006<\/strong><sup><a class=\"text-primary\" href=\"http:\/\/www.environmentwb.gov.in\/pdf\/EIA%20Notification,%202006.pdf\"><strong>[1]<\/strong><\/a><\/sup><\/li><li>Forest Clearance as per Forest (Conservation) Act\n1980<\/li><li>Wildlife Clearance (NBWL) as per Wildlife\n(Protection) Act 1972<\/li><li>CRZ (Coastal Regulation Zone) Rules.<\/li><li>Hazardous Waste Management Rules<\/li><li>Public Liability Insurance Rules, 1991 amended\n1993<\/li><li>Water Act, 1974 amended 1988<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Generic_Structure_of_EIA_Report\"><\/span>Generic Structure of EIA\nReport<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\ngeneric Structure of the EIA report, as mentioned in Appendix III of the EIA\nNotification, applicable to Cement plants, is designed as per the given layout.<\/p>\n\n\n\n<ol><li>Introduction<\/li><li>Project Description<\/li><li>Description of the Environment<\/li><li>Anticipated Environmental Impacts &amp; Mitigation\nMeasures<\/li><li>Analysis of Alternatives (Technology &amp; Site)<\/li><li>Environmental Monitoring Program<\/li><li>Additional Studies<\/li><li>Project Benefits<\/li><li>Environmental Cost Benefit Analysis<\/li><li>Environment\nManagement Plan<\/li><li>Summary &amp; Conclusion<\/li><li>Disclosure\nOf Consultants Engaged<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Annexures_of_EIA_Report_for_Obtaining_EC\"><\/span>Annexures of EIA Report for\nObtaining EC<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ol><li>Land Documents: Land agreement\/Lease deed etc.<\/li><li>Site Photographs: Geotagged site photographs of\nNorth, South, East &amp; West directions.<\/li><li>Primary Data: Baseline Monitoring reports with\nphotographs of Air, Water, Noise &amp; Soil quality of 3 months.<\/li><li>Secondary Data: Hourly Meteorological by IMD,\nClimatological, etc.<\/li><li>Authenticated List of Flora &amp; Faunal species\nof the study area by DFO.<\/li><li>DCF certificate showing the\navailability\/non-availability of a National park, Wildlife Sanctuary, Biosphere\nReserve, Protected Forest, Elephant corridor\/reserve, and Eco-sensitive zone\nwithin a 10 Km study area.<\/li><li>Maps showing topography, geology, land\nclassification, groundwater fluctuation, etc.<\/li><li>ToR Letter &amp; ToR compliance<\/li><li>Public Hearing proceedings<\/li><li>Hydrogeological\nReport<\/li><li>CGWA NOC (if applicable)<\/li><li>Permission\nfrom the concerned department showing power and water supply connections.<\/li><li>Detailed\nProject Report<\/li><li>Quality\ntest certificate for analysis of Limestone and slag etc.<\/li><li>Socio-economic\ndata<\/li><li>NABET\nCertificate of Accredited consultant<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Composition_of_the_EIA_Team\"><\/span>Composition of the EIA Team<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>To assess\nthe significant impacts (direct, indirect, and cumulative impacts), the EIA study\nprimarily depends on the constitution of the right team at the right time,\npreferably at the initial stage of obtaining Environmental clearance for cement\nplants.
