However, these\nactivities though beneficial for humanity, may have adverse impacts on the\nenvironment, so there is always a need to adjust developmental activities along\nwith the concerns of the environment. Environmental impact assessment (EIA) has\nbeen introduced by many countries, including India, as an environment\nprotection-specific legislation. Under <strong>the Environment (P) Act 1986<\/strong><sup><a class=\"text-primary\" href=\"https:\/\/cpcb.nic.in\/env-protection-act\/\"><strong>[1]<\/strong><\/a><\/sup>, the Government\nissued several notifications related to the conservation of the environment,\none of which was the EIA Notification of 2006, which made EIA mandatory for\nspecific projects to obtain Environment Clearance (EC). EIA tries to identify\nthe impacts (both adverse and beneficial) of any proposed private and public\ndevelopment projects. In this write-up, we will understand the stages a project\nmust go through before it can get clearance for the project by the MoEF&amp;CC.\nFirst, let\u2019s look at the category of projects that will need an Environment\nImpact Assessment.<\/p>\n\n\n\n<p><strong>Category A projects<\/strong> are projects whose\nsize and cost are greater than certain levels as defined in the Schedule.\nEnvironmental clearance for projects of this nature is issued at the central\nlevel. Physical infrastructure like ports, highways, urban transport, water and\nsanitation, solid waste management sectors, etc., mandatorily require EC and do\nnot undergo the screening process.<\/p>\n\n\n\n<p><strong>Category B projects<\/strong>&nbsp;are those with smaller\ncapacity or size and that will have a lesser impact than projects in category\nA. Environment clearance for B Category projects is issued at the State\ngovernment level. Each State has dedicated Boards which would give clearance to\nthe project. These projects will require a screening process at the next stage.\nAfter the screening, if the authority thinks that the project will have no\nsignificant effect on the environment, it may be exempted from the requirement\nof EIA and get classified as a B2 category project. While doing so, consequences and effects on the\nenvironment must be characterised in the early stages of the proposal of the\nproject, and mitigation measures must be inculcated in the project design.<\/p>\n\n\n\n<p>EIA tries to foresee the potential environmental problems that could\narise from a proposed activity and address them in the planning and design\nstages of the project. The <strong><a class=\"text-primary\" href=\"https:\/\/corpbiz.io\/environmental-impact-assessment-eia\">Environmental Impact Assessment<\/a><\/strong> process should\nthen allow for the communication of this information to all the parties, i.e.<\/p>\n\n\n\n<ul><li>Project proponent<\/li><li>Regulatory agencies; and <\/li><li>Stakeholders and interest\ngroups<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Stages_in_EIA\"><\/span>Stages in EIA<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Environmental Impact Assessment has five main stages. If an EIA is\nrequired, an Environmental Assessment Impact Report has to be submitted with\nthe application for consent. The public will have the chance to comment. To\nmake sure they are given an opportunity to be involved in decision-making.<\/p>\n\n\n\n<table class=\"wp-block-table table table-bordered\"><tbody><tr><td>\n  <strong>Stage of EIA<\/strong>\n  <\/td><td>\n  <strong>Why Needed<\/strong>\n  <\/td><td>\n  <strong>Detailed<\/strong>\n  <\/td><\/tr><tr><td>\n  <strong>Screening Stage<\/strong>\n  <\/td><td>\n  To Decide if an EIA is required\n  &nbsp;\n  <\/td><td>\n  Applies to Category B projects.\n  The SEAC or the State-level Expert Appraisal Committee will review the\n  application to determine if the project will need further environmental\n  studies for the preparation of the report.\n  <\/td><\/tr><tr><td>\n  <strong>Scoping Stage<\/strong>\n  <\/td><td>\n  For Terms of Reference (TOR)\n  <\/td><td>\n  Performed by the consultant as per\n  the requirements of project proponent and environment-related obligations.\n  <\/td><\/tr><tr><td>\n  &nbsp;<strong>Public Consultation Stage\n  <\/strong>\n  (for Category A and B1&nbsp;)\n  <\/td><td>\n  needed to address issues of the local\n  community\n  <\/td><td>\n  This stage involves consultation\n  with project-affected persons on the effects of the project.\n  <\/td><\/tr><tr><td>\n  <strong>Appraisal Stage<\/strong>\n  <\/td><td>\n  an inspection to find out the merits\/demerits\n  of the Regulatory Authority\n  <\/td><td>\n  The detailed scrutiny of the final\n  EIA report will be presented to the SEAC or the EAC. They will consider the\n  environmental aspects of the project and then make recommendations to the\n  Regulatory Authority on whether EC should be granted or not.\n  <\/td><\/tr><\/tbody><\/table>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Generalised_EIA_Process\"><\/span>Generalised EIA Process<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>An application seeking an EC must be made in the&nbsp;prescribed\nForm 1&nbsp;of the Environmental Impact Assessment Notification before\ncommencing the project to the MoEF&amp;CC. The applicant must submit a pre-feasibility\nreport&nbsp;with the application. In addition to the EC, permits like Consent\nNOC under the Air and Water Act for the projects must be obtained from the\nconcerned State Governments where the project is located. This can be pursued\nin a parallel process and will usually take lesser time than the EC process.\nThe following details must be made ready while going for the Environmental\nImpact Assessment.<\/p>\n\n\n\n<p><strong>Data and Reports<\/strong><\/p>\n\n\n\n<ul><li>Basic project information such\nas the name, location etc.)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;  <\/li><li>Details of activity linked to\nthe project:&nbsp;&nbsp;  <\/li><li>Actions causing physical\ntransformations&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;  <\/li><li>The project\u2019s use of natural\nresources&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;  <\/li><li>Associated substances or\nmaterials that could be hazardous or harmful&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \n<\/li><li>Production of solid wastes  <\/li><li>Release of contaminants into\nthe air, ground and waterways&nbsp;  <\/li><li>Generation of vibration and\nnoise and emissions of light and heat&nbsp;&nbsp;&nbsp;  <\/li><li>Risk of accidents&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;  <\/li><li>Factors that could cause\ncumulative impacts or consequential effects&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \n<\/li><li>Details of environmentally\nsensitive areas within a certain distance of the project site<\/li><li>Proposed TOR for the EIA study<\/li><\/ul>\n\n\n\n<p><strong>Documents<\/strong><\/p>\n\n\n\n<ul><li>Final Environmental Impact\n     Assessment Report<\/li><li>A copy of the videotape or CD of\n     the public hearing proceedings (where public consultations are mandatory \u2013\n     see process requirements below)<\/li><li>A copy of the final layout plan<\/li><li>A copy of the project feasibility\n     report<\/li><\/ul>\n\n\n\n<p>The project proponent will need to prepare the Detailed Project\nReport to the Feasibility Report and submits an executive summary, incorporating\nthe project details, findings of the study etc., and make it public to the concerned\npopulation. The proponent must approach the concerned SPCB for NOC and hold the\npublic hearing. After the public hearing, the proponent submits its application\nto IAA for environmental clearance.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The entities preparing the Environmental Impact Assessment Report must be conversant with the existing legal and procedural requirements for obtaining environmental clearance for the project. The consultant must be able to guide the project proponent through the initial screening of the project and establish whether EIA studies are required and, if so, finalise the scope of that study.
